O-67-44r r ORDINANCE NO. 0 -67- 44 AN ORDINANCE APPROVING A PLANNED DEVELOPMENT (GLORIOSO RESUBDIVISION) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of JOHN GLORIOSO for the approval of a single family residential planned development of certain real estate hereinafter described located in the Hovland Subdivision and classified in the R -1 -B District of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, recommended that said planned development be approved subject to certain conditions and restrictions. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES ;OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the proposed single family planned residen- ONE: tial development of the real estate legally described as follows: Lots 42, 43, 44, 45, 47, 48, 49, 72, 73, 74, 75, 76, "(,,;' 78, 79, 89, 90, 110, 111 and 112 in J. S. Hovland's First Addition to Deerfield in the Southwest Quarter of Section'32, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois, and as set forth and described on the attached plan of development and preliminary plat of resubdivision, which plan and plat of re- subdivision are made a part of this Ordinance, be and it is hereby 2 . approved subject to the conditions and restrictions hereinafter set forth. SECTION That the approval of said planned development TWO: is conditioned upon the following: 1. That the developer, John Glorioso, construct and install full and complete subdivision improvements in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield to serve the lots which will front on the proposed street to be constructed and installed along the rear of Lots 76, 77, 78, 79, 42, 43, 44 and 45, including the dedication of the right -of -way of said street except that portion of the right -df- way to be located to the rear of Lot 77, which portions of said right -of -way shall be condemned for street purposes by the Village in the event the owner thereof refuses to dedicate the same. 2. That the developer, John Glorioso, construct and install full and complete subdivision improvements in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield to serve the lots which will front on the proposed street to becconstructed and installed along the rear of Lots 111, 112, 89 and 90, including the dedication of the right -of -way of said street, and the construction of a temporary turnaround at the North line of Lots 112 and 89. 3. That the developer, John Glorioso, construct and install full and complete subdivision improvements in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield to serve the lots which will front on the proposed street and cul -de -sac to be constructed and installed along the North portion of Lot- 73 and portions of Lots 74, 47 and 48, in- cluding the dedication of the right -of -way of said street. 4. That the developer, John Glorioso, construct and install full street improvements, including pavement, curb, gutter, storm sewer, street signs and street lighting, in accordance with the applicable provisions of the Village Code along that portion of Rosewood Avenue extending from the East right -of -way line of Fair- view Avenue to that portion of Rosewood Avenue already paved extend4g Westerly from Willow Avenue. " <r 5. That the developer, John Glorioso, construct and install full street improvements, including pavement, curb, gutter, storm sewer, street signs and street lighting, in accordance with the applicable provisions of the Village Code along that portion of Laurel Avenue extending from the East right -of -way line of Fairview Avenue to Willow Avenue. 3 • 6. That the developer, John Glorioso, construct and install full storm sewer improvements (including all appurtenances and connections necessary to connect the same to a trunk storm sewer to be installed in Laurel Avenue), street lighting and street signs in accordance with the applicable provisions of the Village Code in the following streets or portions thereof: That portion of Kenmore Avenue from Laurel Avenue Northward for a distance of 240 feet; That portion of Birchwood Avenue between Laurel Avenue and Hackberry Road; That portion of Fairview Avenue between Laurel Avenue and Hackberry Road; That portion of Rosewood Avenue between Birchwood Avenue and Fairview Avenue; That portion of Laurel Avenue between Wilmot Road and Fairview Avenue. 7. That in the event all other owners of property fronting on the streets or portions thereof described in Paragraph 6 con- tribute their proportionate share of the cost of street improve- ments, then the developer, John Glorioso, shall construct and install full street improvements, including pavement, curb and gutter in said streets or portions thereof. 8. That in the event that the Village of Deerfield shall, through special assessmentsproceedings, construct and install street improvements in the streets or portions thereof described in Para- graph 6, the developer, John Glorioso, shall contribute and pay to the public benefit fund of the Village of Deerfield the sum of FOUR THOUSAND ($4,000.00) DOLLARS for each street intersection constructed and- .talled through a special assessment proceeding. .3 SECTION hat the approval of said Planned development is THREE: hereby given with the understanding that in the event all of the owners of property fronting on the streets or portions thereof described in Paragraph 6 of Sec- tion Two hereof do not contribute their proportionate share of the cost of street improvements or make other provision with respect thereto acceptable to the developer, the Village of Deer- field will undertake to construct and install said street improve- ments by special assessment proceedings, and with the further 4 . understanding that in the event the owner of Lot 77 refuses to dedicate that portion of his property required for street right - of -way as indicated in the attached plan and preliminary plat of resubdivision, the Village of Deerfield will institute eminent domain proceedings to acquire said portion of said lot for street purposes. SECTION That the approval of the planned development FOUR: hereby given is subject to the further condition that the developer, John Glorioso, submit for approval a final plat of resubdivision of the real estate described in Section One hereof and except as otherwise provided in this Ordinance comply with all requirements of the Village Code of the Village of Deerfield necessary for the approval of said final plat. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
