The regular meeting of the Board of Trustees of the Village of
Deerfield was called to order by the Mayor in the Council Chamber
of the Village Hall on Monday, October 21 1989 at 8:00 P.M. The
Clerk called the roll and announced that the following were
Present: Bernard Forrest, Mayor
James L. Marovitz
Cynthia J. Marty
Harriet B. Rosenthal
Edwin B. Seidman
Vernon E. Swanson
J. Robert York
and that a quorum was present and in attendance. Also present was
Village Manager Robert Franz and Attorney James Stucko.
Trustee Marovitt requested that the minutes of the previous
meeting regarding the Liquor License request of the Residence Inn
be amended by noting his reason for voting to deny petitioner's
request was due to the question of whether The Village should be
permitting liquor to be dispensed in a situation where there is no
connection with a dining facility. People would be driving to eat
elsewhere after consuming the alcohol and traffic accidents might
occur.
Trustee Marty moved, seconded by Trustee Rosenthal, that the
minutes as amended be approved. Motion carried unanimously.
PRELIMINARY AND FINAL Trustee Seidman moved, seconded by Trustee
PLAT APPROVAL - Marovitz, to accept the recommendation of
FOUNTAINS OF DEERFIELD the Plan Commission to approve the
Preliminary and Final Plat of Subdivision
for the Fountains Development subject to the provision that
appropriate language be added to the Subdivision Plat as is
required by Article 12.1 -2 of the Zoning Ordinance. Motion
carried unanimously.
RESUBDIVISION - Trustee Marty moved, seconded by Trustee
1350 - 1356 SOMERSET Rosenthal, that the Plan Commission recom-

property at 1.350 and 1350 Somerset

Trustee Seidman moved, seconded by Trustee Marty, that the rules
be waived to permit passage of the Ordinance re Final Plan for
plaza at the southwest corner of Deerfield and Waukegan Roads on
first reading. Motion carried unanimously.
Trustee Seidman moved, seconded by Trustee Rosenthal, that the
Consent Agenda be approved and the Ordinances adopted. Motion
carried by the following vote:

0 -89 -54 ORDINANCE Village Attorney James Stucko advised that
MUNICIPAL CODE the proposed Village Ordinance would not
AMENDMENT RE violate the Happy Hour legislation recently
ALCOHOLIC BEVERAGES enacted by the State. Subsection (c)(3) of
the proposed Ordinance states that a
licensee is not prohibited from "including drinks of alcoholic
liquor as a part of a hotel package ". There is a provision in
the Ordinance for hotels but not for extended stay facilities.
Trustee Marovitz expressed his belief that this subsection was a
promotion of alcoholic beverages. Where there is no connection
with a food facility the possibility exists for traffic accidents
caused by guests driving to dine elsewhere after consuming the
complimentary beverages.
Trustee Seidman moved, seconded by Trustee Marovitz, that the
proposed amendment to the Municipal Code re Alcoholic Beverages
be amended by deleting Subsection (c)(3). Motion failed by the
following vote:

Trustee Marovitz moved, seconded-by Trustee Rosenthal, that the
Ordinance amending Municipal Code re alcoholic beverages be
adopted. Motion carried by the following vote:
AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6)

LIQUOR LICENSE REQUEST Mike Malicki, attorney representing
RESIDENCE INN st'a�ed Ghat Residence Inn would
reduce the number of hours and days,
restrict complimentary beer and wine to hotel guests only and
accept any limitations the Board desired in granting this license.
Trustee Marovitz stated that granting a liquor license to an
extended stay facility to dispense complimentary beverages without
an on -site food facility was something Deerfield should not
promote.

Trustee Seidman moved, seconded by Trustee Marovitz, that the
rules be waived to permit passage of ,the Ordinance on first
reading. Motion carried unanimously.
Trustee Marovitz moved, seconded by Trustee Rosenthal, that the
Ordinance amending Municipal Code re Liquor License for Residence
Inn by Marriott, Inc., amended by restricting the hours to 5 and 7
P.M., be adopted. Motion failed by the following vote:
AYES: Marty, Rosenthal, York (3)
NAYS: Marovitz, Seidman, Swanson,.Forrest (4)
PROPOSED TRAFFIC The Board discussed a proposal from the
STUDY -LAKE COOK ROAD Cook County Highway Department involving a
joint agreement with Highland Park,
Northbrook, Deerfield and Cook County for sharing the costs of a
traffic study of Lake Cook Road from the Illinois Tollway to Edens
Expressway. The Village Staff recommends participation in this
study. Board members agreed that Deerfield should participate but
were not pleased with the terms and cost of the study. It was
decided that a meeting be scheduled with the Cook County Highway
Department to discuss the concerns of the Village regarding this
proposal.
Trustee Marty, moved, seconded by Trustee Rosenthal, to table the
authorization to participate in a proposed traffic study until the
Board has met with the Cook County Highway Department. Motion
carried unanimously.
There being no further business, upon motion of Trustee
Rosenthal, seconded by Trustee Marty, the meeting adjourned at
8:40 P.M.
