ORDINANCE NO. 2021 0-21-22
AN ORDINANCE AMENDING SECTIONS 6.01-C AND 14.02 OF
"THE DEERFIELD ZONING ORDINANCE 1978", AS AMENDED, TO REGARDING
CARRYOUT FOOD SERVICE USES
WHEREAS, the Village is a home rule municipal corporation in accordance with
Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and
WHEREAS, North Shore Sports and Wellness, LLC ("Applicant') is the owner of
that certain property located at 550 Lake Cook Road ("Property's; and
WHEREAS, the Property is located in the I-1 Office Research Restricted Industrial
District ("ORI District'); and
WHEREAS, the Applicant submitted an application to the Village seeking approval
of, among other things, an amendment to Section 14.02 of the "Deerfield Zoning Ordinance
1978", as amended ("Zoning Ordinance's to define a carryout food service use and an
amendment to Section 6.01-C of the Zoning Ordinance to allow the carryout food service as a
Special Use in conjunction with a special needs school, personal training facility, and private
sports training in the I-1 Office Research Restricted Industrial District ("Proposed
Amendment'); and
WHEREAS, a public hearing by the Plan Commission to consider the Proposed
Amendment to the Zoning Ordinance was duly advertised on April 1, 2021 in the Deerfield
Review, and was held on April 22, 2021; and
WHEREAS, on April 22, 2021, the Plan Commission approved findings of fact in
support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance, and voted to recommend approval of the Proposed Amendment by the
Village Board; and
WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENT TO SECTION 6.01-C. Section 6.01-C, titled
"Special Uses," of Title 6, titled "Industrial Districts," of the Zoning Ordinance is hereby
amended to read as follows:

Instruction when such a service is located in an I-1 Planned Unit
Development that is a minimum of 25 acres in size.
SECTION THREE: AMENDMENT TO SECTION 14.02. Section 14.02, titled
"Rules and Definitions," of the Zoning Ordinance is hereby amended to add the following
definition in alphabetical order:
"14.02 Definitions
Carry Out Food Service: A food and beverage establishment in an I-1
Planned Unit Development where the food service is primarily for consumption_
off -premises.
SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
