O-66-37ORDINANCE NO. 0 -66 37, AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS :500 :WAUKEGAN .-ROAD..:DEERFIELD WHEREAS, KITCHENS OF SARA LEE, INC. has petitioned for a variation from the strict provisions of the Zoning Ordinance of the Village of Deerfield passed May 4, 1953, as amended, to permit the erection of a roof structure to a height not to exceed fifty -four feet on that portion of its building complex located at 500 Waukegan Road, Deerfield, Illinois, known as the "holding freezer "; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing conducted by the Zoning Board Deerfield; and n said petition was held and of Appeals of the Village of WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation ONE: of the Zoning Board of Appeals is hereby con- curred in and adopted as the findings of fact of the President and Board of Trustees. SECTION TWO: Zoning Ordinance petitioner's pro- forth on Exhibit That there are practical difficulties and particular hardship in the way of carrying out the strict letter of the provisions of the of the Village of Deerfield as applied to perty, the legal description of which is set "A" attached hereto and made a part hereof. SECTION That a variation from the strict provisions THREE: of Paragraph 5 of Section XV of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property herein described is hereby granted so as to authorize the construction and erection of a roof structure to a height not to exceed fifty -four feet on that portion of the building complex located thereon known as the "holding freezer." . SECTION That the variation hereby granted is subject FOUR: to the condition that there be compliance by the petitioner with all other applicable ordinances of the Village.
