AN ORDINANCE PROVIDING FOR FIRE LIMITS AND REGULA-
TIONS GOVERNING THE CONSTRUCTION, ALTERATION, RE-
MOVAL, DEMOLITION, EQUIPMENT, USE AND OCCUPANCY,
LOCATION AND MAINTENANCE OF BUILDINGS AND STRUCTURES
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,ILLINOIS, AS FOLLOWS:
SECTION
ONE:
ADOPTION OF BUILDING CODE
There is hereby adopted by the President and Board of
Trustees for the purpose of establishing rules and
regulations for the construction, alteration, removal, demolition,
equipment, use and occupancy, location and maintenance of buildings
and structures, including permits and penalties that certain
building code known as the National Building Code recommended by
the American Insurance Association, successor to the National
Board of Fire Underwriters, being particularly the 1967 edition
thereof and the whole thereof, save and except such portions
as are hereinafter deleted, modified or amended, of which not
less than three (3) copies have been and are now filed in the
office of the Building Commissioner of the Village of Deerfield
and the same are hereby adopted and incorporated as fully as if
set out at length herein, and from the date on which this ordinance
shall take effect, the provisions thereof shall be controlling in
the construction of all buildings and structures other than single -
and two - family construction, therein contained within the corporate
limits of the Villageof Deerfield.
SECTION
TWO:
ESTABLISHMENT OF OFFICE OF BUILDING OFFICIAL
(a) The office of building official is hereby created
and the executive in charge shall be known as the
building official.
(b) The building official shall be appointed by the
President and Board of Trustees. His appointment shall continue
during good behavior and satisfactory service. He shall not be
removed from office except for cause after full opportunity has
been given him to be heard on specific charges.

(c) During temporary absence or disability of the
building official, the appointing authority shall designate an
acting building official.
SECTION QUALIFICATIONS OF BUILDING OFFICIAL
THREE
To be eligible to appointment, the candidate for the
position shall have had experience as an architect,
structural engineer, building inspector or superintendent of
building construction. He shall be in good health, physically
capable of making the necessary examinations and inspections.
He shall not have any interest whatever, directly or indirectly,
in the sale or manufacture of any material, process or device
entering into or used in or in connection with building construc-
tion, alterations, removal, and demolition.
SECTION DUTIES OF BUILDING OFFICIAL
FOUR:
(a) The building official shall devote his whole time
to the duties of his office. He shall receive applica-
tions required by this code, issue permits and furnish the prescribed
certificates. He shall examine premises for which permits have
been issued and shall make necessary inspections to see that the
provisions of law are complied with and that construction is prose-
cuted safely. He shall enforce all provisions of the building
code. He shall, when requested by proper authority, or when the
public interest so requires, make investigations in connection
with matters referred to in the building code and render written
reports on the same. To enforce compliance with law, to remove
illegal or unsafe conditions, to secure the necessary safeguards
during construction, or to require adequate exit facilities in
buildings and structures, he shall issue such notices or orders
as may be necessary.
(b) Inspections required under the provisions of the
building code shall be made by the building official or his duly
appointed assistant. The building official may accept reports of
inspectors of recognized inspection services, after investigation
of their qualifications and reliability. No certificate called
for by any provision of the building code shall be issued on such
reports unless the same are in writing and certified to by a re-
sponsible officer of such service.
(c) The building official shall keep comprehensive
records of applications, of permits issued, of certificates issued,
of inspections made, of reports rendered, and of notices of orders
issued. He shall retain on file copies of required plans and all
documents relating to building work so long as any part of the
building or structure to which they relate may be in existence.

(d) All such records shall be open to public inspec-
tion for good and sufficient reasons at the stated office hours,
but shall not be removed from the office of the building official
without his written consent.
(e) The building official shall make written reports
to his immediate superior once each month, or oftener if requested,
including statements of permits and certificates issued, and
orders promulgated.
SECTION
FIVE:
LIABILITY OF BUILDING OFFICIAL
The building official or any employee charged with the
enforcement of this code, acting in good faith and
without malice for the Village in the discharge of his duties,
shall not thereby render himself liable personally and he is hereby
relieved from all personal liability for any damage that may accrue
to persons or property as a result of any act required or by rea-
son of any act or omission in the discharge of his duties. Any
suit brought against the building official or employee, because of
such act or omission performed by him in the enforcement of any
provisions of this code, shall be defended by the legal department
of the Village until final termination of the proceedings.
SECTION
SIX:
COOPERATION OF OTHER OFFICTALS
The building official may request and shall receive so
far as may be necessary, in the discharge of his duties,
the assistance and cooperation of other officials of the municipality.
SECTION
SEVEN:
RIGHT OF ENTRY
The building official, in the discharge of his official
duties, and upon proper identification, shall have
authority to enter any building, structure or premises at any
reasonable hour.
SECTION
EIGHT:
DEFINITIONS
(a) Wherever the word "Municipality" is used in the
building code, it shall be held to mean the Village
of Deerfield.
(b) Wherever the term "Corporation Counsel" is used
in the building code, it shall be held to mean the Attorney for
the Village of Deerfield.

SECTION FIRE LIMITS ESTABLISHED
NINE:
The fire limits of the Village of Deerfield are hereby
established as follows:
All properties zoned B -1, B -2, and B -4
SECTION FEES
TEN:
(a) No permit as required by the building code shall
be issued until the fee prescribed in this ordinance
shall have been paid. Nor shall an amendment to a permit be
approved until the additional fee, if any, due to an increase
in the estimated cost of the building or structure, shall have
been paid.
(b) For a permit for the construction or alteration of
a building or structure, the schedule of fees shall be as follows:

D. Miscellaneous, Alterations & Repairs
a. The cost of the permit fee shall be computed on an esti-
mate of cost by the Building Commissioner in accordance with
the following schedule:
The permit fee shall be Four Dollars ($4.00) for each One
Thousand Dollars ($1,000.00) or fraction thereof of the.cost
of the proposed building or alteration for the first Ten
Thousand Dollars ($10,000.00) and Three Dollars ($3.00)
for each additional One Thousand Dollars ($1,000.00) or
fraction thereof over the Ten Thousand Dollars ($10,000.00)
FEES -- B. SEWER
1. Sanitary and Storm Sewer Tapping -- A permit and inspection
fee shall be charged in accordance with the following schedule.
No tapping or connection shall be made if the storm or
sanitary are extended in accordance with the requirements and
approval of the Village Board at the owner's expense the full
length of the property involved, but the inspection fee as set
forth in Section "A" shall apply.

B. Business Zoned Properties (B1, B3 and B4) -- A permit and in-
spection fee of Two Hundred Fifty Dollars ($250.00) per acre or
portion thereof of the site served shall be charged for a connec-
tion to the sanitary sewer and One Hundred Dollars ($100.00) per
acre or portion therof for connection to a storm sewer. In addi-
tion, a minimum of Seventy -Five Dollars ($75.00) per unit shall
be charged for each unit connected to the sanitary sewer and a
minimum fee of Fifty Dollars ($50.00) for each unit connected to
the storm sewer.
C. Manufacturing & Office and Research Zoned Properties * -- A
permit for review and inspection fee of Three Hundred Dollars
($300.00) per acre or portion thereof of the site shall be charged
for connection to a sanitary sewer, and One Hundred Dollars
:x$100.00) per acre or portion thereof of the site shall be
charged for connection to a storm sewer.
D. Conditional Use Properties -- Same charges and exceptions as
provided in Section "C ".

Further provided that the minimum charge shall be Four Dollars ($4.00)
FEES -- E. HEATING PERMIT
The fee for checking and inspections of plans, inspections and tests
for all heating units other than electrical shall be as follows:
For each 70,000 BTU input or fraction thereof of the heating
unit there shall be an inspection fee of Five Dollars ($5.00) and a
minimum of Five Dollars ($5.00) shall be charged. No charge shall be
made for any oil storage tank provided for residential use.
FEES -- F. DRIVEWAY PERMIT FEE AND DEPOSITS
a.) Residential -- A deposit of Fifty Dollars ($50.00) for drive-
ways not more than ten (10) feet in width and Fifty Dollars ($50.00)
for each additional ten (10) feet shall be made for all driveways
where a curb exists. Upon completion of the driveway and upon ap-
proval of the Building Commissioner, such deposit, less Ten Dollars
($10.00) for inspection fees, shall be refunded. A Performance Bond,
plus inspection fees, may be submitted in lieu of the cash deposit
set forth above.
(c) For a permit for the removal of a building or struc-
ture from one lot to another, the fee shall be at the rate of $1.00

per thousand dollars of the estimated value of the building or
structure in its completed condition after removal.
(d) For a permit for the removal of a building or
structure to a new location within the same lot, the fee shall
be at the rate of $4.00 per thousand dollars of the estimated
cost of moving, of new foundations and of work necessary to put
the building or structure in usable condition in its new location.
(e) For a permit for the demolition of a building or
structure the fee shall be at the rate of $10.00 for each ten feet
or fraction thereof in the height of such building or structure
plus one per cent additional for each foot of street frontage of
the building or structure in excess of fifty feet.
(f) In case of abandonment or discontinuance, the cost
of work performed under a permit may be estimated, an adjustment of
the fee made and the portion of the fee for uncompleted work re-
turned to the permit holder, provided that no refund of a prescribed
minimum fee shall be made. If such discontinuance is due to revoca-
tion of a permit, a similar adjustment and return may be made; pro-
vided, that no refund shall be made until all penalties incurred
or imposed by due authority have been collected. After such a
refund has been made no work shall be resumed until a new appli-
cation has been made and a new permit has been issued.
(g) The term "estimated cost" as used in this section,
means the reasonable value of all services, labor, materials, and
use of scaffolding and other appliances or devices ehtiering into
and necessary to the prosecution and completion of the work ready
for occupancy; provided that the cost of excavation or grading,
and of painting, decorating or other work that is merely for em-
bellishment or not necessary for the safe and lawful use of the
building or structure, is not deemed a part of such estimated cost.
SECTION
ELEVEN:
SAVING CLAUSE
Nothing in this ordinance or in the building code hereby
adopted shall be construed to affect any suit or pro-
ceeding now pending in any court, or any rights acquired, or lia-
bility incurred, nor any cause or causes of action accrued or
existing, under any act or ordinance repealed hereby. Nor shall
any right or remedy of any character be lost, impaired or affected
by this ordinance.

SECTION VALIDITY
TWELVE:
The invalidity of any section or provision of this
ordinance or of the building code hereby adopted
shall not invalidate other sections or provisions thereof.
SECTION INCONSISTENT ORDINANCES REPEALED
THIRTEEN:
Ordinances or parts thereof in force at the time that
this ordinance shall take effect and inconsistent here-
with, are hereby repealed.

AMENDMENTS MADE IN SAID CODE
The said code is amended and changed in the following
respects:
SECTION 102.3 APPLICATION FORM (Section shall read
as follows
Applications for building permits shall be made in
triplicate to the Building Commissioner and shall be
accompanied by plans, elevations, critical sections
and details drawn to scale and specifications so as
to clearly show the method of construction and materials
to be used. Plans, except those for single family resi-
dences under 2,000 square feet, erected by and for the
occupancy of the owner, shall be certified by a regis-
tered architect and /or engineer acting for the owner,
as required by state registration act of Illinois.
Additional necessary information shall be submitted
at the request of the Building Commissioner. This
certificate shall be in the following form:
ARCHITECT'S CERTIFICATION
"I do hereby certify that these drawings have been
prepared under my direct supervision and to the best
of my knowledge conform to all codes and ordinances
of the Village of Deerfield, Illinois."

No such certificate shall be required for remodelling
of single family residences done by the owner not
affecting bearing walls or supports nor for exterior
steps, walls, patios or accessory buildings or porches.

SECTION 401.3 (Section shall read as follows):
(f) Outside the fire limits, existing buildings of non-
combustible construction may be unlimited in area when
complying with all the following provisions:
(1) Buildings of protected non - combustible construction
shall not exceed 2 stories in height and buildings of
unprotected non - combustible construction shall not exceed
one story in height without basement.
(2) The entire building shall be equipped with an approved
automatic sprinkler system except that buildings occupied
exclusively by stocks of non - combustible material need not
be sprinklered.
(3) A horizontal separation of 80 feet shall be provided
on all sides of building.
(4) Means of egress shall be provided in accordance
with Article VI.
SECTION 808.4 (Add a new section as follows):
Basements in buildings of other than multi - family or
educational use having an area exceeding 500 square feet

shall have a two hour fire rated separation between
the first floor and the basement. All openings to be
protected by a "B" labeled device. When a basement
is sprinklered by an approved system, the area may
be increased to 1,000 sq. ft.
SECTION 1400 - GAS PIPING
SECTION 1400.1 - INSTALLATION (Add new paragraph
as follows);
Chapter 25 Gas Piping And Appliances of the Municipal
Code of Deerfield shall govern where applicable and
the most restrictive requirements shall govern.
SECTION 1401 - PLUMBING

Chapter 24 Plumbing and Sewers of the Municipal Code
of Deerfield shall govern where applicable and the
most restrictive requirements shall govern.
ARTICLE XVI - SIGNS AND OUTDOOR DISPLAY STRUCTURES
SECTION 1600 - GENERAL ,

any sign unless all provisions have been complied or
as set up in the Zoning Ordinance of the Village of
Deerfield.

first day of the calendar month next following its
publication.
SECTION PUBLICATION
SIXTEEN:
That the Village Clerk is hereby directed to publish
this ordinance within ten (10) days of its enactment
as provided in Section 1 -2 -4 of the Illinois Municipal Code.
