12/18/1972December 18, 1972 A meeting of the Board of Local Improvements of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, December 18, 1972 at 8:12 p.m. The secretary called the roll and reported that the following were Present: Bernard Forrest, President Albert E. Brust Werner E. Neuman Stephen M. Slavin Daniel H. Stiehr M. Jay Turner, Jr. Absent: George Kelm and that a quorum was present and in attendance at the meeting. Also present were Mr. Richard Houpt, Village attorney, and Mrs. Marjorie Emery, representing the m anager. . Petitions - Gordon Ter. Petitions were received from the owners of Improvements Lots 55, 56, 66, 96, 100, 106, 130 and 135, Hovland Subdivision, requesting the paving of Gordon Terrace by Special Assessments, as soon as possible. A letter from the attorney for Mrs. Davi-d(:Bertram, owner of Lot 95, opposed the proposed improve- ment. The Village attorney explained that when the owners of one -half or more of the property to be improved petition for the improvement by special assess- ments, the Statutes provide and it is mandatory for the Board of Local Improve- ments to institute a special assessment proceeding. Other property can be in- cluded in the project if the Board deems it desirable, and the nature of the improvement can also be determined by the Board. At the Court hearing on the assessment, all property owners have the right to object to the amount of the assessment as it relates to the henefit conferred by the improvement. The first step in a special assessment proceeding is to authorize the engineer to prepare the estimate of cost of the improvement. Mr. Stiehr moved, seconded by Mr. Brust, that the matter be tabled until the building commissioner has contacted the owners of all property on Gordon Terrace, or 60 days. Adopted by the following vote: Ayes: Brust, Stiehr, Turner (3) Nays: Neuman, Slavin (2) Re: Wilmot Sidewalk S/A The SAfety Council has recommended that a sidewalk be constructed on the west side of Wilmot Road north of Greenwood Avenue. The.Village attorney suggested that before proceeding further with the project, ­an effort be made to get the property owners together to try to work out an understanding on what would be acceptable to the Board and owners. If agreement cannot be reached, the only alternative would be two assessments, the first for properties where owners are willing, the second for those unwilling. Both curb and gutter will be constructed, and where the owners are unwilling, it will be necessary to condemn right -of -way for the improve- ments. 1 Mr. Brust moved, seconded by Mr. Stiehr, that the Village attorney be directed to contact the homeowners affected by the assessment, to see if an agreement can be reached, and to report in 30 days. Adopted by the following vote: Ayes: Brust, Neuman, Stiehr, Slavin (4) Nays: Yurner (1) Authorize Estimate of Cost Gordon Terrace Improvements Motion carried unanimously. Mr. Brust moved, seconded by Mr. Slavin, that the engineer be authorized to develop the cost estimate for Gordon Terrace improvements. Completion of all streets in Hovland Subdivision was urged by several property owners. One owner stated his lot was lower than the present grade of the unimproved street, and he hoped that flooding would be taken into consideration when plans for the improvement are designed.
