O-19-46VILLAGE OF DEERFIELD ORDINANCE NO. 0-19-46 AN ORDINANCE ESTABLISHING A ONE YEAR MORATORIUM ON THE ENFORCEMENT OF CHAPTER 18, PUBLIC TRANSPORTATION, OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD ILLINOIS 1975" AS AMENDED WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, pursuant to Chapter 18, of "The Municipal Code of the Village of Deerfield," as amended ("Village Code', the Village requires: (i) taxicab companies to obtain from the Village a certificate of public convenience; (ii) public passenger vehicles to obtain a Village license; and (iii) licensed public passenger vehicles to comply with certain regulations (collectively, "Taxicab Regulations'; and WHEREAS, since the adoption of the Taxicab Regulations, there has been significant growth in the use of alternative ride -sharing services; and WHEREAS, the Village does not currently regulate ride -sharing services; and WHEREAS, as a result of the growth in demand for ride -sharing services, the number of taxicab companies and public passenger vehicles that have applied to the Village for certificates of public convenience and licenses has significantly declined; and WHEREAS, the Village desires to study if, and how to, regulate taxicab companies, public passenger vehicles, and ride -share services operating in the Village; and WHEREAS, while the Village studies if and how to regulate taxicab companies, public passenger vehicles, and ride -share services, the Village Board has determined that the imposition of a temporary one-year moratorium with regards to the enforcement of the Taxicab Regulations is in the best interests of the Village and its residents; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: TEMPORARY MORATORIUM. A. Establishment. The Village Manager, Police Department and all other Village departments shall: (i) not accept applications for taxicab company certificates of public convenience; (ii) not accept applications for public passenger vehicle licenses; and (iii) impose and enforce any regulations contained in Chapter 18 of the Village Code (collectively, "Temporary Moratorium'). #71875529_v1 B. Limited Time Period. The Temporary Moratorium, unless sooner terminated by Ordinance duly adopted by the Village Board without further notice or hearing, will remain in full force and effect for a limited period of January 1, 2020 to December 31, 2020. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance shall be in full force and effect after its passage, approval, and publication in the manner provided by law.
