O-67-23ORDINANCE N0. 0 -6j-- 23 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1308 HACKBERRY, DEERFIELD WHEREAS, RICHARD FREEMAN has petitioned for a variation from the strict provisions of Section VII.C.2 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit a side yard of 17 feet 2 -1/2 inches in lieu of the required side yard of 20 feet; and WHEREAS, pursuant to notice,duly published as required by statute, a public hearing on said petition was held and con- ducted by the Zoning Board of Appeals of the Village of Deer- field; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals is hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular TWO: hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to petitioner's property which is legally described as follows: [ 2 1 Lot 6 in the Second Addition to Deerfield Park, being a Subdivision of part of the South Half of the Northwest Quarter of Section 32, Township 42 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois. SECTION THREE: amended, with hereby granted in lieu of the That a variation from Section VII.C.2 of th Village of Deerfield, respect to the property so as to permit a side 20 -foot requirement of the strict provisions of Zoning Ordinance of the passed May 4, 1953, as hereinabove described, is yard of 17 feet 2 -1/2 inches the said Zoning Ordinance.
