R-21-21VILLAGE OF DEERFIELD RESOLUTION NO. R-21-21 A RESOLUTION APPROVING A FINAL PLAT OF SUBDIVISION (720-780 Waukegan Road; 711-833 Deerfield Road; 700 and 750 Osterman Avenue; and 710-766 Robert York Road, Deerfield, Illinois) WHEREAS, Kirby Limited Partnership ("Owner's is the record owner of that certain parcel of real property commonly known as The Shops at Deerfield Square, Deerfield, Lake County, Illinois ("Property's and legally described in Exhibit A attached hereto and incorporated herein; and WHEREAS, the Property is on approximately 16.61 acres and located in the C-1 Village Center District of the Village; and WHEREAS, the Property is currently subdivided into two lots of record; and WHEREAS, the Owner filed an application to resubdivide the Property into 18 lots of record, as depicted on that certain plat titled "Deerland Resubdivision", prepared by Professionals Associated Survey, Inc, consisting of one sheet ("Plat'); and WHEREAS, the Owner has applied for final approval of the Plat, and on April 22, 2021, the Plan Commission recommended approval of the proposed Plat; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to approve the Plat; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Resolution as findings of the Village Board. SECTION TWO: APPROVAL OF PLAT. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Three of this Resolution, the Plat is hereby approved in the form attached to and, by this reference, made a part of this Resolution as Exhibit B. SECTION THREE: CONDITIONS. The approval of the Plat in Section Two of this Resolution is conditioned upon the Owner recording against the Property a declaration, in a form acceptable to the Village Attorney, governing cross access, easements, maintenance, utilities, and party walls for the Property. SECTION FOUR: EXECUTION OF PLAT. The Mayor and the Village Clerk are hereby authorized and directed to execute and seal, on behalf of the Village, the Plat. {00121035.1} SECTION FIVE: RECORDATION OF THE PLAT. Upon execution of the Plat by the Mayor and the Village Clerk, as provided in Section Three of this Resolution, the Village Clerk is hereby directed to cause the Plat to be recorded in the office of the Lake County Recorder. SECTION SIX: EFFECTIVE DATE. This Resolution will be effective only upon the passage by the Village Board in the manner required by law.
