O-58-2964 Page 1 ORDINANCE 0-58-29 ORDINANCE GRANTING RIGHTS AND PRIVILEGES TO THE NORTH SHORE GAS COMPANY BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE COUNTY, ILLINOIS: WHEREAS, NORTH SHORE GAS COMPANY, an Illinois corporation, is now operating in the Village of Deerfield by virtue of an Ordinance passed April 9, 1946, which ordinance and franchise expired April 9, 1956, and it is deemed advantageous by the President and Board of Trustees of the Village of Deerfield at this time to grant a new franchise to said North Shore Gas Company, its successors and assigns; NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED by the President and Board of Trustees of the Village of Deerfield, Lake County, Illinois: SECTION I. That permission and authority be, and the same is hereby granted to North Shore Gas Company, an Illinois corporation, its successors and assigns, to construct, maintain and operate its gas system for the production and distribution of gas for heating, lighting, power and other purposes, in- eluding the right to maintain and operate all gas mains and distribution lines now located in the streets, alleys, public grounds and public places in the Village, and the right to construct, maintain and operate new lines of gas mains and branches upon acid under all the streets, alleys, public d grounds and public places in said Village, or which may hereafter become a part of said Village, and to construct, maintain and operate all necessary connections, services and return pipes and other apparatus necessary or desirable for the effective distribution and utilization of gas for the purpose stated, and other purposes. SECTION II. That said grantee shall do no permanent injury to any street, sidewalk, alley, avenue, shade tree, public grounds or public places, or in any manner - unnecessarily disturb or interfere with any water pipe, sewer, gas pipe, conduit or underground work now or hereafter laid by said Village, or by an authorized company or corporation, and when said grantee shall open ground in any street, avenue or public place in said Village, the grantee shall forthwith restore the said street, pavement, sidewalk, ground, water Page 2 .1, . , pipes, conduits or other underground work to a condition equally as good as the same were in immediately prior to the opening of said ground by said grantee; water to be furnished by the Village under the supervision of the ' Superintendent of Public Works of said Village, shall be used in filling and settling trenches, the cost thereof to be paid by the grantee, and if grantee fails or refuses to properly fill all trenches opened by them, the same may be filled by said Village and said grantee shall be liable for and pay the costs thereof. SECTION III. Said grantee shall not open or encumber more of any street, avenue, alley or public place at any one time than may be necessary to enable said grantee to proceed with advantage in the laying of such mains, pipes, tubing, feeding or service pipes, nor shall said grantee permit any such streets, avenues, alleys or public places to remain open or encumbered for a longer period than shall be necessary to complete the work for which the same shall have been opened, or without putting up the necessary barriers or lights to effectually prevent the happening of any accident in consequence of such opening or encumbering of such streets, avenues, alleys or public grounds. SECTION IV. Said grantee shall lay their mains on such part or parts of the streets as the Village of Deerfield shall designate, and shall furnish to said Village a chart showing the location of the entire system of mains, pipes and appurtenances at the time of the beginning of the manufacture of supplying the gas, and when additions or extensions are made to said system the grantee shall furnish said Village with charts of said extensions or additions as soon as said extensions or additions are completed or at such time as said Village shall designate. 4 SECTION V. Said grantee agrees to hold and keep the Village harmless from any and all damages, expense or liability resulting from any work done or action taken by or on behalf of the grantee, its officers, agents, employees or contractors, under the terms of this ordinance;.and agrees to reimburse and indemnify the Village for any such expense, loss or liability.
