O-67-59ORDINANCE NO. 0 -67 -59 AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDEWALKS PURSUANT TO AND IN ACCORDANCE WITH ARTICLE 112 DIVISION 84, ILLINOIS MUNICIPAL CODE, ALONG PORTION OF WOODWARD AVENUE, SHERIDAN AVENUE, OAKLEY AVENUE IN THE VILLAGE OF DEERFIELD, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION 1: That a sidewalk shall be constructed in the Village of Deerfield, Counties of Lake and Cook, State of Illinois, in accordance with Article 11, Division 84, Illinois Municipal Code, the nature, character, locality and description of which is as follows: C -�oihe A Portland cement concrete sidewalk 4" and 5' for 125 feet along the West side of Lots 6 through 10, Block 12, of the Deerfield Park Land and Improvement Association Subdivision, in the Southwest Quarter of the Southeast Quarter, Section 29, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois; 50 feet along the East side of Lots 3 and 4, Block 9, Deerfield Park Land and Improvement Association Sub- division, in the Northeast Quarter, Southeast Quarter, Section 29, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois; 125 feet along the West side of Lot 1, Block 1, Deerfield Park Land and Improvement Association Subdivision, in the Northeast Quarter, Southeast Quarter, Section 29, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois; 125 feet along the West side of Lot 60, Block 1, Deerfield Park Land and Improvement Association Subdivision, in the Northeast Quarter, Southeast Quarter, Section 29, Township 43 North, Range 12, East of the Third Principal Meridian in Lake County, Illinois. SECTION 7: All ordinances, or parts of ordinances in conflict with this Ordinance be, and the same are hereby, repealed. SECTION 8: That this Ordinance shall be in full force and effect from and after its passage and the approval thereof as provided by law. President ATTEST: 0-0 (�c.c.v� - —6- P f Village Clerk The owner or owners of any lot or parcel of land fronting on the line of such sidewalk, shall, within thirty (30) days after the mailing of notice of passage of this Ordinance, build or renew such sidewalk opposite his land to conform in all respects to the requirements of this Ordinance. Said work shall be done in a workmanlike manner under the superintendence of the Board of Local Improvements of the Village of Deerfield. In default of construction of said sidewalk by any of said owners the Board of Local Improvements is authorized and directed on behalf of the Village of Deerfield to construct or cause to be constructed said sidewalk, prepare a Bill of Costs therefor and spread the cost prorata by frontage, superficial area or assessed value as it may in its discretion deem most equitable and just, all in accordance with the provisions of Article 11, Division 84, of the Illinois Municipal Code, May 29, 1961, together with all Amendatory and Supplemental acts. SECTION 2: The recommendation of the Board of Local Improvements of the Village of Deerfield providing for the improvement be and the same is hereby approved. SECTION 3: The said improvement shall be made and the whole cost thereof shall be paid by special tax levied in accordance with and pursuant to this Ordinance. SECTION 4: That the aggregate amount herein ordered to be taxed or assessed to pay the cost of such improvement against the property shall be divided into five (5) installments in the manner provided by the statute in such case made and provided and each of said installments shall bear interest at the rate of six per cent (6 %) per annum,according to law until paid. SECTION 5: For the purpose of anticipating the collec- tion of the second and succeeding installments of said assessment for the cost of laid improvement, the Village of Deerfield shall issue vouchers payable out of said installments, bearing interest at the rate of six per cent (6 %) per annum, payable annually, signed by the President of the Village of Deerfield, and attested by the Village Clerk of said Village under the corporate seal of said Village. SECTION 6: That the Board of Local Improvements of the Village of Deerfield is hereby designated as the board to take charge of the construction of the sidewalk improvement herein ,and is authorized and directed to do all acts and things neces- sary thereto, in accordance with said Article 11, Division 84, Illinois Municipal Code.
