AN ORDINANCE AMENDING SECTION 6-7 OF CHAPTER 6 (BUILDING)
OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD TO
PROVIDE FOR REDUCTIONS IN VARIOUS PERMIT FEES CHARGED TO A NON-
PROFIT CORPORATION FOR CONSTRUCTION OF A BUILDING TO BE
OPERATED FOR A MINIMUM OF TEN YEARS AS A KEY COMPONENT OF A
CONTINUING CARE RETIREMENT COMMUNITY
WHEREAS, Section 6-7 of the Municipal Code of the Village of Deerfield provides for the
waiver of certain permit fees that would otherwise be charged for the issuance of permits for the
construction of public or parochial schools, or buildings used by a township, county, library, park
district or other local taxing body, or for buildings used for a church or other religious purpose, or
any governmentally assisted senior citizen housing project; and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that the
fee schedule for construction of such school buildings, township, county, library, park district or
other taxing body buildings, and any governmentally assisted senior citizen housing project, as that
term is defined in the Zoning Ordinance of the Village of Deerfield, shall be charged on a reduced
fee schedule in lieu of the fees otherwise set forth in the Comprehensive Building Fee Schedule in
Section 6-79 of Article I of Chapter 6 ("Building") of the Municipal Code of the Village of
Deerfield;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That Section 6-7 (Public Buildings; Permit Fees; Exemption; Charges) of
Article I of Chapter 6 ("Building") of the Deerfield Municipal Code be, and the same is hereby
amended to read as follows:
Sec. 6-7. Public Buildings; Permit Fees; Exemption; Charges.
Except as otherwise provided herein or in a Development Agreement applicable to a
building described herein, no building, plumbing or miscellaneous permit fees shall
be charged for the issuance of permits for the construction of any public or parochial
school, or any building used by a township, county, library, park district of any other
taxing body, any church or building used for religious purposes or any
governmentally assisted senior citizen housing project as that term is defined in the
zoning ordinance. In lieu of the fees set forth in this chapter, any permit applicant of
sixty five years of age or more shall pay a fee of one dollar ($1.00) in the event the
project does not exceed ten thousand dollars ($10,000.00). In lieu of the fees set
forth in this chapter, the fee schedule shall be reduced by fifty percent (50010) for
permits issued for construction of any building owned by a non-profit corporation
and used for a continuing care retirement community as that term is defined in the
zoning ordinance. In lieu of the fees set forth in this chapter, the fee schedule shall
be reduced by twenty-five percent (251/) for permits issued for construction of any
building that is to be operated by a non-profit corporation for a minimum of ten 0 0)
years from the permit issuance date and used for an independent living facility and a
key component of a continuing care retirement community as that term is defined in
the zoning ordinance. Except as modified hereby, the fee schedule contained in this
chapter shall remain in force and effect. The applicant for such permit shall pay the
village for meters, materials and labor furnished by the village in connection with the
issuance of such permits.
No building, plumbing or miscellaneous permit fees shall be charged for the issuance
of permits for the construction of any public or parochial school, or any building
used by a township, county, library, park district of any other taxing body, any
church or building used for religious purposes or any governmentally assisted senior
citizen housing project as that term is defined in the zoning ordinance. (a) In lieu of
the fees set forth in this chapter, any permit applicant of sixty five years of age or
more shall pay a fee of one dollar ($1.00) in the event the project does not exceed ten
thousand dollars ($10,000.00). (b) In lieu of the fees set forth in this chapter, the fee
schedule shall be reduced by fifty percent (50%) for permits issued for construction
of any building owned by a non-profit corporation and used for a continuing care
retirement community as that term is defined in the zoning ordinance. (c) In lieu of
the fees set forth in this chapter, the fee schedule shall be reduced by twenty-five
percent (25%) for permits issued for construction of any building that is to be

operated by a non-profit corporation for a minimum of ten (10) years from the permit
issuance date and used for an independent livingfacility and a key component of a
continuing care retirement community as that term is defined in the zoning
ordinance. Except as modified hereby, the fee schedule contained in this chapter
shall remain in force and effect.
The applicant for any such permit shall pay the village for meters, materials and
labor furnished by the village in connection with the issuance of such permits.
SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non -preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 3: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
