05/20/2019May 20, 2019 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Harriet Rosenthal in the Council Chambers of the Village Hall on May 20, 2019 at 7:30 p.m. The clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Robert Benton Tom Jester William Seiden Dan Shapiro Barbara Struthers Absent: Mary Oppenheim and that a quorum was present and in attendance. Also present were Village Manager Kent Street and Steven Elrod, Village Attorney. PLEDGE OF ALLEGIANCE Talia Joseph led those in attendance in reciting the Pledge of Allegiance. Ms. Joseph, 10, started the organization Kindness Counts to spread kindness and help charities. Her organization has fundraisers. The most recent project, selling water bottles, benefitted Gigi's Playhouse. She raised more than $1,500 for the organization. PRESENTATION — DELTA DHS Students from Delta DHS discussed substance abuse. The local high school students discussed the Delta program and its focus on substance abuse education and prevention. They discussed the commercialization of marijuana. They asked the Mayor and Board to pass a resolution asking the State not to legalize marijuana and to not allow dispensaries in the Village. Sponsor Barbara de Nekkar stated their goal is to help education the community and lawmakers about the facts. PRESENTATION — AMERICAN LEGION Master Sergeant George Ybarra with the U.S. Army noted American Legion Post 738 will host the Memorial Ceremony at 10 a.m. on May 27 at the Jewett Park veterans memorial. They will have an open house from 11 a.m. to 1 p.m. at 849 Waukegan Road in celebration of the 100t' anniversary of the American Legion. They ask participants to bring a non-perishable food items for the Midwest Veterans Closet. Deerfield Post 738 was responsible for starting the food pantry that serves three states. Mayor Rosenthal noted the Village will have a collection box in the Village Hall lobby. PRESENTATION — RICH DEVROEG Director of Public Works and Engineering, Bob 25 YEARS OF SERVICE Phillips, introduced Rich DeVroeg, who has worked at the water reclamation facility since 1994. He is responsible for maintenance of mechanical and electrical equipment and is a key to the success of the wastewater treatment plant. Mayor Rosenthal presented Mr. DeVroeg a watch for his 25 years of service. Mr. DeVroeg thanked the Village. Board of Trustees Meeting May 20, 2019 Page 2 of 5 DOCUMENT APPROVAL Trustee Struthers moved to approve the minutes from the May 6, 2019, Board of Trustees meeting. Trustee Shapiro seconded the motion. The motion passed unanimously on a voice vote. BILLS AND PAYROLL Trustee Seiden moved to approve the Bills and Payroll dated May 20, 2019. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Seiden, Shapiro, Struthers (5) NAYS: None (0) PUBLIC COMMENT There was no public comment on non -agenda items. REPORTS REPORT AND RECOMMENDATION Trustee Benton recused himself and left the Board OF STAFF RE: FOUNTAINS OF Room. Mr. Phillips reported the Fountains of DEERFIELD DREDGING PROJECT Deerfield were built in 1991. There were no formal agreements or maintenance requirements for the dredging of the pond. The sediment has caused the detention basin to fill up over time. Mr. Phillips noted that the Village is responsible for 38 percent of the sedimentation and believes the Village should share in the cost of the project. The bid came in at $70,000 and 38 percent of the bid is $26,600. The Village proposes waiving the permit fees in that amount. Trustee Jester moved to accept the report and recommendation of staff and waive the permit fees for the Fountains of Deerfield Dredging Project in the amount of $27,000. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Seiden, Shapiro, Struthers (5) NAYS: None (0) OLD BUSINESS ORDINANCE AUTHORIZING AN Mayor Rosenthal noted the petitioner requested a AMENDMENT TO A SPECIAL USE TO waiver of the First Reading of the Ordinance. The motion passed by the MIDDLE SCHOOL (DEERFIELD following vote: PUBLIC SCHOOL DISTRICT 109) — 1R AYES: Benton, Jester, Shapiro, Struthers (4) NAYS: Seiden (1) Mayor Rosenthal inquired about the glass used in the windows and how they would stand up against gunfire from an assault weapon. Carole Pugh from Green Associates Architects noted that District 109 discussed protective grades of glass and selected one that offers some protection against gunfire. Mr. Elrod noted they can work with staff on a higher protection glass. Mr. Street indicated a minimum standard can be met, but a higher standard can be requested. Mr. Elrod noted if the Board requires a higher standard, it can be put in the Ordinance. Trustee Jester noted that this could set a precedent for future school construction. Trustee Shapiro suggested considering this Ordinance then consider adopting an Ordinance with a stronger glass if this one fails. Trustee Seiden would like the stronger glass as well, but questioned whether the Board should just make a recommendation to the School Board. Mr. Elrod noted if the motion to approve the Ordinance fails, it would be final action on that document. Trustee Seiden moved to reconsider the waiver of the First Reading. Trustee Shapiro seconded the motion. NEW BUSINESS DISCUSSION UPDATE ON ASSAULT WEAPON BAN Mr. Elrod reported the Village appealed the Circuit Court's decision to the Second District Appellate Board of Trustees Meeting May 20, 2019 Page 5 of 5 Court on April 22, 2019. They requested an expedited briefing schedule and the last brief was filed on May 16, 2019. The next step is for the Second District Court to set a date for oral argument. Mr. Elrod indicated the oral argument would not require testimony by the Village Board or staff. PUBLIC WORKS OPEN HOUSE Mayor Rosenthal thanked Bob Phillips and his team at Public Works for a great open house on Saturday. The event was well attended and there were a number of activities and interesting things to see. DHS ANNUAL JAM FOR JUSTICE students did a wonderful job. CONGRATULATIONS Conference. Mayor Rosenthal attended the human rights group annual event. There were a lot of activities and the Mayor Rosenthal congratulated Trustee Shapiro on becoming the Secretary of the Northwest Municipal DISTRICT 113 MEETING Mayor Rosenthal and Mr. Street met with Dr. Bruce Law, the new Superintendent of District 113. Both the Village and District 113 want the community to be informed of the good work being done. TRUSTEE IN THE TOWN Trustee Seiden reported the Mayor and Trustees would be participating in the Farmer's Market with Trustee in the Town from June through September. He will send out the dates. VEHICLE STICKERS Mr. Street reminded residents that vehicle stickers went on sale today. Enforcement goes into effect on July 1, 2019. He encouraged residents to use the online system. ADJOURNMENT There being no further business or discussion, Trustee Struthers moved to adjourn the meeting. Trustee Benton seconded the motion. The motion passed unanimously on a voice vote.
