ORDINANCE NO. 0-18-03
AN ORDINANCE APPROVING A REVISED PLAT OF SUBDIVISION OF THE
PROPERTY AT 755 SUMMIT DRIVE
WHEREAS, the owner of the property (the "Applicant") commonly known as 755 Summit
Drive (the "Subject Property") has applied for a Revised Plat of Subdivision of the Subject
Property to vacate the existing front north building line and re-establish itjust north of the northern
extent of the existing building on the Subject Property as legally described and set forth in
Applicant's proposed Plat of Amendment attached hereto as Exhibit A and incorporated herein
(the `Revised Plat of Subdivision"); and,
WHEREAS, Applicant presented written waivers from all of the property owners in the
Nathan's Subdivision consenting to the vacation of the building line as it affects the Subject
Property; and,
WHEREAS, on December 14, 2017 and January 11, 2018, the Plan Commission of the
Village of Deerfield held public hearings to consider the Revised Plat of Subdivision of the Subject
Property, said hearings being held pursuant to public notice and conforming in all respects, in both
manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission, after considering the Revised Plat of Subdivision of
the Subject Property and the evidence and supporting materials offered at said public hearings,
filed its report with the President and Board of Trustees containing its written findings of fact and
recommendation to approve the Revised Plat of Subdivision of the Subject Property; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concurred in
the findings and recommendation of the Plan Commission and determined that the approval of the
Revised Plat of Subdivision is in the best interests of the Village of Deerfield;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: The recitals to this Ordinance are incorporated into and made a part of this
Ordinance as if fully set forth herein.
SECTION 2: The corporate authorities of the Village of Deerfield approve the Revised
Plat of Subdivision of the Subject Property attached hereto as Exhibit A and incorporated herein.
SECTION 3: The President and Village Clerk of the Village of Deerfield are authorized
and directed to execute and deliver the Revised Plat of Subdivision of the Subject Property on
behalf of the Village of Deerfield.
SECTION 4: The Village Clerk is authorized and directed to cause the Revised Plat of
Subdivision of the Subject Property to be recorded, at the Applicant's expense, in the office of the
Lake County Recorder of Deeds.
SECTION 5: This Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non -preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.

SECTION 6: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
