O-19-36VILLAGE OF DEERFIELD ORDINANCE NO. 2019- 0-19-36 AN ORDINANCE AMENDING CHAPTER 22 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, TO PROHIBIT PARKING ON VILLAGE RIGHTS-OF-WAY AND IN VILLAGE PARKING LOTS AFTER TWO INCHES OF SNOWFALL WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, pursuant to Chapter 22 of "The Municipal Code of the Village of Deerfield, Illinois, 1975", as amended ("Village Code', the Village regulates parking on Village rights-of-way and in Village parking lots after three inches of snowfall to allow the Village to more efficiently remove snow and ice from Village rights-of-way and parking lots ("Parking Regulations'); and WHEREAS, the Village Board desires to amend the Parking Regulations so that they apply when there is two inches of snowfall to better enable the Village to remove snow and ice from the Village rights-of-way and parking lots; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend the Parking Regulations pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: ALL NIGHT PARKING. Section 22-67, titled "All Night Parking," of Article 12, entitled "Parking Regulations," of Chapter 22, titled "Vehicles and Traffic," of the Village Code is hereby amended further to read as follows: "22-67: All night parking. No person shall park any vehicle on any street for a period of time longer than thirty (30) minutes between the hours of 2:00 A.M. and 6:00 A.M. of any day, except physicians on emergency calls and those persons who shall have received prior permission therefor from the Police Department of the Village of Deerfield. Any person desiring permission to park within the prescribed hours shall contact the Police Department of the Village of Deerfield and shall receive permission, except that no such permission will be granted for parking within twelve (12) hours of a snowfall of three two inches 4 or more as set forth in Section 22-71. SECTION THREE: ALL NIGHT PARKING. Section 22-71, titled "No Parking; Snow Removal" of Article 12, entitled "Parking Regulations," of Chapter 22, titled "Vehicles and Traffic," of the Village Code is hereby amended further to read as follows: "22-71: No Parking; Snow Removal: It shall be unlawful to park any vehicle on any public street in the village or in any 'village parking lot", as defined in section 22-129 of this chapter, after a snowfall of three two inches (44 or more has occurred. Said restriction shall remain in effect for a period of twenty four (24) hours or until such streets or parking lots have been cleared." SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and effect ten days after its passage, approval, and publication in the manner provided by law.
