O-21-28VILLAGE OF DEERFIELD ORDINANCE NO. 2021- 0-21-2$- AN ORDINANCE AMENDING SECTION 7-18 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING PEDDLERS AND SOLICITORS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, the Village has established regulations for soliciting and peddling within the Village in Article 2 of Chapter 7 ("Regulations' of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'; and WHEREAS, the President and Board of Trustees have determined that the Regulations, which are decades old, should be updated so that they appropriately protect First Amendment freedoms while also protecting the well-being, tranquility, and privacy of the residents of the Village; and WHEREAS, the proposed updated Regulations are narrowly tailored to protect against crime and public safety risks that may arise from door-to-door solicitation and against burdens on the Village's resources beyond its capacity to bear, without burdening more speech than is necessary to further these legitimate governmental interests; and WHEREAS, the President and Board of Trustees thus have determined that it is appropriate and in the best interests of the Village and its residents to amend the Regulations as provided in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO SECTION 7-18 OF THE VILLAGE CODE. Section 18, titled "Regulations Applicable to All Soliciting and Peddling," of Article 2, titled "Peddlers and Solicitors," of Chapter 7, titled "Businesses," of the Village Code is hereby amended and shall read as follows: Sec. 7-18. Regulations Applicable To All Soliciting And Peddling: (a) No person shall engage in solicitation or peddling upon any private property after having been asked by the owner or occupant thereof to leave such property. 100121417.11 Additions are bold and double -underlined; A ' 1:__F; A fR 4*43Pk thr-GlAgh. (b) It shall be unlawful for any person to engage in peddling or solicitation upon any private premises or residence or business located thereon if such premises or residence is posted against solicitation or peddling by means of a notice, prominently displayed upon which is printed the legend: NO SOLICITORS OR PEDDLERS For purposes of the preceding sentence, a private property shall be deemed to be posted against solicitation or peddling if there is exhibited, on or near the main entrance to the property or on or near the main door to any structure located thereon, a sign at least three inches by four inches (3" x 4") in size with letters at least one-third inch (1/3") in height, which bears the above legend. (c) No person who engages in solicitation or peddling shall use any plan, scheme or ruse or make any statement which indicates or implies that the purpose of such person's solicitation is other than to obtain orders for or to make sales of goods or services. (d) No person who engages in solicitation or peddling shall misrepresent the right of a buyer to rescind or cancel a sale under the provisions of applicable law. Saturdayor- at (f) It shall be unlawful for any peddler or solicitor to cheat, deceive or fraudulently misrepresent any product or the price thereof, whether through himself or through an employee, while acting as a peddler or solicitor in the village, or to barter, sell or peddle any goods, merchandise or wares other than those specified in his application for a license. M, ..trae1. +h .eug 2 (h) No peddler or solicitor shall peddle or solicit by shouting or by using any sound device in connection with peddling or soliciting, including bells or amplifying systems. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect after passage, approval, and publication in the manner provided by law.
