RESOLUTION NO. R -08 -11
A RESOLUTION APPROVING AN EMERGENCY OPERATIONS PLAN
OF THE VILLAGE OF DEERFIELD
WHEREAS, Section 2 -125 of the Deerfield Municipal Code provides that the Village
Manager acting in the capacity of Coordinator of the Deerfield Office of Emergency Management
shall direct the preparation of an Emergency Operations Plan (EOP); and,
WHEREAS, an Emergency Operations Plan has been prepared dated January 2008 that is in
compliance with the standards of the Illinois Emergency Management Agency and is recommended
for approval by the Mayor and Board of Trustees of the Village of Deerfield; and,
WHEREAS, pursuant to 5 ILCS 140 /70j), being an exemption from the disclosure
requirements under the Freedom of Information Act, information contained within the Emergency
Operations Plan will not be available to the public.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the "Village of Deerfield Emergency Operations Plan dated January 2008
is hereby authorized and approved as the Emergency Operations Plan of the Village of Deerfield.
SECTION 2: That said Emergency Operations Plan shall be effective as of December 1,
2008, and all prior Emergency Operations Plans are hereby superseded.
SECTION 3: That this Resolution, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Resolution should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Resolution
should be inconsistent with any non - preemptive state law, this Resolution shall supersede state law
in that regard within its jurisdiction.
SECTION 4: That this Resolution shall be in full force and effect from and after its passage
and approval as provided by law.
