ORDINANCE NO. 0 -15 -28
AN ORDINANCE VACATING A PORTION OF AN EAST -WEST ALLEY
BETWEEN SOMERSET AVENUE AND FAIR OAKS AVENUE
WHEREAS, the Village of Deerfield is a home rule unit of local government under the
provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, as a home rule unit of local government, except as limited by Article VII,
Section 6, the Village of Deerfield may exercise any power and perform any function pertaining to
its government and affairs, including but not limited to providing for the public health, safety and
welfare; and
WHEREAS, Section 11 -9 1 -1 of the Illinois Municipal Code (65 ILCS 5/11 -91 -1) authorizes
the Village of Deerfield to vacate any street or alley or part thereof within the Village whenever the
corporate authorities of the Village determine that the public interests will be subserved by vacating
such street or alley or part thereof, and
WHEREAS, the owner of the property commonly known as 1034 Somerset Avenue legally
described herein (the "Adjacent Parcel ") has requested that the Village vacate that part of the east -
west public alley lying between Somerset Avenue and Fair Oaks Avenue, west of Forest Avenue,
and abutting the north property line of the Adjacent Parcel, as shown on the Plat of Vacation
attached hereto (the "Alley "); and
WHEREAS, the corporate authorities of the Village of Deerfield find that said Alley, as
shown on the Plat of Vacation attached hereto and legally described herein, is of no further use to the
Village, and that the public interest will be subserved by vacating such Alley; and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that the
consideration as provided herein to be paid by the owners of the Adjacent Parcel in consideration of
the vacation of the Alley is just and adequate compensation for the vacation of the Alley and the
acquisition of title to the vacated Alley;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: The recitals to this Ordinance are incorporated into and made a part of this
Ordinance.
SECTION 2: That the portion of the east -west alley located between Somerset Avenue and
Fair Oaks Avenue, and lying west of Forest Avenue within the Village of Deerfield, as shown on the
Plat of Vacation attached hereto and legally described as follows, is hereby vacated:
THE SOUTH HALF OF THE PUBLIC ALLEY WHICH LIES EASTERLY OF THE
WEST LINE OF LOT 23 EXTENDED NORTHERLY AND WESTERLY OF LOT 21
(EXCEPT THE EAST 3 FEET THEREOF) EXTENDED NORTHERLY IN BLOCK 7 IN
DEERFIELD PARK LAND AND IMPROVEMENT ASSOCIATION SUBDIVISION IN
THE SOUTHEAST QUARTER OF SECTION 29, TOWNSHIP 43 NORTH, RANGE 12,
EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORDED MAY 5, 1898 AS DOCUMENT # 70892, IN BOOK "D" OF
PLATS PAGE 64 IN LAKE COUNTY, ILLINOIS.
SECTION 3: Pursuant to the provisions of Section 11 -91 -1 ofthe Illinois Municipal Code
(65 ILCS 5/11 -91 -1) title to all of said vacated east -west alley as shown on the Plat of Vacation
attached hereto and legally described in Section 2 of this Ordinance shall be acquired by and devolve
upon the owners of the Adjacent Parcel legally described as follows:

LOTS 21 (EXCEPT THE EAST 3 FEET THEREOF) 22 AND 23 IN BLOCK 7 IN
DEERFIELD PARK LAND AND IMPROVEMENT ASSOCIATION SUBDIVISION IN
THE SOUTHEAST %4 OF SECTION 29, TOWNSHIP 43 NORTH, RANGE 12, EAST OF
THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF
RECORDED MAY 5, 1898 AS DOCUMENT #70892, IN BOOK "D" OF PLATS PAGE
64, IN LAKE COUNTY, ILLINOIS.
SECTION 4: That the vacation of the Alley as shown on the Plat of Vacation attached
hereto and legally described in Section 2 of this Ordinance is contingent upon, and shall not take
effect until the owner or owners of the Adjacent Parcel described in Section 3 of this Ordinance shall
make payment of $1,152.00 (equal to $2.00 per square foot) to the Village of Deerfield.
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in ful I force and effect upon its passage, approval
and publication in pamphlet form as provided by law.
