AV- ORDINANCE N0. 0 -6(7-1 AN_ORDINANCE AMENDING SECTIONS III AND XVI OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield, pursuant to proper notice, has held a public hearing upon the subject matter of certain amendments to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the said Plan Commission has recommended that the corporate authorities amend sg,id Zoning Ordinance as hereinafter provided. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF.DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION_ That Section III of the Zoning Ordinance ONE: of the Village of Deerfield, Illinois, passed May 4, 1953, as amended, be and the same..is hereby further amended by adding the following definition: FLOOR AREA - FOR DETERMINING OFF - STREET PARKING AND OFF- STREET LOADING REQUIREMENTS: "Floor area" when prescribed as the basis of measurement for off - street parking spaces and off - street loading spaces for any use shall be the sum of the gross horizontal area of the several floors of the building, excluding space devoted to rooftop penthouses for the containment of such uses as heating and air conditioning equipment, and elevator mechanisms. All horizontal dimensions shall be taken from the exterior of the walls. SECTION That Section XVI of the Zoning Ordinance of TWO: the Village of Deerfield, Illinois, passed May 4, 1953, as amended, be and the same is hereby further amended by striking said section in its entirety and substituting in lieu thereof the following: Section XVI _ Off - Street Parking and Loading A. Scope of Regulations — The following regulations are established to increase safety and les- sen congestion in the public streets, to prevent the deficiency of automobile parking spaces associated with the development of land and increased automobile usage, to set standards for the requirement of off - street parking according to the amount of traffic generated by such uses, and to eliminate the on- street storage of vehicles. In connection with any build- ing hereafter erected or substantially altered or enlarged, or any parking lot hereafter in- stalled, there shall be provided off - street parking spaces and loading areas meeting all of the miriimum requirements of this section. B. Permissive Parking and Loading Facilities — Nothing in.this ordinance shall be deemed to prevent the voluntary establishment of off - street parking and loading facilities to serve any existing use of land or buildings, provided that there is adherence to all regulations here- in governing the location, design, and operation of such facilities. C. 'Damage or Destruction — When any building, structure or use is restored and continued in operation after being damaged or destroyed by fire, collapse, explosion, or other cause, to. the extent that the cost of restoration exceeds 100 percent of the assessed value, there shall be provided the off - street parking or loading facilities required by this ordinance. 'When any building, structure or use which is in existence on the. effective date of this ordi- nonce is restored and continued in operation after being damaged or destroyed by fire, col- lapse, explosion,' or other cause, to the extent that the cost of restoration does not exceed 100.perceritof the assessed value, there shall be provided only the off - street parking or loading facilities equivalent to any maintained at the time of such damage or destruction. However, in no case shall it be necessary to restore or maintain parking or loading facili- ties in excess of those required by this ordinance for equivalent new uses or construction. D. Existing Uses — Whenever the existing use of a building or structure shall hereafter be changed to a new use, off - street parking or loading facilities shall be provided as required for such new use. However, if said building or structure was erected prior to the effective date of this ordinance, additional off - street parking or loading facilities are mandatory only in the event the floor area of the building or structure is increased and then only to the extent required by the additional space. E. Development Plans — A plot plan drawn to scale, showing the location and layout of re- quired off - street parking and loading facilities shall accompany each application for a Building Permit or Certificate of Compliance. The completion of the improvements accord- ing to such plot plan shall be a requisite for the validity of the Permit or Certificate. F. Off - Street Parking: 1. Existing Parking Facilities: Accessory off - street parking facilities in existence on the effective date of this ordinance and located on the same lot as the building or use served shall not hereafter be reduced below, or if already less than, shall not be further reduced below the requirements fora similar.new building or use under the provisions of this ordinance. 1/3/67 2. Use: Required off - street parking spaces accessory to principal uses shall be solely for the parking of passenger automobiles of occupants, patrons, or employees. Each required space shall be kept available at all times for the storage of one. automobile. 3. Location: Required accessory off - street parking spaces shall be located on the same lot as the use served, except when the Plan Commission recommends and the Board of Trustees authorizes, fora specific use, the location of all or a part of the re- quired off - street parking spaces on a lot that does not contain the principal use or structure . 4. , Design and Maintenance: a. Open and Enclosed Spaces: Accessory off - street parking spaces located on 'the same lot as occupied by the use served may be open to the sky or en- closed in a building. Accessory off - street parking spaces that may be per- mitted elsewhere than on the same lot occupied by the'use shall be open to the sky, except when an off -site storage garage or parking structure is recom- mended by the Plan Commission and authorized by the Village Board of r Trustees. b. Surfacing and Drainage: All open off - street parking areas, except parking areas accessory to a single - family or two - family dwelling containing less than four parking spaces, shall be improved with a compacted macadam base, or, equal, not less than four (4) inches thick; and surfaced'withasphaltic concrete or equal. All parking areas shall be pitched and drained so as to prevent the­flow of water from'such areas onto adjoining property or unpaved streets or alleys, or onto paved streets or alleys which do not have sewer and drainage structures installed. Required off - street parking areas accessory to one and two - family residen- tial dwellings when used in compliance with the provisions of this ordinance, shall be paved or otherwise surfaced with an all- weather dustless material. That part of the driveway connecting from the curbline to the property line shall be paved with concrete or asphaltic materials in accordance with Vil- lage standards. C. Screening, Landscaping, and Wheel Stops: All open off - street parking areas containing more than three (3) parking spaces shall be effectively screened on each side adjoining or fronting on any property situated in a residential district by a densely - planted compact hedge, a wall or solid fence, not less than five (5) -feet in height, and no wall or fence shall exceed seven (7) feet in height. In all districts, except one - family districts, wheel stops of masonry, steel, or heavy timber shall be placed along all lot lines where off - street parking areas are provided to protect abutting property and to prevent pro- trusion of vehicles into street rights -of -way. K d. Illumination: Where a parking area or parking lot is illuminated, direct rays of light shall not beam into adjoining property or into a street. 5. Computation: When determination of the number of off - street parking spaces re- quired by this ordinance results in a requirement.of fractional space, any fraction of one -half or less may be disregarded while a fraction in excess of one -half shall be counted as one parking space. 6. Control of Off -Site Parking Facilities: In cases where parking facilities are per- mitted on a lot other than the lot on which the structure or use served is located, a covenant running with the land must be recorded in theoff.i.ceof the Recorderof Deeds of Lake County, Illinois, o­r Cook County, _II l inois,:as.the.case may be, against the. lot uponwhich the'a .ccessory off- streetpark.i.ng is located, which covenantprohibits any other use on that lot, and a certified copy of the recorded covenant must be de- posited with the Building Commissioner. The covenant shall not be released until such time as either one of the following conditions occur: a, the structure on the lot containing the principal use is removed and the principal use terminated, or b. another lot of.the required size within the required distance is properly de- veloped and used for the required accessory off - street parking in place of and in lieu of the initial lot used for accessory off - street parking with the same requirements, covenants, and conditions being attached to such sub- stitute accessory use lot as required for approval of such initial lot. 7. Collective Provisions for Non - Residential Uses: Parking spaces required for separate buildings and uses may be provided collectively, if the total number of spaces so provided is not less than the sum of the separate requirements for each building and use and if all regulations governing the location of accessory parking space in re- lation to the buildings and uses served are observed. No parking space, or portion thereof, shall serve as the required space for more than one use, unless otherwise specifically authorized in accordance with this ordinance. 8. Repair and Service: No motor vehicle repair work or sales or servicing incidental thereto shall be permitted in required parking spaces except of an emergency nature. 9. Size and Access: All off - street parking facilities shall be provided with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements. No driveway across public property shall have a width ex- ceeding twenty -seven (27) feet at the property line. Each required parking space 3 Parking in Required Yards: Off - street parking spaces, open. to the sky, may be lo- cated in required interior side yards and rear yards, provided :tha.t.in other than single - family residential districts off - street parking spaces may not be located less than five feet from the nearest lot line. " Number of Spaces: There shall be provided for each building, structure, and use hereafter erected, structurally altered, or enlarged, the minimum number of ac- cessory off - street. parking spaces in accordance with the following:, a. Dwelling and Lodging Uses: (1) Hotels and Motels: One (1) parking space for each room or suite of rooms comprising a lodging unit, two (2) parking spaces for each three (3) employees, and one (1) parking space for each 100 square feet of retail sales and dining area. (2) Boarding, Rooming or Lodging Houses: One (1) parking space for each resident, and one (1) parking space for each two (2) employees. 1/3/67 4 shall open directly upon an. aisle, a driveway or a public alley of such width and design as to provide safe and efficient means of vehicular access to such parking space at all times. (b) three or more bedroom units — two (2) parking spaces for each dwelling unit. (4) Single - Family Dwellings and Two - Family Dwellings: One (1) park- ing space for each dwelling unit. b. Schools, Institutions and Auditoriums or Other Places of Assembly: (1) Auditoriums, and Places of Assembly with Fixed Seats: One (1) parking space for each three (3) seats, or for each 54 lineal inches of seating space. (2) Churches, Chapels, Temples, and Synagogues: One (1) parking space for each four;(.4) seats, or for each 72 lineal inches of seat- ing space. (3) Hospitals: One (1) parking space for each two (2) patient beds, plus two (2) parking spaces for each three (3) employees, plus one (1) parking space for each staff doctor. (4) Libraries, Museums, Art Galleries, and Aquariums: One (1) park- ing space for each four hundred (400) square feet of floor area. (5) Nursing Homes' bnd Similar Types of Establishments: One (1) park- ing space for each four (4) pari:ent- beds, plus two (2) parking spaces for each three (3) employees, plus one (1) parking space for each staff doctor. (6) Private Clubs and Lodges: One (1) parking space for each three (3) persons based on the design capacity of the facility. (7) Schools: (a) Elementary, Junior High, and the equivalent private or parochial schools: Two (2) pa.rking spaces for each three (3) teachers and employees normally engaged in or about the building or grounds. (b) Senior high schools, colleges, universities, institutions . of higher learning, and the equivalent private or paro- chial schools: Two (2) parking spaces for each three (3) teachers and employees normally engaged in or about the building or grounds, plus one (1) parking space for each five (5) students. 5 (c) Kindergartens, day schools and the equivalent private or parochial schools: Two (2) parking spaces for each three (3) teachers and employees normally engaged in or about the building or grounds, plus one (1) off - street loading space for each eight (8) pupils. (d) Commercial and trade schools: One (1) parking space for each five (5) students, plus two (2) parking spaces for each three (3) employees, based on the maximum number of students that can be accommodated in accordance with design capacity. (e) Where a school has an auditorium or assembly hall which may be used by persons other than students of the school, the parking requirements set forth under "auditoriums, and places of assembly" shall be used to fulfill the parking requirements of the school. C. Recreational Uses, Commercial or Non - Commercial: (1) Bowling Alleys: Seven (7) parking spaces for each lane plus such additional spaces as may be required herein for affiliated uses such as restaurants and the like. (2) Theaters: One parking space for each three (3) seats. (3) Other Recreational Uses: One (1) parking space for each three (3) patrons, based on the design capacity of the facility in terms of the number of patrons to be served at one time. d. Business, Commercial and Industrial Uses: (1) Automobile Service Stations: One (1) parking space for each island of gasoline pumps, plus two (2) for each service stall, and one (1) parking space per each employee on. duty. (2) Banks, businesses, or professional offices not specifically mentioned elsewhere in this section: One (1) parking space for each two hun- dred (200) square feet of floor area. (3) Furniture and Appliance. Stores, Motor Vehicles Sales Establishments, and. Establishments for Repair of Household'Equipment or Furniture: One (1) parking space for each 400 square feet of floor area. 0 (4) Manufacturing, Fabricating, Processing,- Cleaning, Testing, As- sembling, Repairing, or Servicing Establishments as Permitted in the Manufacturing Districts: Two (2) parking spaces for each three (3) employees as related to the working period when the maximum num- ber of persons are employed on the premises, or one for each 800 square feet of floor area, which ever is greater. (5) Medical and Dental Clinics: Three (3) patient parking spaces for each staff doctor, plus two (2) parking spaces for each three (3) em- ployees, plus one (1) parking space for each staff doctor. (6) Restaurants — Not including Drive -in Establishments: One. (1) parking space for each 100 square feet of floor area. (7) Retail.Stores, Supermarkets, Department Stores, and Personal Ser- vice. Shops: One (1) space for each one hundred and seventy -five (175) square feet of floor area. (8) Undertaking Establishments and Funeral Parlors: Ten (10) parking spaces for each parlor or chapel unit. (9) . Warehouse; Storage and Wholesale:. Four (4)par.ki'ng spacesplusone (1) parking space for each 1,500.square feet of floor space over 4,500 square feet or when the number of employees is specifically indicated, two (2) parking spaces for each three (3) employees em- ployed on, the premises. (10) Uses in a Shopping Center Under Unified Control or Ownership on a Tract of Land Four Acres or More in Area: The required number of parking spaces for each use shall be 1:25 times the required number of parking spaces as heretofore set forth for such uses. e. Other Uses: Parking spaces for other permitted uses not listed above shall be provided in accordance with requirements designated by the Plan Com- mission and in. the case of conditional uses, as recommended by the Plan Commission and required by the Board of Trustees. 12. Joint Use of Facilities: For the purpose of meeting the parking requirements pro- vided by this section for churches, auditoriums and ether places of public or private assembly, parking spaces already provided to meet off - street parking requirements for stores, office buildings, and industrial establishments, or off - street parking facilities provided by the municipality, lying within three hundred (300) feet of the place of public assembly as measured along the lines of public access, and are made available for other parking, may be used to meet up to seventy -five (75) percent of the total requirements for parking space, subject to the approval of the Board of Trustees. 7 1/3/67 SECTION That all ordinances or parts of ordinances THREE: in conflict herewith, are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to FOUR: publish this ordinance in pamphlet form. SECTION That this ordinance shall be in full force and FIVE: effect from and after its passage, approval and publication, as provided by law.
