O-67-174c �c �F 4c �c �c � �'c 4c �c �c � �'c �c * �r �'c • s'c sY 9c 4r �'c �c �'c 9r * �c * �'c �? 4c �c �r * r * * V I L LAG E * ' * * * 0 * F * * * D E E R F I E L D, I L L I N O I S * * * * * * * * �c * * ORDINANCE NO.' 0 -67- 17 * * * AN ORDINANCE PROVIDING FOR REIMBURSEMENT OF * COST OF BERRELEY'COURT SANITARY SEWER AND WATER MAIN EXTENSION * * * * PASSED and APPROVED by * * the President and * Board of Trustees the * j]th day of Apri 1 3 * A.D. 1967. * * Published in pamphlet form by authority of the corporate' authorities of the Village of Deerfield, Illinois, the-= -1'7th day of April , A.D. 1967.: ORDINANCE NO. 0 -67- 17 AN ORDINANCE PROVIDING FOR REIMBURSEMENT OF COST OF BERKELEY-COURT SANITARY SEWER AND WATER MAIN EXTENSION WHEREAS, GEE BUILDERS AND IMPROVEMENT CORP., an Illinois corpora- tion, is the owner and party interested in the property described as follows: Lots 1, 2 and 3 in Hermann's First Addition to the Village of Deerfield, being a subdivision in the North- east Quarter of Section 30, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois, and is willing to undertake the construction by private contract and pay the cost of certain underground improvements consisting of'sani- tary sewer and water main extensions in the right -of -way of Berkeley Court and Carol Lane in the Village of Deerfield, all in accordance with certain plans and specifications heretofore submitted; and WHEREAS, said improvements when constructed may be made avail- able to and will be a benefit to the following described properties: Lots 3, 4, 5, 6 and 7 in Derrland Park Unit #12 being a subdivision in Section 30, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois, and the west 100 feet of Lot 4 in Hermann's First Addition to the Village of Deerfield, being a sub- division in the Northeast Quarter of Section 30, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois, and upon acceptance and approval of the Village will become public improvements; and WHEREAS, the construction of said improvements by private con- tractor will result in substantial savings to persons or property [2] owners having present or future use thereof, as compared with the costs of the construction of such improvements by special assess- ments; and WHEREAS, the said Gee Builders propose to construct said improvements by private contract upon the condition that the Village of Deerfield be not charged with any part of the cost thereof, and with the understanding that the Village require the owners of the benefited properties desiring to connect to and utilize said improvements reimburse Gee Builders and Improvement Corp. for such property owner's proportionate share of the cost of the construction thereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That upon completion of the construction of said im- ONE: provements and upon acceptance and approval thereof by the Village, title to said improvements and all rights appurtenant thereto shall be in the Village, and said im- provements shall become a part of the Village Sewer and Water systems and thereafter shall be maintained by the Village in the same manner as all other public improvements. SECTION That upon completion of said improvements and acceptance TWO: and approval thereof by the Village and for a period of ten (10) years thereafter, no person, firm or corporation, excepting Gee Builders and Improvement Corp. shall connect to said improvements for the purpose of providing services to properties being benefited as listed above. No such permit shall be issued by the Village unless the applicant shall submit evidence of payment to Gee Builders and Improvement Corp., or its successors and assigns, in reimbursement of such owner or owners' proportionate share of the cost of said improvements, which is hereby determined to be in accordance with the following schedule: For each of the benefited parcels hereinabove described: For connection to the water main ........ $352.91 For connection to the sanitary sewer .... $398.62 [ 3 l Such payment to Gee Builders and Improvement Corp. shall be in addition to the usual charges and fees established by ordinance and payable to the Village for the issuance of such permits. From and after the expiration of the ten -year period hereinabove provided, there shall be no obligation on the Village to see to any reimbursement for the cost of said improvements. SECTION That the Village Clerk is hereby directed to publish THREE: this ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect FOUR: from and after its passage, approval and publication, as provided by law.
