O-21-08VILLAGE OF DEERFIELD ORDINANCE NO. 2021- 0-21-08 AN ORDINANCE AMENDING SECTION 9.02-F.3 OF "THE DEERFIELD ZONING ORDINANCE 1978", AS AMENDED, TO ALLOW A DIGITAL SCOREBOARD AT A PUBLIC HIGH SCHOOL PROPERTY TO BE USED FOR CERTAIN NONATHLETIC USES IN THE P-1 DISTRICT WHEREAS, the Village is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, Township High School District 113 (`Applicant') is the owner of that certain property commonly known as Deerfield High School located at 1959 Waukegan Road ('Property'); and WHEREAS, the Property is located in the P-1 Public Lands District (`P-1 District'); and WHEREAS, pursuant to Section 9.02-F.3 of the "Deerfield Zoning Ordinance 1978," as amended (`Zoning Ordinance'), the Property may contain a digital scoreboard ('Scoreboard) for use during high school athletic events; and WHEREAS, the Applicant submitted an application to the Village seeking approval of, among other things, an amendment to Section 9.02-F.3 of the Zoning Ordinance to allow a scoreboard in the P-1 District located on a public high school athletic field to be used during the day and only for general academic purposes, extracurricular activities, and community events (`Proposed Amendment'); and WHEREAS, a public hearing by the Plan Commission to consider the Proposed Amendment to the Zoning Ordinance was duly advertised on November 19, 2020 in the Deerfield Review, and was held on December 10, 2020; and WHEREAS, on December 10, 2020, the Plan Commission approved findings of fact in support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Amendment by the Village Board; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. Additions are bold and double -underlined; deletions are struck through. {00035482.5} SECTION TWO: AMENDMENTS TO SECTION 9.02-F.3. Section 9.02-F.3, titled "Digital Scoreboard Sign for Public High School Property," of Title 9, titled "Signs," of the Zoning Ordinance is hereby amended to read as follows: "9.02-F.3 A digital scoreboard sign used in conjunction with a public high school athletic field may en4y be turned on only during the following time periods: a. thane time periods ", When an athletic event is occurring on the athletic field premises; provided, however, that sound associated with advertisements, animations, and similar video or static images on the digital scoreboard shall not exceed 10 minutes per event; b. Academic activities and extracurricular activities during daytime hours; and C. Non -high school community events; provided however that sound association with pre -produced video or static images on the digital scoreboard for non -high school community events shall not exceed 30 minutes per event; and provided further that the number of non -high school community events that may use the sound system for pre: produced video or static images on the digital scoreboard shall not exceed 10 per year. Nothing in this this Section 9.02-F.3 shall restrict the use of the public address system on the athletic field premises for announcements or music so long as such announcements or music is not specifically tied to the video on the scoreboard. Notwithstanding anything to the contrary in Sections 9.01-B.8.a and 9.01-B.8.b of this Code, a digital scoreboard used in conjunction with a public high school athletic field may have moving, flashing, and ahimmering content despite the digital scoreboard's vision from a private or public street, or parking lot. ml' tain no more than four pefmanent panels, not to emeeed 32 square feet eaeh, for- display of statie advertising.-" SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR= EFFECTIVE DATE.
