O-19-32-1VILLAGE OF DEERFIELD ORDINANCE NO. 2019- 0-19-32- 1 AN ORDINANCE AMENDING SECTIONS 6-1 AND 6-19.4 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING PENALTIES FOR WORKING WITHOUT A BUILDING PERMIT WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, Section 6-1 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code', requires a building permit for certain plumbing, electrical, roofing, and construction work when the cost of such construction work exceeds $500.00 (`Building Permit'; and WHEREAS, the Village's current penalty for performing work without a permit is insufficient; and WHEREAS, the Village Board desires to impose a penalty for performing work without a permit that is high enough to encourage full compliance with Section 6-1 of the Village Code; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend Sections 6-1 and 6-19.4 of the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: PERMIT REQUIRED. Pursuant to the Village's home rule authority, Section 6-1, titled "Permit Required," of Article 1, titled "In General," of Chapter 6, titled `Building," of the Title titled, "Building," of the Village Code is hereby amended further to read as follows: "Sec 6-1. Permit Required: A building permit shall be required for all plumbing, electrical and roofing work except as specifically provided in this chapter; chapter 8, "Electricity"; chapter 16, "Plumbing And Sewers", of this Code. A building permit shall also be required for all construction or improvement work where the cost of such construction or improvement work exceeds five hundred dollars ($500.00) and such work is regulated by the provisions of the Village Building Codes. Permits are not required for such work as the installation of vinyl siding, the replacement of wall or floor coverings, the Additions are bold and double -underlined; a-1^-i— — ^+. uek +�,,,,.ug 1 repair or replacement of plumbing fixtures where no modification or extension of any plumbing is required, or similar kinds of replacement or repair. Any violation of this section shall be an offense punishable by a fine equal to 100% of the base building permit fee, with a minimum fee of no less than $300.00 and a maximum f ore than $1,000.M per violation. Each day on which a violation of this section occur or continues_ shall constitute a separate violation." SECTION THREE: ADMINISTRATION AND ENFORCEMENT; DENIAL OF PERMITS. Pursuant to the Village's home rule authority, Section 6-19.4, titled "Permit Required," of Article 1, titled "In General," of Chapter 6, titled `Building," of the Title titled, "Building," of the Village Code is hereby amended further to read as follows: "Sec 6-19.4. Administration and Enforcement; Denial Of Permits: (a) Unless otherwise specified in this Chaff Aany violation of the provisions of this article shall be an offense punishable by a fine of not less than two hundred dollars ($200.00) and not more than two thousand dollars ($2,000.00), and each day on which a violation occurs or continues shall be deemed a separate offense. (b) Failure of the owner or contractor ("applicant") of a new single-family residence to promptly cure any violation of the provisions of this article shall be cause for the director of building and zoning to refuse the issuance of further permits requested by the applicant for the demolition of existing single-family residential structures, or for building new single-family residences, until the existing violations are cured or resolved to the satisfaction of the director. SECTION FOUR: PUBLICATION The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and effect ten days after its passage, approval, and publication in the manner provided by law.
