01/20/2015January 20, 2015 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Harriet Rosenthal in the Council Chambers of the Village Hall on January 20, 2015, at 7:30 p.m. The Clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Robert Benton Alan Farkas Thomas Jester Robert Nadler William Seiden Barbara Struthers and that a quorum was present and in attendance. Also present were Village Attorney Peter Coblentz and Kent Street, Village Manager. PLEDGE OF ALLEGIANCE Steve Sadin from the Pioneer Press led those in attendance in reciting the Pledge of Allegiance. THANK YOU Mayor Rosenthal thanked the community for their support of the Give Where You Live program that took place yesterday. She was overwhelmed by the generosity of the community including Dr. Gerry Zachar and Stephanie Locascio from the Deerfield Police Department's Social Services Division and the corporate sponsors and residents that participated. The event collected a van - load of food for the West Deerfield Township Food Pantry, hundreds of letters for armed service personnel, and a two -month's supply of hygiene kits for distribution at PADS homeless shelters. Similar programs will continue throughout the year. REPORT ON DEPARTMENTAL Director of Public Works and Engineering Barbara OBJECTIVES — PUBLIC WORKS Little presented highlights from the Public Works and Engineering Department. The department welcomed Tyler Dickinson who started yesterday as the new Engineering Technician. The department has implemented and is starting a number of programs including the inflow and infiltration program, street rehabilitation, gas line relocation, pole relocation, the Briarwood Vista infrastructure project, bridge improvements, flood plain management and documentation, recertification and audit, North Trail subdivision improvement, drainage studies and water system upgrades. The street department maintains the streets and handles snow and ice control. They are working on regulatory signs, maintenance of trees in the public right-of-way, ash tree removal and parkway tree replacement. The water department repairs and maintains water mains, perform leak surveys, replaced a 5 MGD pump in the Richfield Reservoir and Pumping Station, and installed 327 new Orion meters. Board of Trustees Meeting January 20, 2015 Page 2 of 6 The sewer department repairs the sanitary and storm sewer systems. They have performed a lot of work in the north and northeast quadrants. They lined more than 5,200 feet of sanitary sewer and 75 percent of the sanitary sewer collection system has been televised. The garage department had some personnel changes due to retirement. This division writes all of tb,- epecifunatinnc for new equipment Ms. Little noted that there have been changes at SWALCO regarding electronics recycling collection. As a result so the Village is not hosting collection events at this time, but there is a drop off location available in Highland Park on Half Day Road. Mayor Rosenthal thanked the department for all their hard work. MINUTES OF PREVIOUS MEETING Trustee Benton moved to approve the minutes from the January 5, 2015, Board of Trustees meeting. Trustee Farkas seconded the motion. The motion passed unanimously on a voice vote. BILLS AND PAYROLL Trustee Seiden moved to approve the bills and payroll dated January 20, 2015. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Farkas, Jester, Nadler, Seiden, Struthers (6) NAYS: None (0) PUBLIC COMMENT There was no Public Comment on non -agenda items. REPORTS REPORT AND RECOMMENDATION Mr. Street reported the Board of Zoning Appeals OF THE BOARD OF ZONING APPEALS held a Public Hearing on November 18, 2014, to RE: REQUEST FOR A VARIATION consider a variation from the Zoning Ordinance to FROM THE ZONING ORDINANCE AT permit demolition of an existing detached structure 1152 CHESTNUT AVENUE FOR RELIEF and reconstruction of the structure covering more FROM REAR YARD COVERAGE than 30 percent of the required rear yard with a side MAXIMUM AND SIDE YARD yard setback of 3.18 feet in lieu of the minimum 5 SETBACK FOR AN ACCESSORY feet. The Board of Zoning Appeals voted 3-1 on STRUCTURE motion to recommend granting the variation as presented. In absence of four concurring votes, the motion failed. Mr. Coblentz noted the Village Board can pass the variance if two-thirds of the Trustees vote in favor due to the non -favorable recommendation. Board of Trustees Meeting January 20, 2015 Page 3 of 6 Trustee Struthers inquired if there was going to be a difference in the light in the garden area. BZA Chairman Bob Speckmann asked for a light study because of the neighbor's garden. The studies show the proposed new garage would cast less of a shadow on the neighbor's garden. Mayor Rosenthal stated the lot is already non -conforming. Chairman Speckmann noted the petitioner wants to tear down the existing garage and put up a new garage in the same footprint, adding two feet. Trustee Seiden noted that the neighbor had provided the Village Board with a study showing there will be an adverse impact on their garden. Henry Siudyla, 1156 Chestnut, had a retired civil engineer perform a field study and measured a similar garage to determine the numbers. Pam Siudyla, 1156 Chestnut, said their findings show some loss of light everyday through the growing season due to the additional shade caused by the north wall and gutter of the proposed structure. Mayor Rosenthal questioned whether moving the structure five inches would make a difference. Mr. Siudyla noted they have a late season garden and the proposed structure would stunt the plant growth. Andrew Venamore, 225 Oakmont Drive, urban planner and zoning specialist, represented the property owner Carol Smith. Mr. Venamore noted the sun study in the packet was done by an architect. The critical element is the gutter line. They are shifting the garage from a 3.18' to 3.5' setback. By shifting the structure over, they are picking up more light, which would benefit the neighbor. Because the gutter line is making a difference, moving the structure by 3+ inches to the south would make it better for the neighbors. Trustee Farkas asked if removing the gutter would address the neighbor's concern. Mr. Venamore believes removing the gutter would make the sidewalk ice up in the winter. Trustee Jester noted the plan is showing that the existing gutter is closer to the north than the new gutter and is creating more shade. Mr. Siudyla stated the new gutter will be three inches higher than the existing gutter. Trustee Benton asked if it would be possible to reduce where the gutter is to augment the sun. Trustee Struthers asked if the garage could be lowered. Mr. Siudyla stated the study was done as low as 7.5 feet and they would still lose some light on their garden. Mayor Rosenthal suggested sending the petition back to the Board of Zoning Appeals and letting the full complement of the Board of Zoning Appeals review the matter. She also noted that a new shade study was submitted to the Board tonight, which the BZA has not had a chance to review. Trustee Farkas moved to send back the petition back to the Board of Zoning Appeals. Trustee Benton seconded the motion. The Trustees did not feel compelled to waive the First Reading of the Ordinance as they want to approve the ordinance authorizing nails salons as a special use in the C-2 District before approving another Board of Trustees Meeting January 20, 2015 Page 5 of 6 nail salon slated for that district. Mayor Rosenthal indicated this would stand as the First Reading of the Ordinance. NEW BUSINESS RESOLUTION R-15-01 AUTHORIZING Finance Director Eric Burk reports the Village CONTINUED PARTICIPATION IN THE has been a member of NIMEC since 2008 to lock NORTHERN ILLINOIS MUNICIPAL in their fixed rate for electricity purchases. It was very nice. LAKE COUNTY LEADERSHIP Mayor Rosenthal and Mr. Street attended the Lake County leadership meeting. They broke out in small groups to determine the issues important to municipalities that should be perused. 60a' ANNIVERSARY Mayor Rosenthal congratulated Frost CPA firm on their 60th anniversary. COMMUNITY, THE ANTI-DRUG Mayor Rosenthal and Mr. Street attended meetings for the new initiative. They are trying to appeal to a broader community group than parents. ADJOURNMENT There being no further business or discussion, Trustee Benton moved to adjourn the meeting. Trustee Seiden seconded the motion. The motion passed unanimously.
