RESOLUTION NO. 2021- R-21-33
A RESOLUTION APPROVING A PLAT OF EASEMENT
FOR A SIDEWALK
(1121 Greenwood Avenue)
WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in
accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970;
and
WHEREAS, Heather Varon ("Owner') is the owner of the property located at
1121 Greenwood Avenue, Deerfield ("Property's; and
WHEREAS, the Village desires to construct a sidewalk on the Property,
necessitating the Village to obtain easements on the Property; and
WHEREAS, the Owner desires to grant the Village a five foot wide easement for a
sidewalk over, across, upon, and under a five foot wide portion of the Property, pursuant to
a plat of easement ("Plat of Easement'; and
WHEREAS, the Village Board has determined that approval of the Plat of
Easement will serve and be in the best interests of the Village and its residents;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals
as its findings, as if fully set forth herein.
SECTION 2: APPROVAL OF PLAT OF EASEMENT. The Village Board hereby
approves the Plat of Easement, substantially in the form attached to this Resolution as
Exhibit A, and in a final form to be approved by the Village Manager and the Village
Attorney.
SECTION 3: AUTHORIZATION TO EXECUTE EASEMENT AGREEMENTS.
The Village Board hereby authorizes and directs the Village President and the Village
Clerk to execute and seal, on behalf of the Village, the Plat of Easement and all necessary
documentation related thereto.
SECTION 4: EFFECTIVE DATE. This Resolution shall be in full force and effect
from and after its passage and approval according to law.

EASSIENT PROVISIONS
An easement is hereby reserved and granted to the Village of Deerfield
for the perpetual right privilege and authority to Canstrucl, reconstruct,
repair, replace, remove, inspect and maintain a sidewalk over, upon
and through the -5.00' easement for sidewalk" as indicated hereon,
together with right of access across the property, for necessary men
and equipment to do any of the above work. Location of the sidewalk
within the easement shall be subject to the approval of the Village of
Deerfield, as to design and location. All installations are subject to the
ordinonces of the VIloge of Deerfield.
It shall include the right to enter the subdivided property for oil such
purposes, and the right without liability to cut, trim, alter, or remove
any vegetation. roots, structures or devices within the designated
eaement property as may be reasonably required incident to the right
herein given.
Without prior written consent of grantee, no buildings, structures or
other obstruction shall be constructed, planted, or placed in any such
easement areas, streets. or other public ways or places, nor shall any
other uses be made thereof which will interfere with the easements
reserved and granted hereby.
Such easements shall survive the vacation by authority of any street
and other public way and place shown on this plot, unless otherwise
expressly mentioned in an ordinance of vacation.
