O-58-491.0 2 ORDINANCE o -58 -49 An Ordinance.Providing for Improvement on ".= HACKBERRY LANE BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield, Illinois, that: Section 1. A local improvement shall be made in the Village of Deerfield, Lake County, Illinois, in accordance with the attached blue- prints of plans and specifications. Said improvements shall.consist of paving, grading and installing a sanitary sewer main on Hackberry Avenue between Fairview Avenue and Willow Avenue,fand on Fairview Avenue from a point 110 .Feet south of the south line of Hackberry Avenue to Hackberry Avenue; installing a water main on Hackberry Avenue between Fairview Avenue and Willow Avenue, and installing ,a storm sewer main on Hackberry Avenue between Fairview Avenue and the West Fork, North Branch of the Chicago River, togeth with house service lines for water, storm sewer and sanitary sewer, on Hackberry Avenue between Fairview and Willow. Conformance to Plans: Wherever herein in the description of the locations of this improve- ment there is'any duplication or locations, no duplication of improvement is intended, or shall be amde and the said improvement shall be constructed in a good and workmanlike manner to.conform to the plans therefor as shown on the blueprints of the plans attached hereto and made a part hereof. All materials used in the construction of this improvement not specifi- cally herein described shall be of good quality and suitable for the purpose for which they are to be used. All of the above described improvements shall be constructed under the d i rec t i'on and supervision and to the satisfaction of the Board of Local Improvements, and all the necessary .labor and work shall be performed in a good and workmanlike manner. Engineering and Inspection: For the purpose of constructing this improvement in accordance with the elevations, dimensions and positions as herein provided for, the grades and lines of construction shall be given by use of stakes and other necessary devices as the work progresses; and to protect those benefited by this improve ment from the use of improper material and poor workmanship, all material. used shall be'inspected, and all-labor performed shall:be superintended. To this end, the Board of Local improvements shall employ the necessary competent engineers, inspectors and superintendents during the construction of the work. All work in connection with'the improvements herein provided for shall be executed in a good and workmanlike manner and under the superin- tendence of the Board of Local Improvements. 1 I YUS, Section 2. That the. recommendation of the Board of Local Improvements and the estimate of the cost thereof, both hereto attached, be and the same are hereby.approved. Section 3. That sbid improvement shallrb de and the whole cost thereof, which is estimated to be $79,255.30 sli*44 be paid for by special assessment in accordance with Article 84 of C.6pter�f 24 of the Illinois Revised Statutes, as amended. An amount not exceeding six percent (6 %) of the esti.inated whole cost, to -wit: $4,755.32 is hereby provided for to apply toward the payment of all lawful costs and expenses incurred in making, levying and collecting the assessment for said improvements. Section 4. That the aggregate amount herein ordered to be assessed and each individual assessment shall be divided into ten (10) installments 9 which shall bear interest at the rate of six percent (6 0/) per annum until CT_„i paid, a-11 in the manner and in accordance with. the provisions of the afore- said Article 84 of Chapter 24 of the Illinois Revised Statutes, as amended. �P Section 5. That for the purpose of anticipating the collection of the second and succeeding installments of said assessment for said improve- ments, bonds shall be issued payable out of such installments, bearing interest at the rate of six.percent (6%) per annum, payable annually, and signed by the President of'the municipality, and attested by its Clerk, under the corporate seal of the said municipality. _Sai.d bonds shall be issued in accordance with, and shall in all respects conform to the provisions of Article 84 of Chapter 24 of the Illinois Revised Statutes, as amended. ° Section 6. That THOMAS A, MATTHEWS, attorney for the Village, be and he is hereby directed to file a pet.ition in the County Court of Lake County, being the County in which the territory to be affected is situated, as pro- vided by law in'the name of the municipality, praying that steps may be taken to levy a special assessment for said improvements,`in accordance with the provisd•ons of this ordinance and in the manner prescribed by law.
