O-63-10AN ORDINANCE ESTABLISHING EXCESS FACILITY UTILITY RATES BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield that: Section 1. The rates hereinafter set forth shall be paid in addition to the charges set forth in other ordinance provisions for water or sewer service rendered by the village water system or sewage system. Section 2. Such additional rates shall be: Water: An additional charge of thirty -eight dollars and fifty -eight cents ($38.58) on each one thousand gallons or fraction thereof of water per day, in excess of three thousand gallons per day per acre of the tract upon which the premises served are located. Sewer: An additional charge of forty -eight dollars and fifteen cents ($48.15) for each one thousand gallons or fraction thereof per day flowing into the sewer in excess of three thousand gallons per day per acre of the tract upon which the premises served are located. The additional rates shall be based on the total 4jRjMW&_ demand for any three -month period. The three- month periods shall start- at the beginning of each fiscal year. At the end of each three -month period the total i of the user shall be computed to determine whether the basic allowance per acre is being exceeded. The maximum excess demand for any three -month period shall establish the excess rate and the excess facility rate shall become payable at the end of each fiscal year. Section 3. The additional rate approved by this ordinance shall be computed at the end of each three - month period and will be in effect for the entire year and shall be paid in the same manner and within the same time after the bill is rendered as in the case.of the regular charge for sewer and water rates. This additional rate shall be based on the total area of the site upon which the premises served are located,and the total water furnished, or flowing into the sewer, during the year. Water or sewer service may be discontinued for non- payment of this additional charge,and this charge shall be a lien on the premises served, in the same manner as for nonpayment of the regular rates for water or sewer service. Section 4. Where there is more than one user of the water or sewer facilities on the same site and the total use does not exceed the three thousand gallons per acre formula set forth above, for the entire tract, there shall be no additional charge under this ordinance. If the total use does exceed. this amount, the additional charge shall be apportioned to the user or users whose demand exceeds his_! share of the three thousand gallons per day in proportion to such excess. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. PASSED this day of _, 1963.
