06/16/2014June 16, 2014 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Rosenthal in the Council Chambers of the Village Hall on June 16, 2014 at 7:30 p.m. The Clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Robert Benton Alan Farkas Thomas Jester Robert Nadler William Seiden Barbara Struthers and that a quorum was present and in attendance. Also present were Village Attorney Peter Coblentz and Kent Street, Village Manager. PLEDGE OF ALLEGIANCE MANPOWER APPOINTMENT Review Commission. Mayor Rosenthal led those in attendance in reciting the Pledge of Allegiance. The Manpower Commission recommended the Mayor appoint Elizabeth Low to the Appearance Trustee Farkas moved to accept the appointment. Trustee Struthers seconded the motion. The motion passed unanimously on a voice vote. MINUTES OF PREVIOUS MEETING Trustee Farkas moved approval of the minutes from the June 2, 2014, Board of Trustees meeting. Trustee Benton seconded the motion. The motion passed unanimously on a voice vote. BILLS AND PAYROLL Trustee Seiden moved approval of the Bills and Payroll dated June 16, 2014. Trustee Struthers seconded the motion. WITH CRYSTAL MAINTENANCE SERVICES CORP. RESOLUTION R-14-06 FOR THE Resolution for the Village of Deerfield to opt -out of VILLAGE OF DEERFIELD TO OPT -OUT inclusion in the Cook County CDBG Urban County OF INCLUSION IN THE COOK Program for Federal fiscal years 2015 through COUNTY CDBG URBAN COUNTY 2017. PROGRAM FOR FEDERAL FISCAL YEARS 2015 THROUGH 2017 RESOLUTION AUTHORIZING A Mr. Street indicated this item was removed from the SETTLEMENT AGREEMENT FOR agenda and would be considered at a future Board LAWSUIT KNOWN AS DEERFIELD of Trustees meeting VS. RICHMOND Trustee Farkas moved to accept the Consent Agenda. Trustee Seiden seconded the motion. The motion passed by the following vote: AYES: Benton, Farkas, Jester, Nadler, Seiden, Struthers (6) NAYS: None (0) OLD BUSINESS ORDINANCE FOR A TEXT AMENDMENT TO THE ZONING ORDINANCE TO CREATE SIGN REGULATIONS FOR A RESTAURANT DRIVE-THRU MENU BOARD SIGN — DUNKIN DONUTS AND BASKIN ROBBINS AT 499 LAKE COOK ROAD An Ordinance for a Text Amendment to the Zoning Ordinance to create sign regulations for a restaurant drive-thru menu board sign for Dunkin Donuts and Baskin Robbins at 499 Lake Cook Road. Fist Reading. Mayor Rosenthal indicated this would stand as a First Reading of the Ordinance. NEW BUSINESS APPEAL OF THE APPERANCE Proposal to appeal the Appearance Review REVIEW COMMISSION'S DECISION Commission's decision to deny the proposed signs TO DENY PROPOSED SIGNS FOR CD for CD One Price Cleaners at 190 Waukegan Road. ONE PRICE CLEANERS, 190 Board of Trustees meeting June 16, 2014 Page 3 of 6 WAUKEGAN ROAD The Appearance Review Commission held a workshop meeting on April 28, 2014, to consider the petitioner's request. They found the construction of the wall sign logos were not in keeping with the Deerfield Zoning Ordinance. They also felt the signs did not have continuity. The Appearance Review Commission voted 6-0 to deny the proposed signage. The Appearance Review Commission along with John Streetz from Doyle Signs discussed alternate signs that were more consistent with other signs in the Village. The commissioners voted 5-1 in favor of the alternate signs. Franchise owners Satish Vayuvegela and Cynthia Brooks stated they committed to the Village. They signed a ten year lease and want to be an active part of the community. Mr. Vayuvegela noted the signage is very important to them for brand recognition and to help their business grow. He asked the Board to allow their corporate branding to be maintained. John Streetz with Doyle Signs has worked with CD One Price Cleaners for many years. The original proposal had a back -lit logo with blue halo lighting from behind as well as individually illuminated channel letters. The proposal was within the branding guidelines of CD One Price; however, the Appearance Review Commission felt the logo was 3-dimensional. Mr. Streetz does not agree the silhouette logo is 3-dimensional. The request was amended at the Appearance Review Commission meeting to get an approval. CD One -Price would like their original proposal with the corporate branding approved. Mr. Streetz noted that the logo was reduced slightly in height to be the same height as the stacked letters in the approved signage. The letter size was reduced from 4 inches to 3.55 inches in height. The individual letters are 1.575 inches in the fust line and 1.65 inches in the second line. Village Planner Jean Spagnoli noted the Appearance Review Commission found the proposed sign was inconsistent with the Deerfield Zoning Ordinance. According to the Zoning Ordinance, a sign face comprised of more than one element or signage panel must be located within the same plane. Typically, this type of sign does not have two different light sources for a non- anchor tenant. In Palatine, the CD One Price cleaner sign shows what the Appearance Review Commission approved. In addition, the proposed monument sign is supposed to have a white background for non -anchor tenants. Mayor Rosenthal noted the Appearance Review Commission is good at what they do. The proposed changes comply with the Village's criteria and she does not feel it would harm the petitioner's business. Mayor Rosenthal thinks the Commission's objections are valid and reasonable. Trustee Nadler noted the monument sign already has a green panel. Mrs. Spagnoli stated the anchor tenant is allowed a color but the other tenants must have a white background. Trustee Jester noted the primary signage is a Zoning issue that would require a Public Hearing to change. It is straight forward and consistent. Trustee Jester stated other monument signs in the Village have different color backgrounds. This monument sign has one panel with a green background. Board of Trustees meeting June 16, 2014 Page 4 of 6 If the Panera green panel had a white background, he would be okay with all the panel backgrounds being white. Ms. Spagnoli noted the anchor tenant is allowed to have color in Cadwell's Comers. Trustee Struthers thinks the sign will look better with a white background. Trustee Benton indicated he wants CD One Price Cleaners in the Village but believes they need to accommodate the Village. Trustee Seiden does not believe having both a blue background panel and a green background panel would look good. Trustee Struthers moved to uphold the Appearance Review Commission's recommendation regarding the lighting and wall sign for CD One Price Cleaners. Trustee Nadler seconded the motion. The motion passed by the following vote: AYES: Benton, Farkas, Jester, Nadler, Seiden, Struthers (6) NAYS: None (0) Trustee Seiden moved to uphold the Appearance Review Commission's recommendation regarding the monument sign. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Seiden, Struthers, Rosenthal (4) NAYS: Farkas, Jester, Nadler RESOLUTION R-14-07 AUTHORIZING THE EXECUTION OF A LAW ENFORCEMENT MUTUAL AID AGREEMENT AND THE EXISTENCE AND FORMATION OF THE ILLINOIS LAW ENFORCEMENT ALARM SYSTEM BY INTERGOVERNMENTAL A Resolution authorizing the execution of a law enforcement mutual aid agreement and the existence and formation of the Illinois Law Enforcement alarm system by Intergovernmental Corporation. Chief Sliozis noted Deerfield has been a CORPORATION member of ILEAS since 2003. ILEAS consists of 900 members. This agreement provides legal authority to be a member. This request has been reviewed by Village counsel and gives the Village access to 900 other law enforcement agencies. Trustee Jester moved approval of the Resolution. Trustee Struthers seconded the motion. Trustee Struthers questioned whether the Village must pay to employ ILEAS support personnel. Chief Sliozis stated membership costs $200 per year. The only additional cost is if Village personnel were called to assist another agency. The motion passed by the following vote: AYES: Benton, Farkas, Jester, Nadler, Seiden, Struthers (6) NAYS: None (0) FARMER'S MARKET Trustee Jester reported this Saturday was the first Board of Trustees meeting June 16, 2014 Page 5 of 6 Farmer's Market of their 20a' year. The turnout was great. Trustee Jester encouraged everyone to attend. MONARCH BUTTERFLIES Trustee Jester indicated monarch butterflies are declining. The Chicago Tribune had an article on May 31, 2014, about milk weed and how it benefits the monarch population He encouraged the Village and Park District to look for any opportunity to put milk weed on public property. MOSQUITO SEASON Trustee Struthers noted mosquito season has begun. She encouraged residents to protect themselves. The South Lake Mosquito Abatement District has information available at its website. TRUSTEE IN THE TOWN Trustee Seiden noted that Mayor Rosenthal and Trustee Nadler will be available to answer questions this Saturday from 9 a.m. to noon at the Farmer's Market. STREETSCAPE TREES Trustee Benton reported the Public Works Department was working on streetscape trees over the weekend. Director of Public Works and Engineering, Barbara Little stated the department removed streetscape trees and will get them replaced as quickly as possible. RELAY FOR LIFE Mayor Rosenthal indicated the Relay for Life took place on June 7, 2014, and June 8, 2014, at the Highland Park Recreation Center. It was a nice evening that raised a lot of money for the American Cancer Society. There were a number of survivors present that were celebrating life. COOK OFF The Deerfield Police Department and the Deerfield - Bannockburn Fire Protection District held their annual cook off in front of Whole Foods. The police department won for the fourth year in a row. FRESH THYME OPENING Fresh Thyme will open on June 25 at 6:45 a.m. The ribbon cutting will take place at 9:00 a.m. GROUND BREAKING Deerfield High School will hold a ground breaking ceremony at 11:00 a.m. on June 30, 2014. FAMILY DAYS Family Days is coming. The fireworks will be held on July 3, 2014. The parade and rotary race will take place on July 4, 2014, as well as a whole day of festivities at Jewett Park. Mayor Rosenthal thanked the Family Days Commission for their hard work. ADJOURNMENT There being no further business or discussion, Trustee Farkas moved to adjourn the meeting.
