ORDINANCE NO. 0-17-11
AN ORDINANCE VACATING A PORTION OF THE WEST HALF
OF A NORTH -SOUTH ALLEY LYING BETWEEN HAZEL
AVENUE AND FAIR OAKS AVENUE
WHEREAS, the Village of Deerfield is a home rule unit of local government under the
provisions ofArticle V11, Section 6 of the Illinois Constitution, and
WHEREAS, as a home rUIC unit of local government, except as limited by Article VII,
Section 6, the Village of Deerfield may exercise any power and perform any function pertaining
to its government and affairs, including but not limited to providing for the public health, safety
and welfare; and
WHEREAS, pursuant to Section 11 -9 1 -1 of the Illinois Municipal Code (65 ILCS 5/1 1-
91-1) the Village of Deerfield is authorized to vacate any street or alley or part thereof within the
Village whenever the corporate authorities of the Village determine that the public interests will
be subserved by vacating such street or alley or part thereof and
WHEREAS, DRH Cambridge [Ionics, Inc. (the -Owner") is the owner of certain property
commonly known as 1067 Forest Avenue and described by PIN 16-29-406-004 (tile "Adjacent
Parcel") and has requested that the Village vacate the west Half of that part of the north -south
public alley lying between Hazel Avenue and Fair Oaks Avenue and abutting the east property
line of the Adjacent Parcel, as shown on the Plat of Vacation attached hereto (the "Alley"); and
WHEREAS, the corporate authorities of the Village of Deerfield find that said Alley, as
shown on the Plat of Vacation attached hereto as Exhibit A hereof and legally described herein, is
of no further use to the Village, and that the public interest will be subserved by vacating such
Alley, and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that the
consideration as provided herein to be paid by the owners of the Adjacent Parcel in consideration
of the vacation of the Alley is just and adequate compensation for the vacation of the Ailey and
for the acquisition of title to the vacated Alley;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE; VII,L.NG1 OI DI ERI-IE:LD, LAKE AND COOK COUNTIES, ILLItiOIS,
in the exercise of* its home rule powers, as follows:
SECTION 1: -1'he recitals to this Ordinance are incorporated into and made a part ofthis
Ordinance as if fully set forth herein.
SECTION 2: That the west half of -the north -south alley located between Hazel .Avenue
and Fair Oaks Avenue, and immediately abutting the east property line of the Adjacent Parcel, as
shown on the Plat of Vacation attached hereto and legally described as follows, is hereby vacated:
The west half of the public alley which lies southerly of the north line of Lot 66
extended easterly and northerly of the south line of Lot 65 extended easterly in
Block 6 in Deerfield Park Land and Improvement Association Subdivision in the
Southeast Quarter of Section 29, Township 43 North, Range 12, East of the Third
Principal Meridian, according to the plat thereof recorded May 5, 1898 as
Document 70892, in Book "D" of Plats, Pages 64 to 67, in Lake County, Illinois,
SECTION 3: Pursuant to the provisions of Section I 1-91-1 of the Illinois Municipal Code
(65 ILCS 5/11-91-1) title to all of said vacated east -west alley as shown on the Plat of Vacation
attached hereto and legally described in Section 2of this Ordinance shall be acquired by and
devolve upon the owners of the Adjacent Parcel legally described as follows:
Lot 65 and Lot 66 in Block 6 in Deerfield Park Land and Improvement Association
Subdivision in th,. Southeast Quarter of Section 29, Township 43 North, Range 12,
East of the `third Principal Meridian, according to the plat thereof recorded May 5,
1898 as Document 70892, in Book "D" of Plats, Pages 64 to 67, in Lake County.

SECTION 4: That the vacation of the Alley as shown on the Plat of Vacation attached
hereto and legally described in Section 2 of this Ordinance is contingent upon, and shall not take
effect until the Owner of the: Adjacent Parcel described in Section 3 of this Ordinance shall make
payment of$800.00 (equal to $2.00 per square foot) to the Village of Deerfield,
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non -preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION G: That this Ordinance shall be in full force and effect upon its passage,
approval and publication in pamphlet form as provided by law.
