O-63-22ORDINANCE NO. 0 -63 -22 AMENDMENT TO ZONING ORDINANCE Whereas the question of making the following amendment to the Zoning Ordinance of the Village of Deerfield has been referred to the Plan Commission for a public hearing, and the Plan Commission has held such public hearing after due notice as required'by law: Now, Therefore Be It Ordained by the,President and Board of Trustees of the Village of Deerfield that the Ordinance for the Comprehensive Amendment of the •zoning Ordinance, enacted May 4, 1953, is hereby amended by amending Section XI11 as follows: Section XIII - 118-1" Neighborhood Business District In any "B -1" Neighborhood Business Zone, the following regulations shall apply: A. • Uses permitted in the "B -1" District are subject to the following conditions: 1. Dwelling units and lodging rooms - except in hotels or motels where specifically permitted as a Conditional Use- - shall not be permitted. 2. All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at reatil on the premises where produced. 3. All business, servicing, or processing -- .except for off - street parking, offstreet loading, and automobile service station operations -- shall be conducted within completely enclosed buildings. 4. Establishments of the "drive -in" type offering food products for service to or consumption by customers in automobiles or parking areas shall not be permitted. 5. The parking of trucks as an accessory use, when used in the conduct of a permitted business, shall be limited to vehicles of not over 1 -1/2 tons capacity when located within 150 feet.of a Residence District boundary line. B. Permitted Uses - No uses other then the following uses shall be permitted as the principal use of land: 1. Neighborhood retail uses as follows: Apparel Store Automobile Parking Lot, excluding commercial parking lot Automobile Service Stations Bakery, retail sales outlet Bakery, products baked on premises for retail sale on premises only Barber Shop Beauty Shop Book Store Candy Store, Confectionary, or Nut Shop Catalog Sales Office for Mail -Order Store Cleaning and Dyeing, Pick -up Store only Cleaning and Dyeing, Self - service Laundromat type Dairy Product Sales Dressmaker's Shop D rugs: S tore Florist Sales, Retail Fruit and Vegetable Market, retail Gift Shop Grocery Store or Supermarket Hardware Store, retail Hobby Shop Ice Cream Shop Laundry, Pick -up Store only Laundry, Self - service Laundromat type Laundry, hand Library, lending Magazine and News Store Meat Market, retail Pet Shop . Front Yard - Each lot shall have a front yard setback .of not less than fifty (50) feet from the street line. 2. Side Yards - a. Interior lot - Each lot not having a secondary' means of access from an alley or private drive shalV, have at least one (1) side yard of not less than twelve (12) feet in width. b. Corner lot - The width of any side yard which abuts a street sha•11 be not less than fifty (50) feet. C. Lots abutting residential zones - The width of.any side yard which abuts a residential zone shall be not less.than fifty (50) feet. 3. Rear Yard - Each lot shall have a rear yard of not less than ten (10) feet; the depth of any rear yard which abuts a street or residential zone shall be not-less than fifty (50) feet. 4. Parking Area - The parking or private automobiles shall be permitted within front, side and rear yard. areas:,, but no parking space or private access drive- way shall be closer than fifteen (15)" feet to any lot zoned for residential use, and no parking space shall be located closer than five (5) feet to any street 1 I line. On Dots adjoining a residential zoning district, no parking space shall be permitted between the street line and the building setback line requi red on the adjoining lot in the residential zone. 5: Lot Area - Any principal use, together with all accessory uses,. shall be located on a lot having a minimum area of not less than ten thousand (10,000) square feet. 6'.. Floor Area - No one use shall occupy more than twenty thousand (20,0000) square feet of floor area. 7.. Maximum Lot Coverage -_The total ground area occupied by any principal building, together with all accessory buildings, sha 1 F not exceed twenty -f i ve. (25) per cent. of the totA 1 area of the lot. . 8. Lot Width - Each lot shall have a width at the building set- back line of not less than fifty (50) feet. The packing of trucks as an accessory use, when used in the conduct of a permitted business listed hereafter, shall be limited to vehicles of not over']-1/2 tons capacity when located within one hundred fifty (150) feet of a Residence District boundary line. 6. All activities involving the production, processing, cleaning, servicing, testing or repair of materials, goods or products shall conform with the .performance standards established for the "M" Manufacturing District, provided that performance stan- dards shall in every case be.-applied at the boundaries of the zoning lot on which such activities take place. No side yards shal 1 be required except that when a building.or group of buildings abuts upon a residential district, such yard baving a width of not less than ten (10) feet: There shall be a rear yard with a depth of not less than fifteen (15) feet when abutting upon a publicly dedicated alley or public way and not less than twenty (20) feet when no dedicated alley or public way exists at the rear of the lot; the depth of any rear yard which abuts a residential district shall be not less than fifty (50) feet. 2: Parking Area - The parking or private automobiles shall be permitted within side and rear yard areas, but no parking space or• private access driveway shall be closer than fifteen (15) feet to any lot zoned for residential use. 3. Lot Area - Any principal use, toge%he,r with all accessory uses, shall be located on a lot having an area of not less than ten thousand (10,000) square feet, except that any smaller lot, duly recorded prior to the adoption of this provision, may be used for any purpose permitted- i n this sec,riion provided that all other requirements of this ordinance are observed. 4. Lot Width - Each lot shall have a width at the building set- back line of not less than fifty (50) feet. The Zoning Ordinance and Zoning Map of ,the Village of. All business establishments shall be retail or service establishments dealing directly with con - sumers. All goods produced on the premises shall be sold at retail on the premises where produced. 3. All business, servicing, or processing -- except for off - street parking, off - street loading -- auto- mobile service station operations and open sales lots where specifically permitted - -shall be con- ducted within completely enclosed buildings. Lighting- Exterior: Illumination of buildings, signs, grounds, and parlZing areas shall be subject to the following:. 5.1 No blinking or colored lights shall be used for the illumination of signs. All primary light sources illuminating the buildings shall be erected and maintained in accordance with standards of the illuminating Engineering Society and shall be so placed, designed and used that neither the direct nor reflected light therefrom will adversely affect sur- rounding property or create a traffic hazard. 5.2 Floodlighting of buildings, grounds or parking or loading areas shall be arranged so as not to direct or reflect rays of light into adjacent residential districts or into the public way. General lighting of parking or loading areas shall, except for emergency lighting, cease at or before the hour of midnight, when these areas face a residential district where the distance from the nearest light to the nearest residence is less than one thousand (1000) feet. 6. Signs: Signs shall be permitted subject to the following: 6.1 Signs may be attached to one (1) or more facades but not to or on the roof of any building, provided that the total area of such signs shall not exceed eight (8) per cent of the building .wall area to which they are attached and the tip edge,of such sign shall not project over the roof line of the building to which they are attached '/ go signs need be less than eighty (80) square Feet in size. Signs, other than directional signs, shall be limited to identifying the name of the enterprise, its merchandise or service. The provisions of any ordinance regulating the erection or maintenance of signs shall apply except as modified herein. 7. There shall be a rear yard with a depth of not less than fifteen (1,5) feet when abutting upcn a publicly dedicated alley or public way and not less than twenty (20) feet when no dedicated alley or public way exists at the r gar of the lot; the depth of any rear yard which abuts a residential district shall be not less than fifty (50) feet. R. Parking Area - The parking of private automobiles shall be permitted within side and rear yard areas, but no parking space or private access driveway shall be closer than fifteen (15) feet to any lot zoned for residential use. 3. Lot Area - Any principal use, together with all accessory uses, shall be located on a lot having an area of not less than ten thousand (10, 000) square feet, except that any smaller lot, duly recorded prior to the adoption of this provision, may be used for any purpose permitted in this section provided that all other requirements of this ordinance are observed. 4. Lot Width - Each lot shall have a width at the building setback line of not less than fifty (50) feet.
