O-66-10ORDINANCE NO.. 0 -66 -10 AN ORDINANCE AMENDING ARTICLE VIII OF CHAPTER 17 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1963, AS AMENDED (RELATING TO LIVERY SERVICE) BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article VIII of. Chapter 17 of the Municipal ONE: Code of the Village of Deerfield of 1963, as amended, be and the same is hereby further amended by adding a new Sub - Article 7 as folitows: "17.807 Livery Service.) 17.807.1 Definition.) The term "livery vehi,cl.e" as used.in this Article shall mean and include a public passenger vehicle for hire only at a charge or fare for each.passenger per trip or each vehicle per trip fixed by.agreement in advance. 17.807.2 Certificate of Public - Convenience and Necessity Required.) No person shall operate or permit a livery vehicle owned or controlled by him to be operated as a vehicle for hire upon the streets of the Village without' first having obtained a certificate of public convenience and necessity issued by the Board of Trustees., 17.807.3 Application and Issuance of Certificate.) An application for a certificate of public convenience and necessity for a livery service shall be filed, a public hearing held and a certificate issued or denied in the same manner as provided for taxicabs in Sub - Article 1 of this Chapter, and, similarly, the provisions of,Sub- Article 1 of this Chapter with respect to liability insurance, license fees and the transfer, suspension or revocation of a certifi- cate shall be equally applicable to certificates of public convenience and necessity for livery vehicles and the holders thereof, provided, however, that the annual license fee shall not exceed $10.00 per livery vehicle. 17.807.4 Vehicles -- Equipment and Mai,ntenance.) (a) Livery vehicles shall be licensed in the same manner and subject to the same regulations as taxicabs as set forth in Sections 17.802.1 - 17.802.3 of this Chapter. (b) It shall be unlawful for any person to hold himself out to the public by advertisement, or otherwise, to render any livery service, unless he holds a certificate issued under, the provisions of this Chapter, or for any holder of such certificate to use-the words "cab," "cabman," "Taxi," or "taxicab" in connection with or as part of, his operation of livery vehicles. 17.807.5 Driver's License.) (a) No person,shall operate a livery vehicle for hire upon the streets of the Village of Deerfield, and no person who owns or controls a livery vehicle shall permit it to be so driven, and no livery vehicle - licensed by the Village of Deerfield shall be so driven at any time for hire, unless the driver of said livery vehicle shall have first obtained and shall have then in force a livery vehicle driver's license issued under the provisions of this Ordinance. (b) All the provisions of Sub - Article 5 of this Chapter with respect to a taxicab driver's license shall be 1 equally applicable to a l: W6ry;)vehic1e'drive01s..;license, provided that every livery vehicle driver licensed under this Chapter shall have his license in his possession at all times while operating said vehicle, but need no post such license in said vehicle. 17.807.6 Solicitation of Passengers Prohibited.) It shall be unlawful for any person to solicit passengers for transportation in a livery vehicle on any public way. No such vehicle shall be parked on any public way for a time longer than is reasonably necessary to accept passengers in answer to a call for service and no passengers shall be accepted for any trip in such vehicle without previous engagement for such trip, at a fixed charge or fare, through the station or office from which said vehicle is operated. 17.807.7 Over -all Service.) All persons engaged in the livery service business in the Village of Deerfield shall render an over -all service to the public desiring to use livery vehicles. Holders of certificates.of public convenience and necessity shall maintain a central place of business and keep the same open for reasonable hours during the day and evening for the'purpose of receiving calls and dispatching vehicles. Any hodler who shall unreasonably refuse to provide over -all livery service shall be deemed in violation of this Ordinance and the certificate granted to such holder shall be revoked at the discretion of the Board of Trustees." SECTION That all ordinances and parts of ordinances in conflict TWO: herewith, are, to the extent of such conflict hereby .repealed. SECTION That this Ordinance shall be i.n full force and effect from THREE: and after its passage, approval and publication, as provided by law.
