ORDINANCE NO. 0 -14 -11
AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE VILLAGE OF DEERFIELD TO ESTABLISH
A VILLAGE CENTER COMMISSION
WHEREAS, the Village Center Development Commission ( "VCDC ") was originally
established to advise and assist the Village Board and staff in the revitalization of the Village
downtown area; and
WHEREAS, the revitalization of the downtown area of the Village of Deerfield has been
accomplished and, accordingly, the VCDC was dissolved by the corporate authorities of the
Village of Deerfield on October 7, 2013; and
WHEREAS, the corporate authorities of the Village of Deerfield are of the opinion that a
new Village Center Commission ( "VCC ") should be established with the mission of generating
ideas for promoting of downtown Deerfield, advocating for Village Center businesses, and of
working with the Deerfield- Bannockburn - Riverwoods Chamber of Commerce (the "Chamber ")
to promote and facilitate public, private and commercial interests in downtown Deerfield; and
WHEREAS, an ad hoc VCC has met and discussed a proposed vision statement and
duties for a new Village Center Commission and have submitted their recommendations to the
corporate authorities of the Village of Deerfield regarding the establishment, purpose and duties
of a new Village Center Commission; and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that it
is in the best interests of the Village of Deerfield to establish a Village Center Commission as an
advisory body of the Village of Deerfield as provided herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That Section 2 -156 ( "Duties and Functions ") of Article 12 ( "Special
Purpose Boards and Commission ") of Chapter 2 ( "Administration ") of the Municipal Code of
the Village of Deerfield, as amended, be and the same is hereby further amended add the Village
Center Commission as a special purpose commission of the Village. Section 2 -156 is amended
to read as follows (additions are indicated by underscoring and deletions are indicated by
st-:'� gh markings):
Sec. 2 -156. Establishment; Number of Members:
There are hereby established the following special purpose boards and
commissions within the village:
Appearance review commission . 5 members
Community relations commission. 7 members
Deerfield cable and telecommunications commission . 9 members
Deerfield cemetery commission. 3 members
Family Days commission. 9 members
Fine arts commission . 7 members
Manpower commission . 5 members
Safety commission . 7 members
Sustainability commission . 12 members
Village center commission — 7 members
SECTION 2: That Subsection (a)(6) entitled "Village Center Development and
Redevelopment Commission" of Section 2 -158 ( "Duties and Functions ") of Article 12 (Special

"Purpose Boards and Commission ") of Chapter 2 ( "Administration ") of the Municipal Code of
the Village of Deerfield, as amended, be and the same is hereby further amended to read as
follows:
(6) Village Center Commission:
(A) Establishment and Purpose: The Village Center Commission is
established to advance a positive vision of Deerfield's downtown Village
Center, to support the downtown area's vitality and desirability, to support
public and private partnerships to enhance the downtown area, and to
recommend programs, efforts and partnerships to enhance the downtown
area's image, strengthen its economic base, and maintain and improve its
attractiveness and accessibility.
(B) Membership and Terms of Appointment:
1. The Village Center Commission shall consist of seven (7)
members, and such ex- officio members as the President and Board
of Trustees may deem necessary from time to time. All members
shall be appointed for a term of three (3) years. Initially, three (3)
members shall be appointed for a term of three (3) years, two (2)
members for a term of two (2) years, and two (2) members for a
term of one (1) year. All appointments thereafter shall be for a
period of three (3) years, as provided in Section 2 -157 of this
Article.
2. At least one (1) member of the Commission shall be a
representative of the Deerfield- Bannockburn - Riverwoods Chamber
of Commerce. At least one (1) member of the Commission shall
be a Village Center business operator or property owner.
(C) Functions and Duties: The Village Center Commission shall act
in an advisory capacity to the President and Board of Trustees and to the
Village administration. The Village Center Commission shall have the
following functions, duties and missions to advance a positive vision for
the downtown area, and to support the area's vitality and desirability:
1. Recommendations: Make recommendations to the Board of
Trustees regarding Village Center matters including different types
of events, promotions, attractions, programs, plans and policies.
2. Interagency Relationships: Work with Village Commissions,
the Deerfield- Bannockburn - Riverwoods Chamber of Commerce,

Village Center businesses and property owners, and other entities
to enhance and promote downtown.
3. Advocacy: Advocate for Village Center constituents to improve
the downtown, attract and retain businesses and to keep downtown
growing, dynamic and exciting.
4. Stewardship: Act as stewards of the Village Center by
representing property owners and tenants in the downtown area
and working to ensure that the downtown area is clean, safe and
accessible.
5. Contracts: When requested by the Board of Trustees, provide
recommendations with regard to entering into contracts with any
public or private agency or person related to Village Center
development or redevelopment.
6. Coordination: When requested by the Board of Trustees, make
recommendations to the Board of Trustees for the coordination of
public and private Village Center plans and programs and
structuring of policies for the downtown enhancement.
7. Proposals: When requested by the Board of Trustees, prepare,
study and approve proposals for the development and
redevelopment of Village Center properties and make
recommendations regarding said proposals to the Board of
Trustees.
8. Eminent Domain: When requested by the Board of Trustees,
make recommendations regarding the exercise of the use of
eminent domain for the acquisition of real or personal property for
the purpose of a Village Center development or redevelopment
project.
9. Real and Personal Property: When requested by the Board of
Trustees, make recommendations regarding the acquisition of,
management of, conveyance of or other disposition of real and
personal property acquired pursuant to the provisions of a
development or redevelopment plan.
10. Capital Grants and Loans: When requested by the Board of
Trustees, make recommendations regarding the application for and
acceptance of capital grants and loans from the United States and
the state of Illinois or any instrumentality of the United States or
the state of Illinois for Village Center development and

redevelopment and assist the Village administration in making
application for said capital grants and loans.
11. Bonds: When requested by the Board of Trustees, make
recommendations with regard to the borrowing of funds as may be
deemed necessary for the purpose of business district development
and redevelopment in the downtown area, including
recommendations regarding the issuance of such obligations.
12. Property Improvements: When requested by the Board of
Trustees, make recommendations with regard to selling, leasing,
trading or improving such real property as may be acquired in
connection with Village Center development and redevelopment
plans.
(D) Meetings: The commission may meet as necessary, but shall meet at
least once during each year.
SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.

SECTION 4: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
