05/05/2014May 5, 2014 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Rosenthal in the Council Chambers of the Village Hall on May 5, 2014 at 7:30 p.m. The Clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Robert Benton Thomas Jester Robert Nadler William Seiden Barbara Struthers Absent was: Alan Farkas and that a quorum was present and in attendance. Also present were Village Attorney Peter Coblentz and Kent Street, Village Manager. PLEDGE OF ALLEGIANCE MOMENT OF SILENCE who recently passed away. Plan Commission member Alan Bromberg led those in attendance in reciting the Pledge of Allegiance. Those in attendance observed a moment of silence in memory of Public Works employee Pete Rossi, 25 YEARS OF SERVICE Mayor Rosenthal honored Officer Geoffrey Ruther for 25 years of service at the Village of Deerfield Police Department. Officer Ruther is currently the senior field training officer responsible for training new police officers and an operator and trainer for the department's project lifesaver program. Officer Ruther has been' recognized on several occasions for going above and beyond expectations. Officer Ruther thanked the Village and the department for their support and recognition. PRESENTATION OF GFOA Mayor Rosenthal presented a certificate from the CERTIFICATE OF ACHIEVEMENT Government Finance Officers Association for FOR EXCELLENCE IN FINANCIAL excellence in financial reporting to Finance Director REPORTING Eric Burk. This is the 30 year the Village has received this award. TREASURER'S REPORT Mr. Burk presented highlights from the Treasurer's Report for March 2014, representing 25 percent of the fiscal year. Sales tax net of the rebate increased and is within $7,000 of the same period last year. The water and sewer revenues are consistent with expectations for this period. The Village received some of the Cook County property tax in March. The larger portion from Lake County Board of Trustees Meeting May 5, 2014 Page 2 of 6 will be received in June and September. Building permits are still doing well. Operating expenditures are consistent with projections at this point. MINUTES OF PREVIOUS MEETING Trustee Struthers moved to approve the minutes from the April 21, 2014, Board of Trustees meeting. Trustee Benton seconded the motion. The motion passed unanimously as amended. BILLS AND PAYROLL Trustee Benton moved approval of the Bills and Payroll dated May 5, 2014. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Nadler, Seiden, Struthers (5) NAYS: None (0) PUBLIC COMMENT There was no public comment on non -agenda items REPORTS REPORT AND RECOMMENDATION Mr. Street reported the Plan Commission held a OF THE PLAN COMMISSION RE: Public Hearing on April 10, 2014, to consider the REQUEST FOR A TEXT AMENDMENT request for the establishment of a nail salon at 810 AND A SPECIAL USE TO PERMIT Waukegan Road, in the C -I Village Center district. THE ESTABLISHMENT OF A NAIL The proposed area has 1380 square feet and would SALON TO BE LOCATED AT 810 serve 50 patrons daily and would have seven full- WAUKEGAN ROAD time and three part-time employees with no more nine employees present at one time. The Plan Commission voted 4-0 in favor of the request. Trustee Struthers noted the Plan Commission did not request a parking study. She believes a quarter of the public parking would be taken by this use, with the number of employees and patrons served each day. Trustee Struthers indicated there is no retail component in this business. Mr. Bromberg stated there is no indication of a nail salon requiring more spaces than what is required based on the size of the space. The petitioner indicated the employees would not be parking onsite. Instead, they would be bussed or driven to work. He also explained their customers frequently drive together. Mayor Rosenthal does not believe Deerfield residents would drive together. Trustee Struthers added that the parking usage would be greater than the petitioner has anticipated. Trustee Nadler questioned how long the space has been vacant. Property owner Joy Fiorini stated the property has been vacant for seven years. Trustee Nadler noted this is a difficult retail location because it is a small store with limited frontage and no front parking. He would like to see the space occupied. Trustee Struthers noted the business the petitioner manages in a different community advertises BYOB on their website. She cautioned the petitioner that they do not have a liquor license. Trustee Seiden suggested Ms. Fiorini consider getting rid of the alley behind her property. He Board of Trustees Meeting May 5, 2014 Page 3 of 6 said it would provide a better drop off for Kevin's Place deliveries as well as additional parking for Deerfield shoppers. Mayor Rosenthal noted staff would set up a meeting with Ms. Fiorini. Mr. Street noted the meeting would be a follow up from the Northwest Quadrant Task Force. He believes it is premature to put a requirement on this petition. Trustee Benton noted the Village does not have cooperation from the property owner to the south. Mr. Street indicated Ms. Fiorini owns the property in question. Trustee Jester believes the Plan Commission has made the point that there is no increment for a parking demand on this property. Anna Pamula, owner of Renu Day Spa, stated she does not consider this business competition for her. She noted the Village has parking requirements that her business had to follow. Ms. Pamula noted this business does not have a parking lot. There are other businesses in the area that would suffer if a quarter of the available parking in the area was taken by this business. Ms. Pamula inquired if the building has an emergency exit, which is also a Village requirement. Wendy Seldin, owner of All Polished Up, expressed concern that unless patrons enter through the back they would use the parking near her business and Deerfield Bakery and walk. Ms. Seldin noted special events held at Running Away already cut into parking near her location. Mayor Rosenthal thanked Ms. Pamula and Ms. Seldin for being Deerfield residents and having their businesses in Deerfield. She also confirmed the building does have an emergency exit. Trustee Struthers asked whether the location has proper ventilation. Ms. Fiorini indicated she had a state -of -the art air conditioner and furnace installed within the past few years. Trustee Nadler moved to accept the report and recommendation of the Plan Commission. Trustee Benton seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Nadler (3) NAYS: Seiden, Struthers (2) CONSENT AGENDA There were no items on the Consent Agenda. OLD BUSINESS ORDINANCE 0-14-08 AMENDING THE An Ordinance amending the Municipal Code of the MUNICIPAL CODE OF THE VILLAGE Village of Deerfield to increase the number of Class OF DEERFIELD TO INCREASE THE B liquor licenses from 1 to 2. Second Reading. NUMBER OF CLASS B LIQUOR Dave Bernier, Vice President of Fresh Thyme, LICENSES FROM 1 TO 2 — 2R noted all of their staff would go through Board of Trustees Meering May 5, 2014 Page 4 of 6 BASSET training. They are on schedule to open on June 25, 2014. Mr. Street indicated there was nothing in the petitioner's background that would prevent them from getting a liquor license. Trustee Seiden moved to adopt the Ordinance. Trustee Nadler seconded the motion. AUTHORIZATION TO PURCHASE Director of Public Works and Engineering Barbara BULK ROCK SALT FROM NORTH Little reported the Village is out of salt and wants AMERICAN SALT THROUGH THE to replenish the supply before the winter. The low LAKE COUNTY DIVISION OF bidder was North American Salt through the Lake TRANSPORTATION (NTE $102,660) County Division of Transportation. Trustee Seiden moved to purchase bulk salt from North American Salt through the Lake County Division of Transportation in an amount not to exceed $102,660. Trustee Struthers seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Nadler, Seiden, Struthers (5) NAYS: None (0) AUTHORIZATION TO AWARD THE Assistant Director of Public Works and Engineering CONTRACT FOR DEER RUN Bob Phillips noted that the Village has been dealing SUBDIVISION DRAINAGE with drainage issues in Deer Run. There are 14 IMPROVEMENTS TO MANEVAL acres of the Briarwood Country Club that drain CONSTRUCTION (NTE $61,381.20) onto Oakmont. A Village drainage study showed the subdivision's drainage system was only designed to handle the subdivision's drainage and did not account for the drainage from Briarwood Country Club. The Village worked with Briarwood Country Club and residents on a design plan that would include a large berm on the Briarwood Country Club and an overflow area. The original scope of work also included regrading, but that was removed from scope. The Village received five competitive bids. The lowest bid came from Maneval Construction in an amount not to exceed $61,381.20. Board of Trustees Meeting May 5, 2014 Page 5 of 6 Trustee Struthers asked what has caused the flooding. Mr. Phillips stated there have been drainage complaints as long as he has been with the Village. There has been flooding over the past few years. Trustee Nadler asked whether this would solve the issues. Mr. Phillips believes this would be a significant improvement. Sharon Fellers, 280 Oakmont, has been a Deerfield resident since 1970. She does not want her property altered whatsoever. Ms. Fellers indicated her property has never flooded. Mr. Phillips noted the scope of work was modified and the Fellers' property would not be altered. Trustee Struthers moved to award the contract for Deer Run subdivision drainage improvements to Maneval Construction in an amount not to exceed $61,381.20. Trustee Nadler seconded the motion. Trustee Struthers believes this will attract new people into the Village. MEDICAL MARIJUANA SEMINAR Mayor Rosenthal thanked Trustee Seiden for attending the medical marijuana seminar. LAKE COUNTY VISITORS BUREAU Mayor Rosenthal and Mr. Street met with the Lake County Visitors Bureau. They are helping fill Deerfield hotels over the weekends. PIONEER PRESS Mayor Rosenthal and Mr. Street met with the editor of the Pioneer Press. He wanted to know what they could do better for the Village. Mayor Rosenthal encouraged them to provide as much Deerfield related news as possible. ADJOURNMENT There being no further business or discussion, Trustee Benton moved to adjourn the meeting.
