The regular meeting of the Board of Trustees of the Village of
Deerfield was called to order by the Clerk, in the Council Chamber of
the Village Hall on Monday, March 16, 1987 at 8:00 P.M. The Clerk
called the roll and announced that the following were

and that a quorum was present and in attendance. Also present were
Village Manager Robert Franz and Village Attorney James Stucko.
Trustee Seidman moved, seconded by Trustee Marovitz, that the minutes
of the previous meeting be approved. Motion carried unanimously.
BILLS & PAYROLL Trustee Seidman moved, seconded by Trustee Marty,
that the Bills and Payroll for February as
submitted by Finance Director George Valentine be approved. Motion
carried by the following vote:
AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6)
NAYS: None (0)
TREASURER'S REPORT Finance Director George Valentine noted there was
a slight inconsistency in the table of his report
due to the late reporting by the State. He commented that the sales tax
receipts increased 11% over last year, which was the largest increase in
some time. This brings the rolling average up to 4 %. Cash was invested
at an average interest rate of 6.4 %.
PUBLIC WORKS - Director of Public Works, Ed Klasinski, appeared
DEPARTMENTAL before the Board and answered a few questions
OBJECTIVES regarding,items in his written report. The Board
accepted the report and commended Mr. Klasinski on
his Department's fine work.
AMENDMENT TO SPECIAL Michael Delaney, Vice President of the Park Board,
USE - CLAVEY FIELD spoke on the changes the Park District would make
at Clavey Field in an attempt to reach a
compromise with the Clavey Park residents. He mentioned moving the
pole near Chatham Circle 150 feet to the west lowering all poles to 50
feet, louvering and adjusting the lights on Diamonds 10 and 12,
establishing a Citizens Advi=sory Committee consisting of 7 people to
review landscaping plans and priority on plantings. The Park District
is willing to spend $60,000 - $70,000 over the next 3 years on landscap-
ing. Mr. Delaney requested the Village to grant a Special Use permit
and spell out the Village requirements. If granted the permit, work
would start immediately at Clavey Field. He also requested the Clavey
Park residents to drop all present and future law suits, the Village
allow a soccer field at the Brickyards and a 11 P.M. curfew at Jewett
and Clavey Parks.

Board should consider the King Richards residents in this matter.

Joseph Morrison, attorney representing the Clavey Park Neighbors, asked that
Jewett Park be separated from the Plan. Commission recommendation and treated
separately. He stated that his clients were still unanimously opposed to the
special use permit for Clavey Field as presented.
Marshall Hechter, representing DYBA, urged the Board to take action that evening
on making the lights available at the parks. Time is critical for DYBA scheduling.
He also urged that the .lights at Jewett Park be permitted to be on until 11:00 P.M.
Mayor Forrest made a statement which is attached hereto and made a part of
these minutes.

Trustee Marty moved, seconded by Trustee Seidman, that the Resolution be passed.

Trustee Marty moved, seconded by Trustee Seidman, that the rules be waived to
permit passage of the ordinance on first reading. Motion carried unanimously.

a special use for Jewett Park be adopted. Motion carried by the following vote:

RECOMMENDATION that the Plan Commission recommendation to deny the

The meeting was recessed at 9:20 P.M. and resumed at 9:30
WALKWAY ACCESS/ Lot 13 which had been sugges;:ec: at one previous
WOODLAND PARK Village Board meeting as a site for a walkway was
determined to be unsuitable since it would lead
through a wooded area. Herbert Zaltzman, representing Chesterfield Development,
reaffirmed Chesterfield's desire to cooperate with the Village in whatever
decision it made regarding a-walkway access to Woodland Park. Several residents
of the subdivision spoke in support of the walkway and others voiced their op-
position.
It was generally agreed by the Board that, while a walkway would be beneficial to
the area, providing one at this time could present more problems that it would
resolve. Trustee York moved, seconded by Trustee Marty, that the recommendation
of the Board of Zoning Apppeals to drop the issue of providing a walkway to
Woodland Park be accepted. Motion carried, Trustee Seidman dissenting.

SPECIAL USE - Michael Gidwitz, petitioner, described the type of
RESTAURANT AT °restaurant proposed for-the Multiplex facility.

Trustee Marty moved, seconded by Trustee Rosenthal,
that the recommendation of the Plan Commission to grant a Special Use for a
restaurant as part of the Multiplex facility in the Lake -Cook Plaza Shopping
Center be accepted and the attorney directed to prepare the necessary ordinance.
Motion carried unanimously.
DEERCREST - FINAL Trustee Rosenthal moved, seconded by Trustee Marty,

A discussion following the above motion resulted in the following action: Trustee
Swanson moved, seconded by Trustee Marovitz, to table to the next meeting the
recommendation of the Plan Commission regarding the Special Use text amendment
for a self- storage facility in the Brickyards, Flodstrom property, Deer Lake Road.
Motion carried unanimously.
SPECIAL USE - Mr. Robert Speckmann, representing Zion Lutheran
COURT FACILITY/ Church, described the space in the church building
ZION LUTHERAN CHURCH that was available for use by the Branch Court of
Lake County. Police Chief Brandt answered questions
on the. traffic problems which might occur. He noted the advantages of time and
money saved by the Police Department and the convenience for the area residents
with a court in the immediate vicinity. An offer by Flodstrom Construction Company
for possible space in the Deerbrook Office Center was noted.
A number of residents from Heather Lane and Colony Point spoke in opposition to
a traffic court at Zion Lutheran Church.
Trustee Seidman moved, seconded by Trustee Marovitz, that the recommendation of
the Plan Commission to deny a Special Use, Court Facility, Zion Lutheran Church,
be accepted. Motion carried by the following vote:
AYES: Forrest, Marovitz, Marty, Rosenthal (4)

ABSTAIN: Seidman, Swanson (2)
Mayor Forrest thanked the Zion Lutheran Church for their cooperation in offering
the use of their facility.

EMERGENCY REPAIRS/ Marty, that a contract for emergency repairs to _

Sealants & Waterproofing, Inc. in an amount not to
exceed $2,250.00. Motion carried by the following vote:

AWARD OF BID - The Village proposes to install a 12 -inch water
WATER IMPROVEMENT valve in a 5 foot vault on Lake Cook Road for
VALVE /VALVE VAULT better control of the water distribution system
and to facilitate utility relocation when an
underpass is constructed.
Trustee Marty moved, seconded by Trustee Rosenthal, that a contract for
a water improvement valve and valve vault on Lake Cook Road be awarded
to Meyerbrook Contractors in an-amount not to exceed $7,950.00. Motion
carried by the following vote:

TENTATIVE ANNUAL that there be a waiver of rules on first reading

designating a Canvassing Board, naming Harriet E. Rosenthal to serve on

MAYOR FORREST'S STATEMENT ON LIGHT CONTROVERSY
Few issues have consumed as much Village Board time as the Park District light
controversy. Although the Village has been criticized for delaying a decision
on this matter, we have tried for the past several months to work out a compromise
acceptable to all parties and, hopefully, in the best interests of the community
as a whole.
As I have stated from the beginning, I believe that the intrusion of lights into
a single home as a result of the Park District's expansion of the use of Clavey
Field, is unacceptable. Unless shielding can be done to prevent the lights from
shining in the homes - particularly those on Chatham Circle, which are the closest
to Field 12 - the special use for Clavey Field should be denied.
However, I do think the Park District has a problem and that the Village should
assist them as much as we can in relocating the lights to the Brickyards. I
would like to propose that the Board take the following actions:
1. Pass a Resolution regarding the Park District's use of a portion of the Brickyards
tonight and that the Village assist in moving the soccer lights (and baseball lights
also, if the Park District chooses) to the Brickyards.
2. Approve the.lights as previously recommended by the Plan Commission for Jewett
Park.
3. Return the lights on Field 10 to their original state before they can be used.
4. Deny the special use for the Clavey lights and direct that all soccer lights
be removed within the next 90 days. I do not feel that Village Board meetings are
the appropriate place to negotiate a compromise regarding lights on Field 12.
There appear to be good reasons for the Park District and the Clavey Park home-
owners to continue their discussions on this matter. However, whatever the outcome,
the Park District should return to the Plan Commission and present a proposal for
Field 12. Once that process is completed and all input received, a recommendation
should then come back to the Board.
In retrospect, the Park District should have held public hearings to make certain
that the Clavey residents were fully conversant with their plans for lights in that
area. The Village has always followed these procedures and we find that, while the
public may not agree with our final decision, gaining initial input from them im-
proves the decision- making process.
In making this proposal, I recognize full well the Park District's right and duty
to conduct recreational activities in Deerfield. At the same time, I hope that
they recognize this governmental body's obligation to protect the rights of its
property owners.
