AN ORDINANCE GRANTING VARIATIONS FROM
THE PROVISIONS OF THE ZONING ORDINANCE OF
THE VILLAGE OF DEERFIELD WITH RE-
SPECT TO THE PROPERTY COMMONLY KNOWN
AS 760 OSTERMAN AVENUE, DEERFIELD, ILLINOIS

WHEREAS, H -D ELECTRIC COMPANY, has petitioned for variations
from the strict provisions of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended, to
permit a front yard of 47 feet from the center line of Oster-
man Avenue, and to permit a side yard of 12 feet a6d a varia-
tion to eliminate the corner front yard restriction of said
Zoning Ordinance, all with respect to the premises commonly
known. as 760 Osterman Avenue, Deerfield, Illinois; and
WHEREAS, pursuant to notice duly published as required by
statute, a public hearing on said petition was held and con-
ducted by the Zoning Board of Appeals of the Village of Deer-
field; and
WHEREAS, the Zoning Board of Appeals has filed with the Presi-
dent and Board of Trustees its written findings of fact and
recommendations.
NOW THEREFORE,' BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD.' LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the Findings of fact and recommendation of the
ONE: Zoning Board of Appeals is hereby concurred in and
adopted as the findings of fact ofM,the President and
Board of Trustees.
SECTION That there are practical difficulties and particular
TWO: hardship in the way of carrying out the strict letter
of the provisions of the Zoning Ordinance of the
Village of Deerfield as applied to petitioner's

property, which is legally described as follows:
That part of Lot 5 in Phileman Cadwell's Addition
to the Town of Deerfield, said Addition being a part
of the Northwest Quarter of Section 33, Township 43
North, Range 12, East of the Third Principal Meridian,
and of the Northeast Quarter of Section 32, Township
43 North, Range 12, East of the Third Principal Meri-
dian, described as follows: Commencing at the inter-
section of the North line of Osterman Avenue and the
Easterly line of the Depot Grounds of the Chicago,
Milwaukee, St. Paul & Pacific Railroad; thence East
along the said North line of Osterman Avenue 65 feet
for a place of beginning; thence North at right angles.
to said North line of'Osterman Avenue 122 feet; thence
East on a line parallel with the said North line of
Osterman Avenue 48.73'feet; thence Southeasterly to a
point on the said North line of Osterman Avenue which
is 75 feet East of the place of beginning; thence
West 75 feet.along the said North line of Osterman
Avenue to the place of beginning, all in Lake County,
Illinois.
SECTION That variations from the strict provisions of the Zoning
THREE: Ordinance of the Village of Deerfield, passed May 4,
1953, as amended, with respect to the property herein-
after described are hereby granted as follows:
1. A variation from Section XV, Paragraph 6.a -2 of
the Zoning Ordinance so as to permit a front yard of
47 feet from the center line of the street in lieu of
the required 100 feet.
2. A variation from Section XV, Paragraph 6.b of the
Zoning Ordinance so as to permit a side yard of 12 feet
in lieu of the required 25 feet.
3. A variation from Section XV, Paragraph 6.a -4 of
the Zoning'Ordinance so as to eliminate the corner
front yard requirement.

SECTION That the variations hereby granted are subject to the
FOUR: condition that there be compliance by the petitioner
with all other applicable provisions of the Zoning
'.Ordinance and all other ordinances of the Village.
SECTION That this Ordinance shall be in full force and effect
FIVE: from and after its passage and approval, as provided by
law.
