VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -15 -15 AN ORDINANCF, APPROVING AN AMENDMENT TO THE SIGN PLAN FOR WALGRF,ENS COMPANY CORPORATE CAMPUS 102 -304 WILMOT ROAD) WHEREAS, the owner (the "Petitioner') of the property commonly known as Walgreens Corporate Campus at 102. 104, 106, 108, 200, 300, 302 and 304 Wilmot Road. Deerfield, Illinois, and legally described on Exhibit A attached hereto (the "Subject Property "), has petitioned the Plan Commission of the Village of Deerfield for approval of an amendment to the approved sign plan for the Subject Property to: (A) replace an existing single flag pole with one 1) new 40 -foot flagpole facing Wilmot Road at the 200 Wilmot Road driveway entrance to fly an 8 -foot by 12 -foot American flag, with two (2) new 35 -foot flagpoles on each side to fly commercial flags featuring the Walgreens red script logo and the logo for Walgreens Boots Alliance, including removal of the existing single flagpole; and (B) replace an existing double -faced monument ground sign at the driveway entrance for the 200 Wilmot Road building with two (2) single -face monument ground signs, each with a total area of 72 square feet, one containing the words "Walgreens Boots Alliance Global Headquarters" with a logo, and the second containing the words "Walgreens" and "Community Support Center" (the "New Business Ground Signs "), as an amendment to the approved sign plan for the Subject Property and to the Special Use Planned Unit Development of the Subject Property in the 1 -1 Office, Research and Restricted Industrial; and WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on April 23, 2015 to consider Petitioner's request for approval of the New Business Ground Signs as an amendment to the approved sign plan for the Subject Property, including requests for the following sign modifications: (i) a sign modification to allow two commercial flags (Walgreens Boots Alliance and Walgreens) to be flown from flag poles in addition to the two (2) ground signs permitted for the Subject Property frontage; (ii) a sign modification to permit the two (2) proposed single -face monument ground signs with a total area of 144 square feet (72.0 sq. ft. per sign) to exceed the maximum surface area of 90 square feet permitted for the ground signs; (iii) a sign modification to allow the three (3) proposed flag poles and the two (2) proposed single faced ground signs to be located within the required perimeter setback of the Subject Property; and. (iv) a sign modification to permit the two (2) proposed single -face monument ground signs that are located within 112 feet of a residential district to be illuminated after 11:00 p.m. (the "Sign Modifications "); and WHEREAS, the said public hearing was held pursuant to public notice duly given as required by law and conformed in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Plan Commission, after considering the proposed New Business Ground Signs as an amendment to the approved sign plan for the Subject Property, the requested Sign Modifications and the evidence and supporting materials offered at said public hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that the New Business Ground Signs, including the Sign Modifications, be approved as an amendment to the approved sign plan for the Subject Property and as an 2- amendment to the Special Use Planned Unit Development of the Subject Property in the 1 -1 Office, Research and Restricted Industrial District; and WHEREAS, the President and Board of Trustees of the Village of Deerfield find that an amendment to the approved Sign Plan for the Walgreens Corporate Campus should be approved for the Subject Property to permit: (A) the replacement of an existing single Flag pole with one (1) new 40 -foot flagpole facing Wilmot Road at the 200 Wilmot Road driveway entrance to Fly an 8 -foot by 12 -foot American flag with two (2) new 35 -foot flagpoles on each side to fly commercial flags featuring the Walgreens red script logo and the logo for Walgreens Boots Alliance, including removal of the existing single flagpole; and (B) the replacement of an existing double -faced monument ground sign at the driveway entrance for the 200 Wilmot Road building with two (2) single -face monument ground signs, each with a total area of 72 square feet. one containing the words `Walgreen Hoots Alliance Global Ifeadquarters" with a logo, and the second containing the words "Walgreens" and "Community Support Center" (the "New Business Ground Signs "), including said Sign Modifications, as an amendment to the approved sign plan for the Subject Property and as an amendment to the Special Use Planned Unit Development of' the Subject Property in the 1 -1 Office, Research and Restricted Industrial, all in accordance with an to the extent depicted on the plans, documents and supporting exhibits presented by the Petitioner and attached hereto as Exhibit B hereof; NOW, TIIEREFORE, BE IT ORDAINED BY THE. ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance. are hereby incorporated and made a part of this Ordinance as if fully set forth herein. 3- SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby find that the requested amendment to the approved sign plan for the Subject Property, consisting of the New Business Signs and the Sign Modifications, fully complies with the requirements and standards set forth in Article 9.02 -C PUD and in Article 12.01 -8,1 of the Zoning Ordinance ofthe Village of Deerfield. SECTION 4: That the approval and authorization of said amendment to the approved sign plan for the Subject Property is hereby granted subject to the following additional conditions, regulations and restrictions: ME A. That the construction, maintenance and use of the New Business Ground Signs described in Section 3 of this Ordinance as hereby approved shall be in accordance with the supporting documents, materials and exhibits attached hereto and made a part hereof as Exhibit B: B. Compliance with all representations submitted and made by the Owner to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. C. Continued compliance by the Petitioner with the Final Development Plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the I -I Office. Research and Restricted Industrial District, including the sign plan for the Subject Property as hereby amended. D. Continued compliance by the Petitioner with all other applicable provisions ol'the Zoning Ordinance of the Village of Deerfield. SEC'T'ION 5: That the amendment to the approved sign plan for the Subject Property, hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property, shall be binding upon and inure to the benefit of Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by Petitioner or its successor, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of-the Recorder of Deeds of Lake County, Illinois, at Petitioner's expense. SECTION 7: That this Ordinance, and each of its terns, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions ofcurrent or subsequent non - preemptive state law; or. (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within itsjurisdiction. 5- SECTION 8: That this Ordinance shall be in full force and effect fi•om and after its passage, approval and publication in pamphlet form as provided by law.
