08/17/2015August 17, 2015 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Harriet Rosenthal in the Council Chambers of the Village Hall on August 17, 2015, at 7:30 p.m. The clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Thomas Jester Robert Nadler William Seiden Barbara Struthers Absent: Alan Farkas Dan Shapiro and that a quorum was present and in attendance. Also present were Village Attorney Peter Coblentz and Kent Street, Village Manager. PLEDGE OF ALLEGIANCE Deputy Chief Tom Keane lead those in attendance in reciting the Pledge of Allegiance. REPORT ON DEPARTMENTAL Deputy Chief Keane presented highlights from the OBJECTIVES — POLICE DEPARTMENT Police Department report representing the past 6 months. Deputy Chief Keane noted the department exceeded their fundraising goals for the Special Olympics of Illinois, including Cop on Top. They had a terrific turnout and got the opportunity to participate in the Special Olympics Torch Run. The index crimes increased from 50 to 71, primarily due to theft cases. Several other area municipalities have seen increases in index crimes, and Deerfield's number is still quite low. Mayor Rosenthal requested an article be put in D -Tails regarding bicycle locks. Deputy Chief Keane noted the number of parking tickets have significantly decreased. The number of tickets issued to people for using a hand-held mobile device has decreased. He attributes it to their education programs. Trustee Jester expressed concern because he has not seen a significant reduction in cell phone use while driving. MINUTES OF PREVIOUS MEETING Trustee Nadler moved to approve the minutes from the August 3, 2015, Board of Trustees meeting. Trustee Struthers seconded the motion. The motion passed unanimously on a voice vote. BILLS AND PAYROLL Trustee Struthers moved to approve the bills and payroll dated August 17, 2015. Trustee Seiden seconded the motion. The motion passed by the following vote: AYES: Jester, Nadler Seiden, Struthers (4) NAYS: None (0) Board of Trustees Meeting August 17, 2015 Page 2 of 5 PUBLIC COMMENT Scott Colburn, 948 Osterman, expressed concern about the Community Integrated Living Arrangement (LILA) facility at 943 Osterman, which he feels has brought a security risk to his neighborhood. He is quite concerned, especially because it is near a school zone. Mr. Colburn indicated the Police Department has been called to the home and there have been multiple squad cars at the facility. It is very alarming and he believes it needs to stop. Mayor Rosenthal noted this is a home that is owned by the parents of a severely autistic individual. The home has been leased to Clearbrook, a non-profit that operates CILA. Clearbrook has scheduled a meeting with the neighbors on September 2, 2015, to try to address their concerns. The Village is trying to do everything legally possible to ensure the neighbors and individual are both safe. Mr. Coblentz stated the Village's Zoning Ordinance allows up to five unrelated individuals to live together. The Federal Fair Housing Act makes it illegal to discriminate against mentally handicapped individuals. The home is legal under the Village's Zoning Ordinance. The Village is researching the requirements for such facilities under State law to ensure the home is working in compliance with all regulations. He suggested contacting the State Department of Human Services with their concerns. The Village needs to operate within the framework of the law, but is looking into the residents' concerns. Mr. Colburn believes Clearbrook mislead the neighbors by telling them the residents would be high -functioning individuals that will work during the day. Mayor Rosenthal stated the Village is concerned about the safety of all Village residents. The police department goes through bus stops with the schools each year to ensure safety and will take this matter into consideration. Mayor Rosenthal noted the Village will do what they can for the community, the neighborhood and the individual resident in question. The Village is taking this concern very seriously. Tony Kavadas, 930 Central, appreciates the Mayor and Trustees for being approachable to residents. He stated there are a number of residents that are concerned about safety in the neighborhood. Mr. Kavadas indicated his daughters, aged 10 and 12, are afraid because they have seen Clearbrook staff restrain this resident. His family has been asked by the police department to go inside their home because of this individual. He believes that Clearbrook is operating a business in this home, which is creating problems. He believes there will be more issues when the Central Avenue construction begins. Harry Mark, 934 Osterman Avenue, stated the home has been altered to keep this individual contained. The police department has felt it necessary to shut down the road because of this individual. Mr. Mark's daughter has come home in tears because the police are surrounding the house. He is sympathetic to handicapped individuals and the family, but believes there are more appropriate facilities that can better take care of that individual. REPORTS There were no Reports. Second WITH VERIZON WIRELESS — 2R Reading. Trustee Jester moved to adopt the Ordinance. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Jester, Nadler Seiden, Struthers (4) NAYS: None (0) AUTHORIZATION TO RENEW An authorization to renew the intergovernmental INTERGOVERNMENTAL agreement for the maintenance of Reservoir 27. AGREEMENT FOR MAINTENANCE OF RESERVOIR 27 Mayor Rosenthal indicated the Village would receive 100 percent reimbursement. Trustee Struthers moved to authorize the renewal of the intergovernmental agreement for maintenance of Reservoir 27. Trustee Nadler seconded the motion. The motion passed by the following vote: AYES: Jester, Nadler Seiden, Struthers (4) NAYS: None (0) OLD BUSINESS ORDINANCE 0-15-24 INCREASING An Ordinance increasing the number of Class E THE NUMBER OF CLASS E LIQUOR liquor licenses from 15 to 16 for El Tradicional LICENSES FROM 15 TO 16 (EL Mexican Restaurant. Second Reading. TRADICIONAL) — 2R Trustee Struthers moved to adopt the Ordinance. Trustee Jester seconded the motion. The motion passed by the following vote: AYES: Jester, Nadler Seiden, Struthers (4) NAYS: None (0) NEW BUSINESS ORDINANCE AMENDING THE An Ordinance amending the Municipal Code to MUNICIPAL CODE TO INCLUDE include Appendix J of the 2012 International APPENDIX J OF THE 2012 Residential Code. First Reading. INTERNATIONAL RESIDENTIALCODE Board of Trustees Meeting August 17, 2015 Page 4 of 5 Code Enforcement Supervisor Clint Case indicated Appendix J recognizes there are older homes in town that cannot be strictly in compliance with new codes. Appendix J grants the building official some flexibility to look at the code and use common sense. Mayor Rosenthal indicated this would stand as a First Reading of the Ordinance. DISCUSSION MOMENT OF SILENCE Those in attendance observed a moment of silence in memory of Ray Craig. Mr. Craig was a former Village Trustee. He was also very active in the Presbyterian Church and served on the Northwest Quadrant Task Force. NEW LIBRARY DIRECTOR The Deerfield Library hired a new director, Amy Falasz-Peterson. Mayor Rosenthal stated she is very enthusiastic about being in Deerfield and will be an asset to both the Library and the Village. MAYORS MEETING Mayor Rosenthal attended a meeting of mayors of surrounding communities. TRUSTEE IN THE TOWN Mayor Rosenthal and Trustee Seiden attended Trustee in the Town last Saturday. They spoke with a lot of residents. Most residents seem to be happy living in Deerfield. GRILLFEST This Saturday, the Farmer's Market will be hosting Grillfest, giving away free, grilled sweet corn to patrons. OPEN HOUSE Whole Foods will be holding an open house in honor of their 15fl' anniversary on Saturday, Aug. 22. BANNOCKBURN BBQ CHALLENGE Mayor Rosenthal invited all residents to the Bannockburn BBQ Challenge, which will take place on August 22, 2015 from 2 p.m. to 4 pm. Neighboring communities will be offering brisket, ribs and a side dish. She encouraged residents to vote for Deerfield. NEXT MEETING Mr. Street reported the next Board of Trustees meeting will take place on Tuesday, September 8, 2015, due to observance of the Labor Day holiday on Monday.
