O-65-42F� ORDINANCE NO. 0 -65 -42 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 964 WAUKEGAN ROAD, DEERFIELD WHEREAS, the Estate of John L. Vetter, through its attorneys, Ross b Stern, has petitioned for a "variation from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit the construction, on certain property owned by the Estate, the legal description of which is hereafter set forth, of a building or buildings for use as multiple family dwelling units requiring only 1500 square feet of lot area for each such dwelling unit; and WHEREAS, pursuant to notice duly published as required'by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has.filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals is hereby concurred in and adopted -bs the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular TWO: hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to the petitioner's property which is legally described as follows: That part of the West 1/2 of the Southwest 1:/4 of Section 28, Township 43 North, Range '12, East of the Third Principal Meridian, described as follows: Commencing on the West line of said 1/2, 1/4 Section at a point 1199.2 feet North of the Southwest corner thereof; thence North along the Section line, 92.2 feet; thence in a Northeasterly direction (along the Southerly line of Hazel Avenue), 145.6 feet to the center of Lincoln Avenue; thence in a Southeasterly direction along the center line of said Avenue 138.3 feet; thence Westerly 198 feet to the place of beginning, in Lake County, Illinois (commonly known as 964 WaukegannRoad, Deerfield, Illinois). SECTION That a variation trom the strict provisions of Section THREE: XII.D.5.e of Tne Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, witn respect to the property hereinabove described is hereby granted so as to authorize the construction on said property or a bui;fding containing up to but not more than seven (7) multiple family dwelling units, subject to the conditions hereinafter set forth. SECTIJON That the variation hereby granted is subject to the FOUR: condition that no structure or' portion thereof be erected on the Westerly 30 feet of said property and that no parking of automobiles or other vehicles be" permitted on said Westerly 30 feet and that the prohibition of such use of such Westerly 30 feet'be evidenced by a duly recorded covenant running with the land approved by the Village Attorney;'said variation is subject to the further condition that there be compliance by the petitioner with all other applicable ordiinances of the Village. SECTION That this ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law. H.
