O-18-38VILLAGE OF DEERFIELD ORDINANCE NO. 2018- 0-18-38 AN ORDINANCE AMENDING SECTIONS 4.03-C, 9.02-A, AND 14.02 OF "THE DEERFIELD ZONING ORDINANCE 1978", AS AMENDED, TO MAKE POST- SECONDARY EDUCATION PROGRAMS A SPECIAL USE AND TO PERMIT GROUND SIGNS FOR SUCH USE IN THE R-3 DISTRICT WHEREAS, the Village is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Cove School, Inc. ("Applicant') desires to use a portion of the property located at 720-724 Elder Lane, in Deerfield, Illinois (collectively, the "Property') for high school and post -secondary education programs, and install on the Property two identification signs; and WHEREAS, the Property is located in the R-3 Single Family Residential Zoning District ("R-3 District's; and WHEREAS, post -secondary education programs are not an authorized use in the R- 3 District; and WHEREAS, pursuant to Section 9.02-A(1) of the "Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordinance', the Applicant is not permitted to install more than one identification sign on the Property; and WHEREAS, the Applicant submitted an application to the Village seeking approval of, among other things, amendments to the Zoning Ordinance to: (ii) make post -secondary education programs a permitted use in the R-3 District upon the issuance of a special use permit; and (ii) to permit high school and post -secondary education programs to install up to two identification signs on properties within the residential districts (collectively, "Proposed Amendments'); and WHEREAS, a public hearing by the Plan Commission to consider the Proposed Amendments to the Zoning Ordinance was duly advertised on September 20, 2018, in the Deerfield Review, and was held on October 11, 2018; and WHEREAS, on October 25, 2018, the Plan Commission approved findings of fact in support of the Proposed Amendments, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Amendments by the Village Board; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to adopt the Proposed Amendments, as set forth in this Ordinance; Additions are bold and double -underlined; deletions ^f" stPae ' """""' NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: POST -SECONDARY EDUCATION PROGRAMS. Section 4.03-C, titled "Special Uses," of Article 4, titled "Residential Districts," of the Zoning Ordinance is hereby amended to read as follows: "4.03-C Special Uses The following uses are permitted in the R-3 Single -Family Residence District when authorized in accordance with the procedures for Special Uses as set forth in Article 13: Educational Institutions a. Elementary Schools. b. Junior High Schools. C. High Schools. d. Nursery Schools, Day Schools and Camps when conducted on non-residential properties. e. Section 14.02, titled "Definitions," of Article 14, titled "Rules and Definitions," of the Zoning Ordinance is hereby amended to add the following definition in alphabetical order: "Post -secondary education program: An education pXq prm for higher rnin life skills instruction." SECTION FOUR: IDENTIFICATION SIGNS. Section 9.02-A, titled "Residential Districts," of Article 9, titled "Signs," of the Zoning Ordinance is hereby amended to read as follows: " 9.02-A Residential Districts In all residential districts, only the following are permitted and then only if accessory and incidental to a permitted or Special Use in such districts: Identification Signs Additions are bold and double -underlined; a Eleletions are str-u k thr-e g jL IdentificatiM_ Signage for a High School and Post - Secondary Education Program U1. There shall not be more than two identification signs for the proposed use. Such signs shall indicate the name and/or address and logo of the high school and post -secondary education program. Le No identification sign may have a height that exceeds three feet above grad, SECTION FIVE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION SIX: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
