O-61-39IORDINANCE 0 -61- 39 ZONING AMENDMENT - "Ll" MANUFACTURING DISTRICT WHEREAS a public hearing on the question of adopting the following amendments to the zoning ordinance of the Village following notice duly published as required by law, was held by the Plan Commission: NOW THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield, that: Section XV of the Zoning Ordinance of the Village of Deerfield, adopted May 4, 19539 be and the same is hereby amended to read as follows: "Section XV - M Manufacturing District" 11 Purpose: M. Manufacturing District is designed to permit industrial and other related activities which do not detract from the general character of the Village. No use permitted in this District shall be so• conducted as to endanger or injure the general welfare of the owners or occupants of premises in the Village, or of the public. 2. General Standards: The use and construction of all buildings, premises or structures in the M Manufacturing District shall comply with the following regulations: (a) No building shall be used for residential purposes. (b) No retail sales or services shall be permitted. (c) All production, processing, cleaning, servicing, testing, storage, or repair of materials,. goods, products, or equipment shall take place within completely enclosed buildings. Any present use which shall become non - conforming to this section by the adoption of this ordinance shall be dis- continued within the period of fifteen (15) years from the adoption of this ordinance. (d) jffhere any use abuts a residence district at a side or rear lot line, or is separated from a residence district only by an alley along a side or rear lot line, such use shall be effectively screened from such residence district by a properly maintained solid evergreen planting, solid fence, or solid wall not less than six:. feet nor more than eight feet in height extending along such rear or side lot line. (e) All structures erected within an M- Manufacturing District shall be of fire resistive construction and shall be of that construction in which all structural elements, including walls, bearing partitions, floors, ceilings, roofs and their sup- ports are of non - combustible materials. Required hours of Fire resistance for the foregoing shall be as follows: -1- The standards to be used for determining the fire resistance of materials shall be as specified in the pamphlet on fire resistance ratings published by the Underwriters Laboratory, Inc., of Chicago, in 1957. The foregoing requirements for Fire resistance construction in an M Manufacturing District shall supersede those parts of the Deerfield Building Code which may be in conflict with the above. (f) All premises shall be furnished with all- weather surface walks. Except for parking areas, adjacent grounds shall be planted and landscaped. (g) Fire and Explosive Hazards 1) The storage, utilization or manufacture of materials or products shall be such as not to cause or create a fire hazard. 2) The storage and utilization but not the manufacture of materials or products ranging from free or active burning to intense burning, as determined by the Building Commissioner, is permitted only if said materials or products shall be stored or utilized within a completely enclosed building having fire resistive construction as referred to in section (e) above, and the building is to be protected by an automatic sprinkler system complying with installation standards prescribed by the National Board of Underwriters standards for the instal- lation of sprinkler systems published in 1961. 3) The storage or utilization of materials which produce flammable or explosive vapors or gases having a closed cup flash point under 130OF is prohibited except when such materials are used for power or heating fuels or for laboratory use, or as a refrigerant or for cleaning purposes, in quantities not to exceed 25 gallons, with; storage not to exceed 55 gallons. 4) The storage or utilization of materials which produce flammable or explosive vapors or gases having a closed cup flash point over 150OF shall not exceed 500 gallons of any one material or product above ground, and shall be within a completely enclosed building having fire resistive construction as referred to in section (e) above, and the building is to be protected by an auto- matic sprinkler system complying with installation standards prescribed by the National Board of Fire Underwriters. 5) Storage of materials be limited underground to No. 5 and No. 6 fuel oil sufficient for the normal building or buildings. -2- for power or heating fuel shall 20,000 gallons, except for which may be stored in quantities heating requirements of the lours 1) Exterior walls 3 2) Interior bearing walls 3 3) Exterior columns 3 4) Interior columns a. Performance Standards: All uses in an M- Manufacturing District shall be subject to the following Performance Standards.: (a) Noise - no noise from operations (other than that emanat- ing from vehicular traffic) either continuous or inter- mittent, shall be detectable at the limits of the tract on which the Manufacturing structure or structures are erected. (b) Glare or Heat - No glare or heat shall be detectable at the limits of the tracts on which the Manufacturing struc- ture or structures are erected. (c) No vibrations shall be detectable at the limits of the tract on which the Manufacturing structure or structures are erected. (d) Lights - Exterior lighting shall be shaded to avoid casting light upon any residence district or into public streets or parks. (e) No toxic matter, noxious matter, smoke or gas, and no odorous or particulate matter detectable at the limits of the tract on which the Manufacturing structure or structures are erected shall be emitted. 4. Permitted Uses: No premises, structure or building in the M- Manufacturing District shall be used for any purpose or activity other than the following: (a) Artificial limb manufacture (b) Bakeries, wholesale (c) Broom manufacture (d) Box manufacture (e) Building equipment, building materials, lumber, coal, sand, and gravel storage, and storage for contracting equipment or operating equipment of public agencies, or public utilities, or materials orequipment of similar nature. (f) Canvas goods fabrication (g) Carpet and rug cleaners (h) Cleaning and dyeing establishments (i) Clothing and dress manufacture (j) Drapery and bedding manufacture (k) Electrical appliances and electronic instrument assembly (1) Furniture manufacture and upholstering (m) Greenhouses, wholesale growers (n) Heating and sheet metal fabrication (o) Laundries, more than 1000.pounds daily capacity (p) Machine shops and metal products manufacturers (q) Printing, binding and publishing of periodicals, books . . and reading matter -3- .1 4, Permitted Uses - Jontinued (r) Printing of tags, forms, . for commercial use. (s) Public utility electric centers, gas regulation holder stations (t) Telephone exchange (u) Tool and die shops (v) Window shade manufacture calendars and other, products substations -and distribution centers and'-underground gas (w) The compounding and packaging of cosmetics and pharma- ceuticals (x) The manufacture, compounding, assembling or treatment of articles of merchandise from the following previously prepared materials: bone, cellophene, canvas, cloth, cork, feathers, felt, fibre, furs, glass, hair, horn synthetic fibres, tanned leather, paper, plastics, _precious or semi - precious stones or metals, shell, textiles, wood (excluding planing mills) and yarns (y) The manufacture of pottery and figurines or any other similar ceramic products using only previously pulverized clay and kilns fired only by electricity or gas. 5. Height regulations: No building or structure shall be erected or structurally altered to exceed a height of two (2) stories nor shall it exceed thirty -five (35) feet in height except as provided in Section V. .6. Area Regulations: No building shall be erected on any lot having a frontage of less than one hundred fifty (150) feet at the building line, and an area of less than three (3) acres. The maximum ground area occupied by all buildings shall not be more than sixty per cent (600) of the area of the 1ot..or tract on which a building permit has been issued. (a) Front Yard: On streets or roads having an eighty (80) foot right -of -way, there shall be a front yard having a depth of not less than one hundred twenty -five (125) feet' from the center line of-the street or road, wherein.there shall be no structure of,any kind, or the parking of auto- mobiles. On streets or roads having a sixty (60) foot right-of-way, there shall be a front yard having a depth of not less than one hundred (100) feet from the center line of-any- street or road, wherein thate shall be no structure of any kind, or the parking of automobiles. Provided that, on Waukegan Road or County Line (Lake -Cook) Road, there shall be a front yard having a depth of-not less than one hundred.ninety (190) feet from the center line of the road, wherein there shall be no structure of any kind, or the parking of automobiles. On a corner lot, there shall be a front yard on each street side of such lot, as hereinabove provided. -4- (b) Side Yard: There shall be a. minimum side yard of not less than twenty -five (25) feet on both Bides of the building or buildings,-but where the property is ad- jacent to an "R" District, there shall be a side yard of not less than fifty (50) feet on the side nearest to the residential lots. The parking of private automobiles may be permitted within the said side yard areas, but not closer than twenty (20) feet to any lot zoned for resi- dential use. (c) Rear Yard: A rear yard is not required except where a lot abuts upon an "R" District, in which case there shall be a rear yard of not less than fifty (50) feet and no parking of automobiles shall be permitted within the twenty (20) feet closest to any residential lot or lots. Section XVI of the said ordinance relating to parking pro- visions is hereby amended so-.-that the paragraph relating to "Manufacturing Establishments" shall read: "Manufacturing Establishments" - One parking space for each two (2) employees based on the greatest number of em- F3byees at work at one time, to be provided on the premises." This ordinance shall be in full force and effect from and after its passage, approval and publication, as required by law. PASSED this 5th day of September , 1961.
