RESOLUTION NO. R-13-10
A RESOLUTION AUTHORIZING MEMBERSHIP IN THE
NORTH BRANCH WATERSHED CONSORTIUM
WHEREAS, the City of Highland Park, the City of Highwood, the Village of Lake Bluff,
the City of Lake Forest, the City of North Chicago, the City of Park City, the City of Waukegan,
the East Skokie Drainage District, the Lake County Forest Preserve District and the Lake County
Stormwater Management Commission (the "Original Parties") have established the North Branch
Watershed Consortium (the "NBWC") by Intergovernmental Agreement; and,
WHEREAS, the purpose of the NBWC is to facilitate joint action and intergovernmental
cooperation to address, and to seek funding and other resources to assist in, flood mitigation,
stormwater management and green infrastructure improvement projects in the North Branch
Chicago River Watershed within the jurisdictions of the parties to the NBWC Agreement; and,
WHEREAS, the Village of Bannockburn, Village of Deerfield, Village of Green Oaks,
Village of Lincolnshire, Village of Mettawa, Village of Riverwoods, Union Drainage District No.
1, and West Skokie Drainage District have been offered to become members of the NBWC; and,
WHEREAS, portions of the North Branch Chicago River Watershed are located within
the jurisdictional boundaries of the Village of Deerfield and are subject to flooding; and,
WHEREAS, the Village Engineer has recommended that the Village of Deerfield join
the NBWC to cooperate with other members of the Consortium to facilitate joint action and
intergovernmental cooperation addressing flood mitigation, stormwater management and green
infrastructure improvement projects in the North Branch Chicago River Watershed; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the public health, safety and welfare of the Village of Deerfield will be served by
joining the NBWC;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the corporate authorities of the Village of Deerfield do hereby
authorize and approve the "Intergovernmental Agreement Amendment Expanding Membership
of the Skokie River Consortium and Hereinafter Renamed to the North Branch Watershed
Consortium", a copy of which is attached hereto as Exhibit A (the "NBWC Agreement").
SECTION 2: That the President and Village Clerk of the Village of Deerfield are hereby
authorized and directed to respectively execute and attest said NBWC Agreement for and on
behalf of the Village of Deerfield.
SECTION 3: That this Resolution, and each of its terms, shall be the effective
legislative act of a home rule municipality without regard to whether such Resolution should: (a)
contain terms contrary to the provisions of current or subsequent non -preemptive state law; or,
(b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is
the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms
of this Resolution should be inconsistent with any non -preemptive state law, this Resolution shall
supersede state law in that regard within its jurisdiction.

SECTION 4: That this Resolution shall be in full force and effect upon its passage and
approval as provided by law.
