ORDINANCE NO. 107
ORDINANCE GRANTING VARIANCE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF DEERFIELD, THAT:
The question of granting a variance from the terms of the Zoning Ordinance
as hereinafter described was referred by this Village Board to a commission
consisting of the members of the Zoning Board of Appeals for consideration;
the said commission, after due public notice, held a public hearing on July 15,
1953 to consider the matter. The commission found that the property known as
AMERICAN LEGION HOME, 849 .Waukegan Road
Lot 15, Block 1, Plat of the Town of Deerfield
is owned and used by the American Legion for meeting and similar purposes; that
strict compliance with Article 14, Paragraph D of the Zoning Ordinance of the
Village insofar as that section requires a twenty foot building line at the rear
of the lot would cause undue hardship and. would make it impossible for the owner
of the premises to use the same to its best advantage for the purposes for which
it.is zoned therein, and the commission also found that granting a variance to
permit the construction of a building in accordance with an application for a
permit hitherto filed with the wall of the building on the rear (East) lot line
would not have a harmful effect on any neighboring property and would not adversely
affect the use and enjoyment of any other property in the Village.
Therefore the Board of Trustees hereby adopts the findings of the commission
above referred to, and grants a variance from the terms of the Zoning Ordinance
permitting the American Legion to construct a building on the said premises with
the end wall of the said building on the rear (East) lot line.
