ORDINANCE NO. 2018- 0-18-34
AN ORDINANCE REZONING THE LOTS AT 658, 662, AND 702 ELM STREET TO
THE R-5 GENERAL RESIDENCE DISTRICT
WHEREAS, 1219 Partners, LLC ("Developer's desires to construct seven
townhomes ("Development's on the parcel of property consisting of three lots of record
commonly known as 658, 662, and 702 Elm Street, in Deerfield, Illinois, and legally
described in Exhibit A attached hereto (collectively, the "Property'; and
WHEREAS, the Property is currently located in the R-4 Single and Two -Family
Residence District ("R-4 District'; and
WHEREAS, in order to construct the Development, Developer filed an application
with the Village seeking approval of, among other things, a special use permit for a planned
residential development and the rezoning of the Property ("Proposed Rezoning' to the R-
5 General Residence District ("R-5 District'); and
WHEREAS, a public hearing by the Plan Commission to consider an amendment of
the Zoning District Map of the Village of Deerfield, Lake and Cook Counties, Illinois
("Zoning Map's to rezone the Property in accordance with the Proposed Rezoning was
duly advertised in the Deerfield Review on May 3, 2018, and was held on May 24, 2018; and
WHEREAS, on May 24, 2018, the Plan Commission approved findings of fact in
support of the Proposed Rezoning, in accordance with and pursuant to Section 13.10 of the
Zoning Ordinance voted to recommend approval of the Proposed Rezoning by the Village
Board; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interest of the Village to rezone the Property in accordance with the Proposed Rezoning, as
set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: ZONING MAP AMENDMENT. The Zoning Map is hereby
amended to rezone 658, 662, and 702 Elm Street from the R-4 District to the R-5 District,
all in accordance with, and pursuant to, Section 13.10 of the Zoning Ordinance and the
home rule powers of the City.
SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
