10/21/1991October 21, 1991 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, October 21, 1991 at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers James L. Marovitz Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Attorney James Stucko. Trustee Marovitz requested that the minutes of the previous meeting on the 727 -743 Elder Lane (Mizell) matter be amended by deleting the word "covenant" and substituting the word "agreement" in the second paragraph and deleting "covenant" in the third paragraph. Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes as amended be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee Seidman moved, seconded by Trustee Swartz, that the Bills and Payroll be approved. Motion carried by the following vote: AYES: Ehlers, Marovitz, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) TREASURER'S REPORT Finance Director George Valentine reported that sales tax receipts for June 1991 were approximately 4% over the prior year, with the current 12 month average 3% over the prior period. General Fund revenues were above projections. Water purchases are 209 over projection and water sales are currently 13% over projection. As of September 30, 1991, 102.7% of cash was invested at an average interest rate of 6.46%. Motion carried seconded by Trustee Marovitz, that the passage of the Ordinances on first unanimously. AMENDMENT TO IDOT The amendment to the IDOT agreement re the AGREEMENT -FLOOD WATER flood water retention reservoir 29A RETENTION RESERVOIR 29A attempts to lay out the responsibilities of the Village and State regarding costs relating to site maintenance and monitoring the removal and disposal.of the hazardous substance. Trustee Seidman moved, seconded by Trustee Marovitz, that the Mayor be authorized to sign an amendment to an agreement with IDOT regarding Flood Water Retention Reservoir 29A. Motion carried by the following vote: AYES: Ehlers, Marovitz, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) R -91 -9 RESOLUTION Deerfield wishes to retain services of SPECIAL• LEGAL COUNSEL - Ancel, Glink, Diamond & Cope as special HIGHLAND PARK WATER counsel to pursue legal remedies in its RATE INCREASE water rate controversy with Highland Park. Trustee Marovitz moved, seconded by Trustee Swartz, that a Resolution retaining special legal counsel, Ancel, Glink, Diamond, Cope, regarding the Highland Park water rate increase be passed. Motion carried by the following vote: AYES: Ehlers, Marovitz, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) DEDICATION AGREEMENT - ELECTRIC & EASEMENT The proposed Dedication and Easement DEERFIELD Agreement between the Village and way for Phase II of permanent easement parking lot on the _ Deerfield Electric (758 Hoffman Lane) provides for the dedication of right the Robert York Avenue improvement. A would be established to allow for a joint Savage parcel. of Trustee Seidman moved, seconded by Trustee Ehlers, that the Mayor be authorized to sign the Dedication and Easement Agreement between the Village and Deerfield Electric re Phase II of the. Robert York Avenue improvement. Motion carried by the following vote: AYES: Ehlers Marovitz, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0..� DISCUSSION_ Trustee Seidman mentioned. treat SWFICO '. hired a Recycling Coordinator who will visit Deerfield to review its recycling program. Trustee Rosenthal suggested reminding residents that Deerfield is now recycling plastic containers that are coder 1 or 2 on the bottom. Trustee Marovitz moved, seconded by Trustee Rosenthal, that following adjournment the Board go into an executive session to discuss land acquisition.
