AN ORDINANCE TO REGULATE THE
REMOVAL A1D SALE OF TOP SOIL
WITHIN THE VILLAGE LIMITS OF DEER -
FIELD, LAKE COUNTY, ILLINOIS
BE IT ORDAINED by the President and Board of Trustees of the
Village of Deerfield, Lake County, Illinois:
SECTION 1: That it shall be unlawful for any
person, firm or corporation to remove,for the purpose of sale,
the top soil of any lot, parcel or tract of ground, in the
Village of Deerfield, unless and until a permit shall have
first been obtained as hereinafter provided. Nothing; in this
section contained shall apply to the removal or excavation of
top soil in connection with any construction or use, made or
carried on, upon such premises, pursuant to permits issued by
the Village Clerk of the Village of Deerfield.
SECTION 2: That any person, firm or corporation
desiring to obtain such permit for the removal and sale of top
soil shall apply, in writing, for such permit, to the Vill &ge
Clerk, stating the approximate cubic yardage of the top soil
which it has proposed to remove, dimensions of the lot, parcel
or tract of ground affected, the purpose of such removal and
the street address, if any, of such premises. Upon the receipt
of an application for such permit, the Village Clerk shall, at
the expense of said applicant, cause to be published in a
newspaper of beneral circulation within the Village, a notice
of public hearing, at which any owners or occupants of property
that deem themselves affected by the proposed excavation, shall
have an opportunity to voice their objections to the same. Such
hearing shall be held before the Village Board of Appeals which
shall hear any objections which may be offered and shall report
to the President and Board of Trustees whether, in its opinion,

based upon said hearing, the proposed removal of top soil will
have a detrimental effect upon the values of adjacent property,
or result in the creation of unsanitary or dangerous conditions.
SECTION 3: That based upon such report, or upon
further hearings held directly before said Board, the President
and Board of Trustees shall determine venether said permit shall
issue. If the said Board authorizes the issue of a permit, then
the Village Clerk shall issue the same upon the payment of One
Hundred ($100.00) Dollars for such permit and license.
SECTION 4: That any person, firm or corporation
violating the provisions of this section shall be fined not less
than five ($5.00) Dollars nor more than Two Hundred (200.00)
Dollars for each and every offense.
SECTION 5: That all ordinances or parts of ordinances
in conflict with this ordinance, be, and the same are hereby
repealed.
SECTION 6: This ordinance shall be in full force
and effect from and after its passa8e and approval according
to law.
