AN ORDINANCE APPROVING AN AMENDMENT TO THE
DEERFIELD SQUARE COMMERCIAL PLANNED UNIT DEVELOPMENT
TO THE PREVIOUSLY APPROVED REDEVELOPMENT PLANS OF THE
711 DEERFIELD ROAD BUILDING WITH A NEW MULTI -TENANT BUILDING
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
September 14, 2017 on the application of CRM Properties Group, Limited (the "Applicant'), being
the owner of the property commonly known as the Deerfield Square Shopping Center and legally
described on Exhibit A attached hereto, for approval of an amendment to the redevelopment plans
previously approved by the President and Board of Trustees of the Village of Deerfield on
December 19, 2016 to the Deerfield Square Commercial Planned Unit Development (the
"Deerfield Square PUD") in the C-1 Village Center Zoning District of the 711 Deerfield Road
building (the "Subject Property) to permit: (1) reducing the overall building area allowing for
additional outdoor seating from 10,300 square feet to 9,600 square feet; (2) converting the
previously approved glass enclosure on the west side of the building to an exterior patio; (3)
changing the previously approved double gabled roof at the middle of the building to a single
gabled roof; (4) modifying storefront entrance door locations and revising overall building
elevations; (5) relocating the trash enclosure to a new location west of the building; (6) re-routing
the pedestrian crosswalk located at the western end of the building to the south; (7) changing
landscape to the west landscaped island; and (8) adding additional landscaping along the southern
and western elevations (collectively referred hereto as the "Amended Redevelopment Plans"), all
as provided herein and in substantial conformance with the plans and supporting materials
submitted by the Applicant, which are attached hereto as Exhibit B, incorporated herein, and made
a part of this Ordinance by reference; and
WHEREAS, said public hearing was held pursuant to public notice duly given and
published as required by statute and conforming in all respects, in both manner and form, with the
Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
evidence, testimony and supporting materials offered at said public hearing, filed its report with
the President and Board of Trustees containing its written findings of fact and recommendation
that the proposed amendment to the Deerfield Square PUD to authorize the Amended
Redevelopment Plans for the Subject Property, be authorized and approved as an amendment to
the Deerfield Square PUD pursuant to Article 5.01-C, Paragraph 2, Subparagraph i, Article 12.09-
G, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the proposed amendment to the Deerfield Square PUD to authorize the Amended
Redevelopment Plans fully complies with the requirements and standards set forth in Article 5.01-
C, Paragraph 2, Subparagraph i, Article 12.09-G and Article 13.11 of the Zoning Ordinance of the
Village of Deerfield; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined and find that the best interests of the Village will be served by the authorization and
approval of said amendment to the Deerfield Square Planned Unit Development to authorize and
permit the Amended Redevelopment Plans, all as provided herein and in substantial conformance
with the plans and supporting materials submitted by the Applicant, which are hereby incorporated
and made a part of this Ordinance;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are
hereby incorporated and made a part of this Ordinance as if fully set forth herein.
SECTION 2: That the President and Board of Trustees do hereby affirmatively find that
the PUD Amendment as described herein fully complies with the requirements and standards set
forth in Article 5.01-C, Paragraph 2, Subparagraph i, Article 12.09-G and Article 13.11 of the
Zoning Ordinance of the Village of Deerfield.
SECTION 3: That the President and Board of Trustees do hereby authorize and approve
an amendment to the Deerfield Square PUD to permit the Amended Redevelopment Plans, all as
more fully described on Exhibit B attached hereto, but not including the plans revising the
previously approved sign criteria to allow a roof top sign no larger than 24 inches in height only
on the east glass enclosure, subject to the further conditions, regulations and restrictions set forth
in Section 4 of this Ordinance.
SECTION 4: That this amendment to the Deerfield Square PUD is granted subject to the
following conditions, regulations and restrictions: (i) the Subject Property shall be redeveloped,
constructed, maintained and used in accordance with the plans and supporting materials attached
hereto and made a part of this Ordinance as Exhibit B hereof, except for the plans revising the
previously approved sign criteria to allow a roof top sign no larger than 24 inches in height only
on the east glass enclosure; (ii) compliance by the Applicant with all representations made and
submitted by the Applicant to the Plan Commission and to the President and Board of Trustees of
the Village of Deerfield; (iii) compliance by the Applicant with the recommendations of the

Appearance Review Commission, except for the recommendations disapproving of the white
painted brick walls (Bartaco) and lack of an articulated fagade (Bartaco); (iv) compliance by the
Applicant with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield;
and (v) compliance by the Applicant with all other applicable provisions ofthe Municipal Code of
the Village of Deerfield.
SECTION 5: That the PUD Amendment described herein, and hereby authorized as an
amendment to the Deerfield Square Special Use Commercial Square Planned Unit Development
in the C-1 Village Center District, shall be binding upon and inure to the benefit of the Applicant
and Applicant's successors, grantees, transferees and assigns, and any violation of this Ordinance
or the conditions, regulations and restrictions set forth herein by the Applicant or its successors,
grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby
authorized.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non -preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
