Published in pamphlet form by authority of the President and Board of Trustees of the Village of Deerfield, Illinois, the 16th day of January 2 A.D. 1967. r ORDINANCE NO.'0 -67- 4 AN ORDINANCE DECLARING REBATES ON SPECIAL ASSESSMENT WARRANTS NUMBERS 87 and 88 WHEREAS, pursuant to statute, the Village of Deerfield did heretofore institute special assessment proceedings for local improvements known as Special Assessment Warrant Number 87 _(Improvement of Cherry Street and Somerset Avenue) and Special Assessment Warrant No. 88 (Paving Elder-Lane), which improve- ments have been completed; and WHEREAS, the Village Treasurer has advised the President and Board of Trustees that after final settlement with the con- tractor for said improvements and after full payment of all vouchers, bonds and interest coupons there remains a surplus of funds collected; and WHEREAS,'pursuant to statute in such case made and pro - vided, the Village is authorized to utilize such surplus funds to reimburse the public benefit fund and to reimburse the Village for the cost and expense of declaring and making a rebate and to rebate the balance of said funds to the owner or..owners of each lot, block, tract or parcel against which such special tax was assessed. N 0 W, T H E R E F 0 R.E. BE IT ORDAINED BY THE PRESI- DENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That with respect to Village of Deerfield ONE: Special Assessment Warrant No. 87 (Improve- ment of Cherry Street and Somerset Avenue), there is hereby found to be a surplus in the amount of $3,235.42, all as. is more fully set forth on Schedule "A0° which is attached -two hereto and made a part hereof, and a rebate thereof is hereby declared, provided that the public benefit fund of the Village first be reimbursed in the amount heretofore paid from said fund in connection with.said special assessment and that there be deducted an amount equal to 5% of the surplus so remaining to reimburse the Village for the cost of.declaring and making this rebate, and that the balance of said surplus funds be re- bated to the owners of each lot, block, tract or parcel ori- ginally assessed in the amount indicated opposite the description of each such lot, block, tractor parcel on Schedule 1°B" which is attached hereto and made a part hereof. SECTION That with respect to Village of Deerfield TWO: Special Assessment Warrant No. 88 (Paving Elder Lane), there is hereby found to be a surplus in the amount of $2,539.55, all as is more fully set forth on Schedule ".C.19 which is attached hereto and made a part hereof, and a rebate thereof is hereby declared, provided that the public benefit fund of the Village first be reimbursed in the amount heretofore paid from said fund in connection with said special assessment and that there be deducted an amount equal to 5% of the surplus so remaining to reimburse the Village for the cost of declaring and making this rebate, and that the balance of said surplus funds be rebated to the owners of each lot, block, tract or parcel originally assessed in the amount indicated opposite the description of each such lot, block, tract or� parcel on Schedule "D" which is attached hereto and made a part hereof. SECTION That the Village Treasurer is hereby THREE: authorized and directed, in pursuance of the rebates hereby declared, to reimburse the appropriate funds of the Village and to make the rebate payments to the owners of record of those lots, blocks, tracts or parcels as set forth on attached Schedules "B" and 1°D ", upon submission of appropriate evidence of ownership by those per- sons claiming such rebate payments. - three- SECTION That this Ordinance shall be in full force FOUR: and effect from and after its passage, approval and publication, as provided by law.
