ORDINANCE NO. 2021- 0-21-19
AN ORDINANCE REZONING THE PROPERTY LOCATED AT
525 LAKE COOK ROAD TO THE C-2 OUTLYING COMMERCIAL DISTRICT
WHEREAS, Commonwealth Edison Co. ("Owner's is the record title owner of the
property commonly known as 525 Lake Cook Road, Deerfield, Illinois, and legally described
in Exhibit A attached to and, by this reference, made a part of this Ordinance
("Property's; and
WHEREAS, the Property is currently located in the R-1 Single Family Residence
District ("R-1 District's; and
WHEREAS, as part of Owner's "smart -grid" initiative, the Owner desires to
construct on the Property: (i) a 104 foot tall antenna support structure; (ii) three utility
fiber enclosures; (Ili) a utility enclosure for batteries; and (iv) new fencing (collectively,
"Improvements'); and
WHEREAS, to construct the Improvements, the Owner filed an application with the
Village seeking approval of, among other things, the rezoning of the Property ("Proposed
Rezoning' to the C-2 Outlying Commercial District of the Village ("C-2 District'); and
WHEREAS, a public hearing by the Plan Commission to consider an amendment of
the Zoning District Map of the Village of Deerfield, Lake and Cook Counties, Illinois
("Zoning Map' to rezone the Property in accordance with the Proposed Rezoning was
duly advertised in the Deerfield Review on April 1, 2021, and was held on April 22, 2021;
and
WHEREAS, on April 22, 2021, the Plan Commission approved findings of fact in
support of the Proposed Rezoning, in accordance with and pursuant to Section 13.10 of the
Zoning Ordinance, and voted to recommend approval of the Proposed Rezoning by the
Village Board; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interest of the Village to rezone the Property in accordance with the Proposed Rezoning, as
set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: ZONING MAP AMENDMENT. The Zoning Map is hereby
amended to rezone the Property from the R-1 District to the C-2 District, all in accordance
with, and pursuant to, Section 13.10 of the Zoning Ordinance and the home rule powers of
the Village.

SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
