O-21-26VILLAGE OF DEERFIELD ORDINANCE NO. 2021- 0-21-26 AN ORDINANCE AMENDING "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, TO ELIMINATE THE ELECTRICAL COMMISSION AND MODIFY THE ELECTRICAL CONTRACTOR REGISTRATION REQUIREMENTS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, Sections 2-153 and 2-154 of the "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code', provide for a six -member Electrical Commission designed to recommend regulations regarding the installation, alteration, and use of electrical equipment in the Village; and WHEREAS, the Village has adopted 2017 edition of the National Electrical Code (NFPA 70), as published by the National Fire Protection Association and approved by the American National Standards Institute (ANSI), which governs the installation and use of all electrical equipment in the Village; and WHEREAS, Article 5 of Chapter 7 of the Village Code requires all electrical contractors performing electrical work within the Village to obtain a certificate of registration from the Village by fulling certain requirements including, without limitation, passing a written test administered by the Village ("Registration Requirements'); and WHEREAS, after a review of the Registration Requirements, Village staff recommends amending the Registration Requirements to eliminate the administration of the test by the Village and, instead, require electrical contractors working within the Village to hold a valid electrical license issued by an approved Illinois municipality or through the International Code Council or other similar duly authorized licensing agency; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend Sections 2-153 and 2-154 and Article 5 of Chapter 7 of the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: ELECTRICAL COMMISSION. Pursuant to the Village's home rule authority, Section 7-37, titled "Registration Required," of Article 5, titled "Electrical Contractors," of Chapter 2 titled, "Businesses," of the Village Code is hereby amended as follows: "Sec. 7-37. Registration Certificate: (a) Registration Certificate Required: No person may still engage in the business of electrical contractor within the Village without having first secured a certificate of registration from the Village heI-equil-ed. (b) Application: Applications for sueh an electrical contractor registration certificate must slAll be made to the dir et r of building g and z Director of CommunityDevelopment, or desigu&e. Pursuant to the Village's home rule authority, Section 7-40, titled "Contractors from Other Municipalities," of Article 5, titled "Electrical Contractors," of Chapter 2 titled, "Businesses," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION FIVE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION SIX: EFFECTIVE DATE.
