O-58-26610 ORDINANCE 0 -58 -26 BE IT ORDAINED by the Pres.i;dent and Board of Trustees of the Village of Deerfield, that: Section 1. This ordinance, when accepted by Harold D. Friedman, Chicago Construction Company, shall be a contract between Hardid D. Driedman, Chicago Cons tructi (n Company, and the Village of Deerfield. Sectbon 2. By acceptance of this ordinance, Harold D. Friedman, Chicago Construction Company, states that he has furnished and paid for all labor and materials needed for the installation of an eight -inch clay sanitary sewer with all necessary appurtenances thereto, in compliance with the plans and specifications approved by the Village, of a length of apporximately 662 feet in the proposed right -of -way of Wilmot Road in the Village of Deer- field for the installation and maintenance of a sanitary sewer main extending northerly from approximately 1,180 feet north of Deerfield Road, as shown on the attached plat, a length of approximately 662 feet to the south line of Greenmont Subdivision, Unit 1, to a connection with the sanitary sewer lying in Wilmot Road, said sewer lying along the west side of WM mot Road, as shown bn the "as built" plans of First Addition to Deerfield Park Subdivision prepared by Charles W. Greengard, Professional Engineer. Section 3. Such sewer shall be and become a part of the sanitary sewer system of the Village, upon its approval and acceptance by the Village. Section 4. The Village agrees to pay Harold D. Friedman, Chicago Construction Company, his heirs, successors, or assigns, the cost of such installation not to exceed the sum of $3,098.70, and shall be paid solely from the proceeds of the sewer tapping fees established by Ordinance #207, as amended, and deposited in the Sewer Capital Improvement Fund. The Village shall pay to Harold D. Friedman, Chicago Construction Company, eighty percent (80'/0) of the sewer tapping fees collected by the Village from Harold D. Friedman, Chicago Con- struction Company, and fifty percent (50'/0) of the sewer tapping fees paid by all others. Provided that Harold D. Friedman, Chicago Construction Company, shall have no claim against the Village for reimbursement other than such sewer tapping fees. ' T cave* a ? The connection fee to be charged premises for connection with the sewer main hereinabove described shall be $229.95 per connection; provided that where connection is made to serve more than one premise, the fee to be paid shall be $229.95 for each premise to be served by such connection. Section 6. All connections with the sewer hereinabove described shall be made in full compliance with the ordinances of the Village relating to such connections, and no connection shall be made except upon payment of the "3 fee herein established. r--� M PASSED: This 11th day of June, 1958.
