O-21-03VILLAGE OF DEERFIELD ORDINANCE NO. 2020- 0-21-3 AN ORDINANCE REZONING THE PROPERTY LOCATED AT 10 DEERFIELD ROAD TO THE R-5 GENERAL RESIDENCE DISTRICT WHEREAS, Zion Lutheran Evangelical Church ("Owner's owns the parcel of property commonly known as 10 Deerfield Road, in Deerfield, Illinois, and legally described in Exhibit A attached hereto ("Property'); and WHEREAS, Brinshore Development LLC, an Illinois Limited Liability Corporation, and Housing Opportunity Development Corporation, an Illinois not-for-profit corporation (collectively, the "Applicant', is under contract with the Owner to enter into a 99 -year lease agreement for the Property and construct on the Property two multi -family apartment buildings ("Deuelopment'�; and WHEREAS, the Property is currently located in the R-1 Single Family Residence District ("R-1 District'; and WHEREAS, in order to construct the Development, the Applicant, with the consent of the Owner, filed an application with the Village seeking approval of, among other things, a special use permit for a planned residential development and the rezoning of the Property ("Proposed Rezoning' to the R-5 General Residence District ("R-5 District'; and WHEREAS, a public hearing by the Plan Commission to consider an amendment of the Zoning District Map of the Village of Deerfield, Lake and Cook Counties, Illinois ("Zoning Map's to rezone the Property in accordance with the Proposed Rezoning was duly advertised in the Deerfield Review on June 7, 2018, and was held on August 28, 2018; and WHEREAS, on August 28, 2018, the Plan Commission approved findings of fact in support of the Proposed Rezoning, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Rezoning by the Village Board; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to rezone the Property in accordance with the Proposed Rezoning, as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: ZONING MAP AMENDMENT. The Zoning Map is hereby amended to rezone the Property from the R-1 District to the R-5 District, all in accordance with, and pursuant to, Section 13.10 of the Zoning Ordinance and the home rule powers of the City. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
